a man could walk out of a south bay hospital this morning two days and two millimeters from a watery death. he was bitten by a shark while surfing. katie marzullo is live at san jose regional. he may be ready to talk to the media this morning >> reporter: we are hoping. he said he would when he was released. he could be released today this is my favorite quote one of the surgeons seder rick tarantino is one of the luckiest unlucky people there is. no kidding he not only survived the shark attack but he could be home with nonlife-threatening injuries not 48 hours later. this happened saturday morning when tarantino was surfing at marina state beach in monterey county. the shack attacked and bit him on the neck and just narrowly missing his jugular vein and his carotid artery. he was also hit on his forearm

and his surf board took a hit 19 inch piece missing from that. his friend said in all his years of surfing he had never seen a shark. tarantino alerted him to the fact there was one in the water where they were that morning. >> wave came and i atop the wave and when i came over-the-top he started yelling, "shark shark shark." >> they travel fast and it is a big ocean. for safety sake we will be posting beaches and recommending people don't go in the water. >> reporter: better safe than sorry. tarantino did tells did he thinks the shark was nine feet long. even if that shark is gone there could be others late summer to early fall is when shark activity is at its peak in the area known as the red triangle. 27-year-old eric tarantino lives to tell about his narrow escape from the jaws of what might have been a great

to assess this daily. protesters held strategizing sessions over the weekend. they are calling for a general strike wednesday. they are getting promises have a variety of groups they will weak -- walk out including some union workers who land to shutdown the port of oakland. protesters say they are back and it feels good given the confrontation they had last week with . >> it means the -- week with police. it means the movement has a lot of momentum. they didn't realize that. there was a ground swell of support. i think maybe the -- -- the energy was tenser last week there was a lot of uncertainy. now i think the movement has more confidence. >> reporter: oakland's police chief was quoted over the weekend saying this tent city poses significant public safety hazards to the citizens and police.

he thinks this crowd would react hostilely to police if officers needed to get in to help someone. the mayor believes forcing people to leave would lead to more violence going to keep watching the situation. city officials are rean you are the city of oakland that -- are reassuring the city of oakland that crucial services will be available wednesday despite the planned city wide strike. amy hollyfield abc7 news. there's also a new online twist to the occupy oakland protest. a website that is posting a fake statement from mayor quan supporting the movement. this is the bogus site oaklandmayor.com. it has a statement reportedly from quan that apologizes for last week's police raid at frank ogawa plaza. this bogus statement goes on to endorse the call for that general strike wednesday that

amy was just telling you about. here's mayor quan's real sight at oakland net.com in the real site quan does apologize for police movement but nothing about a call for a general strike. 10 peacekeepers are volunteering to help ensure tent city in justin herman plaza is safe, clean and drug-free. they wear arm bans so they can be easily identified -- arm bands so they can be easily identified. they are trying to make the area more family-friendly. they want to include children in the activities because much of the occupy movement is geared towards a better future for children. if you felt a little rattle overnight it wind your imagination just the latest earthquake to strike on the hayward fault near berkeley. 2.4 quake struck two miles east of berkeley at 2:42 this morning.

look behind me at the tent city in front of city hall. looks like it did a week ago before police cleared it you. the mayor is allowing it to stay. we have not seen any police officers in the plaza this morning. protesters have been quietly planning in the plaza. calling for a general strike wednesday. they've asked city officials to return their medical supplies. a spokeswoman for the mayor says they will give them back. the group organized a march saturday mostly peaceful. protesters say they refuse to let last week's confrontation weaken their will. >> i think people bad mouthed this out of stereotypes and it showed that it had more people power. everyone seeing something magical happening itch >> reporter: wednesday's strike is gaining support. there's word that union workers plan to shutdown the port of oakland wednesday evening. city officials are prompting

that essential city services will be -- are promising that essential city services will be available no matter who walks out on-the-job. there was reports that they would be occupying the mayor's off today. the group tells us that was not official lay proved by the group. they don't know who -- who put that statement out. they say that is not in their plan planning for wednesday's strike. amy hollyfield abc7 news. 6:32 now this morning doctors say the iraq war veteran injured in last tuesday's clash between occupy protesters and oakland police is now expected to make a full recovery. a close friend of scott olsen says he seems seems to be doing well but still can't talk after suffering a skull fracture. he was hit in the head by a project as police fired tear gas into the . police are investigating. olsen was rushed to the

hospital but has been transfered to another medical facility. in santa rosa occupy protesters set up an illegal r the weekend. city leaders are#z/ letting them stay for now. health and safety issues are concerns. the incident in oakland last week has had influence in how officials are handling the situation there. >> it was best to an individual a so-called showdown that was not in our interests there interests. >> i'm somebody who can see their point of view because i'm living in it. soon right now i'm on unemployment, soon i might be here by force because i will have nowhere to go. >> santa rosa leaders will discuss the handling of the new encampment at their next meeting. chp investigators looking into an accident that killed a pedestrian on 680. it happened last night around 9:30 in the southbound lanes north of route 4 near martinez. the lanes were closed several hours they've since reopened.

it is not clear why the victim was walking on the freeway >> vta light rail back to normal after being stopped last night after a train hit a woman. the accident occurred 11 p.m. at north capital avenue. jose police say it appears she only had minor injuries -- there's a possibility the new 49er stadium could open a year earlier than planned. the 49ers are telling city leaders to expect a financial plan for the billion dollar project soon. city councilwoman gilmore says the council is hoping to approve finances by the end of this year. the team is confident it has the money lined up. wants to plan for an opening date sometime in 2014. if you are looking for a halloween block party tonight don't look in the castro. for the fifth straight year that san francisco neighborhood will not host its traditional halloween street

morning they hadn't been in the water more than 10 minutes when the shark possibly a great white appeared and bit the man on the neck. surgeons say just millimeters from his jugular vein and from his carotid artery. his friends say he was able to get on to the beach on his own. friends helped once he was operate sand and he was then airlifted to the medical center. he could be released today. his injuries turned out to be nonlife-threatening of there's a chance he could make a statement as he leaves this morning. amy hollyfield in oakland with our other top story. >> reporter: we are live at occupy oakland things are going well for the protesters. main jean quan says she will return their medical supplies to them today -- check out the tent city in front of city hall. she is allowing it to stay overnight even though earlier
