es tonight... nearly 11 hours after it started. =jess/rar= res right now at 11:00, a dramatic rescue continues nearly 11 hours after it started. rescue crews trying to beat the rain as another storm bears down on the bay area. good evening i'm jessica aguirre. >> i'm raj mathai. they are trying to excavate this man and the wet weather is about to make a complicated situation

worse. >> all happening in oakland near highland hospital. let's get to terry mcsweeney who has been at the rescue site for hours. where are they at this point? >> reporter: they are where they have been for 11 hours, oakland firefighters joined by alameda county firefighters trying to free this man who has been stuck in this hole. he has been down there since about 12:30 this afternoon. he was working on a sewer pipe digging through the sand and the walls caved in. he couldn't get him out. the crews dig out the sand and the sand keeps going down on him. they brought out a vacuum truck to suck out the sand and it comes back in. and now they have a wood worker who has a working table out here. he's got a table saw and cutting wood to specifications trying to shore up that sand to make sure

it doesn't come on him again. you can see how many people are out here. 30 at one point. oakland fire and alameda county fire. they have fresh workers. they have the wood going down now. but that's not the only problem. listen to this. >> the problem is there is a sand soil in there and there is also a clay. so when we are moving the sand more sand is coming into the hole and his feet are actually entrapped in a clay material right now. he's within two holes right now. >> his feet stuck in clay, he is in good spirits. they have sent down an iv to keep him hydrated. we'll keep you posted. live in oakland, terry mcsweeney, nbc bay area news. >> let's hope they get him out soon. the first in a series of storms is heading to toward the

bay area. we are under a micro climate weather alert tonight. heavy rain and strong wind hours away from impacting commuters. jeff ranieri is tracking when the rush will be the worst. >> over the next three to six hours it is going to intensify. the storm system is on a clip towards the region. already showers beginning to develop. nothing super heavy but spotty activity here. and a heavier pocket of rainfall moving into san rafael across the richmond bridge and that will be impacting the golden gate grbridge as well. by 3:00 a.m. heavy widespread coverage of rainfall and the wet weather until 5:00 a.m. and gusty winds. here's a look at how gusty it could get. maybe up to 29 miles an hour in san jose, 36 in orinda.

mark davis is clear this evening he is not committing publicly to oakland. >> not at all. nfl owners so you're saying there's a chance? yes, the silver and black staying put for now. with today's vote in houston to only allow the l.a. rams to relocate to los angeles the inglewood site with the chargers having the option to join them. the raiders are still oakland's team. and the raiders and chargers will be given $100 million from the league if they can come to agreement with the cities of oakland and san diego. after the decision, mark davis did not seem enthusiastic about not getting to move the raiders to carson with the chargers. >> this is not a win for the raiders today but at the same time i'm happy for stan and the rams going to inglewood. we'll see where the raider nation ends up here. we'll be working hard to find us

a home. that's what we're looking for our fans and everything else. don't feel bad we'll get it right. >> the chargers have until the end of march to decide whether they will move to l.a. for the 2016 season. if they don't move they have until january of 2017 to make a permanent decision on inglewood. if they stay in san diego, inglewood would be wide open for the raiders to join the rams. the saga is far from over. we'll have more on the story coming up later. the happiest people in the bay area are raiders fans. the team is staying in oakland at least for now. >> there is not another place that will show the love like the oakland raiders. they left one time and had to come back. >> the raiders represent the east bay, being the underdogs, coming from nothing to something

lawmakers and people to work together and to be civil. it's a message people here in marin county heard loud and clear. >> we're in the middle of the longest streak of private sector job creation in history. >> reporter: in his final state of the union speech president obama lists his accomplishments and admits gridlock in washington is blocking progress on big issues like immigration and gun control. but instead of outlining his final legislative proposals he urges lawmakers to end the gridlock. >> i hope we can work together this year on bipartisan priorities. >> reporter: at a watch party in san rafael, president obama supporters say that the climate in washington is toxic. >> when he came in he was going to do away with all that and it got worse. >> reporter: the president urged americans to tone down hateful rhetoric. the president is addressing the hateful tone on the election

trail and across the nation. >> his concern is that we've lost our way, at least many have. because of that, many americans have become alienated. >> reporter: supporters heard his call for fairness and help. >> he appealed to citizens. i don't know when people listen to it do they know that's me? >> reporter: some are working for change. greg is collecting signatures to qualify the voters right no know act. a cause the president agrees is a problem, jean elle, nbc bay area news. >> president obama announcing a cancer initiative that vice president joe biden will take over. >> let's make america the country that cures cancer once and for all. >> the announcement caught the vice president off guard and turned to the speaker and said

this is news to me. but president obama says he will work with doctors, patients and the government. the vice president lost his son to brain cancer last year. the seat next to first lady michelle obama was left empty in honor of gun violence victims. since the last state of the union address more than 30,000 people were killed by a gun. to have an empty seat for each of the victim you would have to empty the chamber 28 times. the south carolina governor nikki haley gave the republican response. >> many americans are still feeling the squeeze of an economy too weak to raise income levels. we're feeling a crushing national debt, a health care plan that has made insurance less affordable and doctors less available. >> she says that republican president would put the brakes on spending and debt.

the promise has been made. u.s. officials are anxiously awaiting to see it happen. iran has detained ten u.s. sailors after what the pentagon is calling an accident. the a.p. is reporting the sailors are based out of san diego. iran is saying they will return the boats and sailors wednesday morning. one of the boats reportedly broke down and drifted into iranian waters and the second boat tried to retrieve it. the sailors spoke to u.s. officials and are reportedly doing fine. i'm chief meteorologist jeff ranieri. rain starting to develop right now. we have a moderate pocket headed toward hercules. we'll talk more about the micro climate forecast and the morning commute in a few minutes. a south bay deputy on the wrong side of the law. and a famed local chef burned by food critics.

employee at a jack in the box. it happened in santa clara on el camino real. it's t a sheriff's deputy arrested for pulling a gun on an employee at a jack in the box. ian cull is live at the restaurant where it happened. how did it escalate? >> reporter: at this point we don't know. the investigators are not releasing the details. the employees are not talking about it. but it happened at the drive through of this jack in the box. that's where the deputy allegedly pulled a gun on an employee. another santa clara county deputy in trouble with the law.

santa clara police arrested benjamin lee on sunday morning after someone reported a disturbance between an employee and drive through customer at this jack in the box. how it started is unclear but lee was arrested for dui and pulling a gun on an employee. >> we were saddened by the news. >> reporter: rogers winslow is the vice president of the sheriff's association and says he can't ever remember an arrest like this involving a deputy. >> behavior like this by anyone is unacceptable. >> reporter: it's another mark on the embattled sheriff's office, a recent report shows 22 correctional deputies have been fired and 27 others suspended in the past six years, the deputies and lee fall under different unions but work for the sheriffs. winslow will wait for the investigation to move forward. >> we do expect that appropriate action will be taken after the facts are determined. >> reporter: it's unclear if the

firearm was lee's service weapon. he is now on administrative leave. the sclafr police department is investigating and the sheriff's office is conducting an internal investigation. reporting live, ian cull, nbc bay area news. gone in eight seconds. that's all it took for a thief to run in threaten a cashier and run out with $300. it happened at a liquor store in san matteo. this is near the 101/3rd avenue exit. he is wearing a mask as he is excepting the liquor store. if you have information call the san matteo police. a judge ruled the nfl is allowed to continue building a temporary media center for the upcoming super bowl on soccer fields next to levi's stadium. the soccer club says the league went back on the offer to find other places for the media site.

and the question is can we handle the rain that is coming our way? already in the north bay we have some rain right now. >> we definitely do. over the next ten days, six storms rolling in. it will be soggy but we'll avert any major river flooding at this point. the latest storm system is off shore. once that cold front alives we expect the heaviest rain and gustiest winds. we do have spotty power ises in the north bay and heavier pockets off shore approaching san francisco and the north bay. nothing too heavy falling so far. but you can see a moderate pocket in san rafael and sf. we talked about the man trapped in the hole in oakland. they are trying to get him out. this heavier rainfall likely to arrive in the next two hours. no doubt rescuers are concerned about that. you can get more on that on

as we look at the morning forecast tomorrow everybody has a chance of showers for the morning commute and temperatures in the upper 40s and lower 50s. here's the cold front lining up at 11:30 at night. that begins to drop down at 3:00 a.m. this is the strongest portion of the system. 3:00, 4:00, and 5:00 in the morning. watch what happens at 6:00, the cold front exits. not much left for the morning commuters. we are talking about scattered showers lingering until 9:00 a.m. and isolated thunderstorms in the afternoon. a short break and here comes the next storm system thursday morning. it's off to the north at 10:30 and the heavier rainfall arrives by 6:00 p.m. on thursday. the rainfall totals are decent but not super strong right now. and we're not complaining after

the drought. .64 in san jose. .75 in san francisco. and once you hit santa rosa, 1 to 2 inches. looking at the micro climate forecast. temperatures cool off 4 to 6 degrees from today. we'll go to 57 in san jose. for the peninsula, locked in with 50s as well. let's get you up to the north bay, east bay and tri-valley. the best risk of thunderstorms is in the north bay from napa to mill valley and a chance for fremont and walnut creek. the storm system for wednesday morning after another chance by thursday evening, not a big storm. but it looks like we could have a moderate system by saturday morning with rain and wind and another round of wet weather by sunday. four storm systems in the next six days we're talking about 1 to 2 1/2 inches of wet weather with these.

especially for celebrted bay area chef -- "thomas keller." kellerwn it's a review that can leave a bad taste in your mouth especially for thomas keller. he owns the french laundry restaurant. but he got a scathing review for his manhattan recent. the critic called it dull and flat footed. he said it's among the worst food deals in new york city. the paper downgraded the restaurant from four stars to two stars. per se was once called the best restaurant in new york. friendly advice when it

comes to checking your power ball numbers tomorrow night. make sure you read the right numbers. workers at a noejz restaurant erupted in cheers after they thought they won the power ball last week. unfortunately for them, they didn't realize they had read off the wrong day's winning numbers. the servers, the cooks, the bartenders thought they were going to share the $900 million jackpot. it's not clear what happened when they figured out they didn't win. but we are guessing they were crying and are going to try again tomorrow. >> one guy quit on the spot. geraud moncure rejoins us next. the decision about the raiders impacts the a's.

the drought is affecting all of us. at pg&e we've definitely put a focus on helping our agricultural customers through the drought. when they do an energy efficiency project and save that money they feel it right in their pocket book. it's exciting to help a customer with an energy efficiency project because not only are they saving energy but they are saving water. we have a lot of projects at pg&e that can help them with that and that's extremely important while we're in a drought. it's a win for the customer and it's a win for california. together, we're building a better california.

silver and black's relocation to l.a. voted down by the nfl owners. the chargers have until the end of march to decide if they are going to make the move with the raiders. the rams were given the green light for the relocation to inglewood. chargers have until 2017 the option to join the rams or stay in san diego. if they pass the raiders could hook up with the rams in the state-of-the-art facility. >> it's more than just a stadium, it's a project, an entertainment complex that we believe will be responsive to the kind of things we need to be successful with our fans in the los angeles market. >> the nfl and the city of oakland aren't the only ones playing hardball with the raiders. lew wolff says that this does
