let's start with anthony weiner. the field for the mayoral race will have anthony weiner to kick around. he's refusing to drop out of the race after revealing he continued sexting long after the same lewd behavior forced him to resign from congress. months after the resignation and while working on his marriage, he was engaged in the same behavior. dana bash is live with reaction from his political rivals and would be constituents. >> reporter: with anthony weiner on the mayoral counsel, facebook is awkward. >> all i can say is don't ask me. >> reporter: a light hearted moment. >> people around the city called on you to withdrawal. you are distracting from focusing on the middle class and ideas. >> if you want to play to the

however despite it failing, the overall nearly $600 million defense spending bill did pass. four f-16 fighter jets will not be heading to egypt yet. the pentagon is delaying it as the administration continues after they overthrew president morsi. pope francis, today, meets the poor in rio de janeiro. police are expected to be out in force during this visit. 20% of rio's residents live there. the pope is said to have specifically asked to see one in person during this trip to brazil. tropical storm dorey is the fourth named storm. forecasters are keeping a close watch on it. indra petersons is one of the forecasters. what is the storm headed our

way? >> good morning. it's interesting because it's early in the season. there are a lot of things to inhibit its growth. it's a strong, tropical storm. it is trying so hard to hold together. winds moving at 16 miles per hour. it's moving quickly to the west/northwest at 17 miles per hour. let's talk about what is ahead of it in its path. all of this dry air. we are watching all of this. anything up here could weaken the system. the next thing we have to look at is sea surface temperatures, how warm the water is. a hurricane for growth needs 79 degree temperatures. it's on the threshold of the two. we have to look at where it goes, the 80 degree waters or the cooler waters? the other thing is how fast it moves over the cooler waters if it's in the cooler water. if it's there and stay there is longer, it will weaken as well. aside from that, the next 48 hours are going to be critical. we are watching the path.

now to spain and a deadly train derailment. dozens are dead after the train crashed in the northwestern part of the country. look at this. it's almost snapped in two. al goodman has the latest on the phone from near the scene of the cra crash. what is the latest this morning, al? >> caller: i am looking at the scene. the prime minister was her a short while ago, said nothing. 77 dead. that means about a third of the people who got on that train in madrid yesterday are now dead. a court official tells cnn that

considered. they said he was passing through immigration at one point. his lawyer came to meet him, went into the secure transit zone and emergeed from the meeting saying absolutely not true. he has not received any documentation. he applied for asylum more than a week ago. that's the usual process. no explanation for the delay except to say that it's an unprecedented case. there's a lot of paperwork, a lot of beaurocracy and he would no longer speculate on how long it could take for snowden to walk free. it's now approaching five weeks. >> he finally got a change of clothes and reading material. interesting to see what the next move is. thank you. a 17-year-old is in the hospital accused of suffocating a young neighbor and shooting a police officer who tried to arrest him. he was shot in the head after police say he pulled a gun on them near the family's home in ft. worth. he faces murder and attempted

murder charges. they believe he sexually assaulted a 6-year-old girl, then suffocated her. her body was found wrapped in a tarp a mile from home. bill belichick speaking publicly for the first time since aaron hernandez was charged with murder. she was shocked to hear he was involved in something so tragic. >> it's a sad day. it's really a sad day on so many levels. our thoughts and prayers are with the family of the victim and i extend my sympathy, really, to everyone who has been impacted. a young man lost his life. and his family suffered a tragic loss. there's no way to understate that. >> meantime, aaron hernandez was back in court wednesday for the first time since pleading not guilty in the death of odin

wednesday's earnings showed mark zuckerberg was able to take mobile advertising from nothing to make it $1.6 billion that's what wall street wanted to see. mainly, the number of people using face book increased 51%. 819 million people are using facebook now on mobile phones or tablets. the other big story, apple. apple shares had the best day in a year. shares rose 5.1%. at $442 a share, it's the biggest one day percentage share. better than expected iphone sales. profits down 22%. the silver lining is that apple does have new products in the pipeline they hope can reenergize sales though they haven't launched something new in several quarters. visa raised the outlook because credit card spending

heading toward me, toward the town. you can see the force of the impact. some of the cars slid down and embankment. there's all sorts of train tracks, that help keep the trains running. at this point, we have cranes that lifted some of these absolutely mangled cars up to the street level. that's the area the spanish prime minister visited in the last hour, spending 15 minutes here. he is from the area. christine? >> what caused the crash? do we know yet? what are they zeroing in on? >> excessive speed. possibly twice as fast as the train should have been going around the curve. that's been the lead in various newspapers. the spanish government in charge of the rail system said there is no firm hypothesis yet on what happened. we have heard it does not appear

to be terrorism. no one is talking about terrorists. was there human error or mechanical error? tell us about the death toll and the number injured. is that expected to rise? >> caller: unfortunately, yes. 77 people are confirmed dead by the court system here. it's court officials who confirm those figures. they are still working on the scene. a spokeswoman says they expect to find other bodies in cars. dozens and dozens of people injured, some in serious injury. just to give you an idea, 218 people aboard this train, a third of those people are now dead. christine? >> what a tragedy in a beautiful town. a town of pilgrims who take a beautiful walk there. it is some place that is loved.

this ruling puts the challenges on hold. they have yet to make a decision about the merits in the case. the retired workers, what they are concerned about, pensions. big cuts to their pensions. they rely on their pensions. in a bankruptcy, they fear it will go away or cut dramatically. it will have a big impact on it. >> to be able to retire and have money there. it's a concern. >> librarians and people depending on a pension. it will not be there in bankruptcy. we know it now has a change. we are not talking the prince, it's a tropical storm. dorian isn't a threat to us. we watched it yesterday, a tropical depression. it's made the turn to a storm. >> one of the things that's unusual dur thg time of year, the water is close to the shoreline. it formed out where we see more formation in august off the

coast of africa. now a strong tropical storm with 60-mile-per-hour winds and moving quickly. it's 17 miles per hour. a couple things could inhibit the growth. a lot of dry air ahead of it, not a good thing. it will weaken it. we are looking at temperatures here. waters above 79 degrees. you can see it's right on the borderline. where it goes and how fast it goes over cold water. it does go over colder water determines how much it will weaken. the other thing, if it stays together after all of this, we have a lot of wind shear. we are talking winds at upper levels that could weaken it. all these factors determine whether or not it holds together. either way, a dome of high pressure. thanks to that, it will go west, west-northwest. with that, the current thinking is it's above puerto rico monday staying a tropical storm. it's a small system. no effect to the islands, currently, at least in this track. we are talking rough seas and
