san jose near the tank and julian street headed into downtown san jose not going to be an issue with light conditions in and out of downtown. we have an accident in the east bay along the nimitz freeway traveling southbound with a vehicle a solo crash blocking one lane with no delays. in marin, we have a new accident involving a make and possible major injuries at 101 and tiburon boulevard. >> new details in the death of ain't mate at the santa clara county jail. we have learned the man's identity. there was an incident involving guards before his death. janet o is in san jose with the story. janet? >> we have learned the inmate found dead this his cell on monday was 33-year-old walter roches, the santa clara sheriff said that physical force was used on him along with the

concentrated form of pepper spray and wouldject -- projectiles to get him out of the cell a week best death. he noticed behavioral changes and wanded to move him for monitoring but it is not clear if the physical altercation has anything to do with why he died. the jail has been under intense scrutiny after another inmate 31-year-old michael tyree was found beaten to death. three dopeties were arrested. the sheriff deputy is now waiting on autopsy results and the official cause of death in this case but they are releasing any information to be transparent. >> i hope they do not jump to conclusions. in august we were fast, transparent and did the prop things. we are doing the same thing: investigating into the fullest. >> he was being held on assault, battery and public intoxication.

he was being held where inmates with mental health issues are usually housed. a candlelight vigil is planned for 9:30 in west oakland as the art community mourns the loss of a young artist gunned down in broad daylight. 27-year-old antonio ramos was shot yesterday as he worked on a mural at an underpass 580. ramos exchanged words with a man while painting a mural. friends say the man was messing with their equipment and antonio ramos asked him to stop. the wall is part the super heroes project. students at west oakland middle school plan to finish the mural. >> go not have that person -- we are stuck with these people. filled with destruction. >> the artists will dedicate the mural of hope to antonio ramos.

>> oakland restaurant owners breathe a sigh of relief over the deal of lowering compost fees. the city council amended the contract with waste management to keep organic waste pickup 30 percent lower than trash pickup. many were outraged over the $1 billion contract saying it cost thousands and took away the incentive to keep the food waste out of the landfill. >> the epa will conduct betweens on properties in and around middletown ravaged by the valley fire. the goal is to locate and safely row move hazardous waste hidden in the rubble. they will train contractors to handle certain types of debris. more help is on way for victims. representatives from the second harvest food bank say they will offer help to those would need emergency food stamp benefits. the valley fire is 97 percent
