traffic still looking good. >> and despite negotiations democrats and republicans can't reach a deal on a special tax election. a frustrated governor jerry brown say they may miss a wednesday deadline to pass a balanced state budget. >> you are not kristen sze. i'm carolyn tyler. good morning zmoo. >> johannes mehserle was reached from jail for shooting and killing a bart passenger two years ago. protestors believe the sentence was too short set to the streets of oakland last night. amy hollyfield has more on the peaceful protests. >> some businesses were prepared for chaos take a look at the foot locker is boarded up along with a few other businesses. the protest was calm. there were no reports of any

broken windows. the rally started at the fruitvale bart station yesterday afternoon. that is johannes mehserle shot and killed oscar grant. protestors marched to city hall and had only one disrugs when two men were disrupted. mehserle was released from jail just after midnight today. he served one year. he was sentenced to two. it was one of the harshest sentences for an officer-involved shooting here in california but grant's supporters feel like mehserle got off easy. >> a crime was committed but it wasn't paid for. this needs to stop and the only way it going to stop is if we all stand together. >> mehserle's attorney will not say what mehserle's plans are now or where he will live. details of his parole has not been released. he still faces a federal civil

suit that has been filed by granted's family. protestors say this will not be the end of their demonstration. the oscar grant coalition has a meeting scheduled for later this month where it will plan future activities. amy hollyfield "abc 7 news." more details on that. it took nearly two years for johannes mehserle to be charged tried and convicted in the new year's day 2009 shooting. a jury found him guilty of involuntary manslaughter. judge dismissed a gun enhancement charge saying there was insufficient evidence. mehserle was sentenced on november 5th of last year. he 365 days including the time prior to sentencing. lawyer lawyer is covering the mehserle -- lawyer ray anthony is covering and we are posting

updates at our website at abc7news.com. in just a few hours a federal judge will hear a motion to throw out judge vaughn walker's ruling california's ban on same-sex marriage is unconstitutional. at issue is judge walker himself on whether he should have disclosed his ten-year openly gay relationship before ruling on the same sex marriage ban. most legal scholars agree that his sexuality preference is not an issue but the fact he did not disclose the gay relationship does stir an ethical debate. the motion to vacate the ruling was filed by backers of proposition 8 supporters of same-sex marriage say they will demonstrate outside the federal courthouse before the 9:00 a.m. hearing. police are looking for suspects in a weekend shooting in east san jose that left three people wounded. it happened in the wee hours of the morning.

first a man and juvenile were shot while walking in the area around 2:30 in the morning. police say a third victim a boy was shot earlier that morning. >> the family and friends of missing nursing student michelle le are not giving up and working for her safe return. mark klags s whose 12-year-old daughter was kidnapped and murdered has joined in the search effort. hayward police continue to look for le's body and follow leads. jonathan bloom reports. >> they promised not give up hope they gathered a handful of supporters. $65,000 reward they are now offering for michelle's safe return. >> it's not over for us. >> reporter: even though convinced that she was murdered.

as they search for their bodies they have launched their own search for clues that could bring the nursing student home alive. >> reporter: blanketing the area they went door to door asking for help. and although they came up light on information neighbor's hearts were heavy on sympathy. >> i'm really soar you haven't found her yet. >> reporter: by the time friends and family were finished cars and bicycles were displaying the flier and the $65,000 reward. with police now no longer expecting to find her live it's important for the family to remain hopeful and encourage neighbors as well.

the north. a couple of areas of clockwise motion and clouds. those are areas of high pressure. we have this exactly to the west and another one down to the south. that is were we're going to see the warming trend because the storm track to the north and we'll get an offshore wind or land breeze starting tomorrow. right now, we still have a little bit of a breeze coming ashore. west wind at 6 miles an hour and about the same in fairfield. fremont southward temperatures one to three degrees cooler. 60 in antioch right now. everybody else pretty much in the low to mid-50s. low to mid-60s around half moon bay. 68 in san francisco with mid to upper 70s through the bay shore to the south bay and low 80s develop in the north bay and east bay valleys. tomorrow i think it will be the warmest day and also thursday. then we'll see a slight cooling trend as we head through the weekend. good morning frances.

>> the weather looks great but traffic this morning we've already had an accident in mountain view. westbound 2378 approaching highway 85. it happened around 3:00 this morning but right now it's only blocking one lane. keep that in mind as you make your way through the mountain view area. also there is road work going on eastbound 4. you've probably seen this. it's not a slow freeway closure at this point. a lane is blocked around leverage and that is expected until about 5:30 so less than an hour to go. >> it is 4:40. still ahead confusion over evidence in the bryan stow case. >> and revealing second go photos that is adding fuel for anthony weiner to resign.

paul tim pawlenty rick santorum and herman cain. >> getting our first look at gabrielle giffords five months after she was critically wounded in the tucson shooting rampage. photos are the first clear evidence of just how far she has progressed since being shot in the headed. her short hair is one of few signs of her brain injury and surgery. here is more from bob woodruff. >> since first time since the shooting in tucson we see her face her characteristic smile and upbeat spirit. the photos were taken on may 17th one day after she traveled to florida to witness her husband launch into space. along with the photos came the news that before the end of this month, the congresswoman will be released from the memorial hermann hospital science she has lived since january.

emeryville back but most of those are staying at the coast for now. let's check out the temperatures. if you are leaving it's 50 in antioch. around the monterey bay we have temperatures in the low to mid-50s and sincerely and even a 49 at gilroy. highlights for this forecast. warming continues sunshine just about everywhere. clouds at the coast and should be clear everywhere else and clear and sunny for the weekend. as far as what is happening right now clouds move a little closer to the coast and some of those tried to spill into the bay but once the sun comes up it clouds retreat back to the coast where they are going to stay keeping you in the 50s. 70s around the bay and a lot of 80s inland neighborhoods south bay, los gatos will hit 80 and everybody else in the mid to upper 70s. peninsula, low to mid-70s top to bottom as you head into the south bay los altos around 70
