investigators believe a freight train was stopped at a crossing. the amtrak train was on a second set of tracks as it headed to oakland. >> san francisco police are investigating an accident involving a bicyclist riding south on second street. you can find a link on our website and tonight at 11:00 you're going to hear from the cyclist who has hit. a judge accused of san francisco police officer of perjury. this is the video the judge saw that led to a dismissal in this case. vic lee joins us live with the story. >> prosecutors had no idea

lawyers for brandon simpson had a security video. that video that would result in the case being dismissed. officer nicholas buckley signed a sworn declaration detailing arrest last december in the tender loin. he was testified before judge charles drier. and repeated that he and his partner had just broken up a dice game, that he engaged simpson who looked suspiciously at him, ignored commands, and tried to sprint up the hill. that is when they found a gun. >> they told bold faced lies to the judge and u.s. attorney. >> after buckley testified, simpson's lawyer showed the court a security video from an apartment building.

they interact with simpson. there is no evidence he acted aggressively. nor did he try to escape. they grab him quickly and take him down. others arrive and help. >> the they went up to this man and grabbed him for no reason. >> prosecutors asked the judge to drop the charges. the judge said it was in a front to all of us and he was deeply saddened. in an unusual move, the judge ordered prosecutors to give copies of the video to chief suhr. simpson was released yesterday thanks to the video. the question is, will the officer be charged with perjury under oath? san francisco police department

tells us they have launched an investigation. >> a late night shooting brings total to 20 shootings since november. last night's shooting happened in hercules. a 25-year-old was shot in the legs, tleeted. officers don't believe the shootings have been random acts. >> work is underway to replace a brick sewer main. the sink hole developed on mission street near new montgomery tuesday night. a car got caught when it opened up. no one was hurt. >> now, your voice, your vote. today marks 25 days until the presidential primary. the secretary of state spoke about finding ways to expand and diversify the electorate.

baker beach. they have been feeding on fish going in and out of the bay. they prefer crills but but they're in colder, deeper waters. when running out of food, they leave the area. that is what researchers hope will happen. marine biologist worry about a ship striking one of the whales. a whale in front of a ship doesn't hear it that way. so they don't have time to react. >> people gathered to watch them. the spokesperson for the farallons sanctuary says they're asking boaters and tide surfers to keep a distance. >> we can't intervene. we can get the word out that the responsible thing to do is rig

a fairfield couple found themselves in an ordeal when becoming involved in a water rescue. >> the couple is winding down the trip, abc7 news reporter chris nguyen has the story. >> it was supposed to be an enjoyable ride, but the trip became remember rabl for the wrong reasons. >> if you don't know why you don't want it to cause more people in danger. >> the couple, both licensed private pilots from fairfield, spotted a paddle boater.

a man charged with two murders and crimes made a court appearance today, one victim was found shot to death in a hem. the car was likely the get away vehicle. >> the driver was in court today facing charges. abc7 news reporter david louie has the story.

>> reporter: weapons, redmond and an accomplice broke into a home in the santa cruz mountains. they put a gun to the head of harden's adult son, demanding them to lead them to money. the report says they beat the son with a mallit. >> this was a violent home invacation that took place and as a result, the victim, the individual was murdered. >> robert harden was killed with a shot tolt head. harden was not home when the invasion occurred but when he returned there was a struggle and the accomplice was seriously wounded in the arm, near death when the car chase ended. deputies found a note with the victim's address and a note to get more bullets. >> because of the fact that we have not even confirmed his

identity, i don't want to speculate to what his relationships may have been. >> the wife, siblings and friends of the victim attended redmond's court appearance but told me they're not ready to talk to reporters. the couple had three children. redmond might replace his public defender with a private attorney. the trial of the man accused of killing sierra lamar may not start next month. torres filed a motion for a new attorney which his lawyer said would delay the trial another year. the judge says he can refile it later. sierra lamar was 15 when she disappeared from a school bus stop. her body was never found. >> a billion dollar investment leads to tonight's bay area
