were made last night-- bringing the total to 11. according to the complaint, the group had explosives and night vision goggles and was prepared to fight. they originally occupied the building to protest what they call "government overreach" on federal land. ### there won't be a new trial for a nevada trucking firm, for the deadly amtrak crash in 2011 outside fallon. a federal judge decided to uphold the 2014 decision made by a u-s district court jury. the jury decided the truck driver wasn't paying attention; and was to blame for the crash. the driver was killed along with five people on the california zephyr. the judge ruled the 2014 verdict was reasonable, and there was no legal basis to revisit the case. john davis trucking was ordered to pay more than four and a half million dollars in damages to amtrak. a jury has sided with the peppermill resort spa and casino over an 8-

the grand sierra resort against a corporate analyst for the peppermill. ryan tors was caught using a reset key, to gather information from its slot machines. state investigators found he also collected other casinos. peppermill was fined-- 1-million dollars. g-s-r sought damages, a order, and injunction-- g-s-r can appeal the jury's decision. ### after a long battle--the city of reno and the truckee meadows fire protection district have agreed to settle a lawsuit regarding fire services. the reno city council voted yesterday to accept the terms of a settlement. the county will pay the city 447-thousand dollars in back workers comp fees... but that's it. both parties are choosing not to argue over damaged fire engines... or missing equipment. this ends a nearly four year battle between the two agencies... and fosters a good relationship that could--in the future--lead to another attempt at fire consolidation. ### nevada's capital is thriving-- but it needs

grow. carson city mayor-- bob crowell-- delivered his state of the city address yesterday. the city is getting ready to break ground on its downtown redevelopment project that will make significant improvements to the heart of the city. " i really want to have nevada day when i have wider sidewalks, a place to go up and down to sit and also we can go across the street from the legislature without worry about getting whacked" the project is set to wrap up in october. over the last year, the city added 11 acres of land for recreational use, and has increased revenue by nearly 13 million dollars. ### changes are coming to aces ballpark. last year the ballpark played host to dozens of community events... and next year they'll welcome a united soccer league team to the stadium. kolo 8 news now's chris buckley has a look at the park's future. the last year brought a variety of events to aces ballark. "our ownership mr. simons vision is the ballpark is a community ceter so baseball is the primary place holder, but then it's how else can we use the venue so we've had over 80

count the ice rink, soccer will be getting added, i think there's only room to grow." a united soccer league team will be taking the field next year.. "the response has been fantastic i mean the sport is growing tremendously i think that we're still at the front edge of the popularity in this country and we're really fortuate to have an owner that's giving us this opportunity to invest in something so exciting." and a stadium authority is now in place. "the purpose is that washoe county will be investing their poprtion of the ballpark property taxes that will be put into a fund to be used for facility maintenance and so the stadium authority will govern that maintenance over the long term" there's also a plan for 1.2 million dollars in upgrades... for h-d video and surround sound... and team officials say all payments are current... and the $63 million dollar debt is in good standing. "the last year there were soe back property taxes that were an issue that's all been settled, current property taxes are working just fine and at this point i think we're on solid footing with dealing with our partners in the city and nothing but blue skies ahead we've got a great future ahead of us." that was chris buckley reporting.

will drop to 4000-5500 feet. pressure shifts to the east today. the next storm will impact the region starting friday with strong winds, rain, and five arrests have been made in connection to the california jail break that's sparked a massive manhunt. the orange county sheriff says the people arrested, had "some connection" to the inmates who escaped, and more arrests are expected. the three men --considered dangerous-- are still on the run. some of the people arrested were members of a vietnamese gang. investigators are convinced that the inmates had outside help in escaping the prison because of the clean cuts made to inch-thick steel bars. a mosquito-borne virus is spreading that can hurt unborn children. it's called the zika virus. and president obama has ordered rapid research to help prevent it from spreading. local doctor--james wilson-- has been appointed to the zika

kolo 8 news now's terri russell spoke with him about the dangers of the virus. dr. james wilson is with the nevada state infectious disease forecast center. with a group of disease specialist throughout the country, he and others will be watching the zika virus closely and its impact on countries in central and south america. dr. james wilson/nevada state infectious disease forecast center: pregnant women have been the focus of this. and we really should expand the consideration to any fertile woman. really should avoid unnecessary travel during this hot period of transmission. that's because pregnant women exposed to the virus can have children with a syndrome called microcephaly, the brains are highly underdeveloped--it is sometimes fatal and extremely debilatating where life expectancy is short. this mosquito, the ades aegypti is responsible for the transmission of the virus. some people exposed feel no ill effects, others may come down with severe joint pain, rash, and red eyes. the virus stays in the system for 21 days. dr. wilson says because the mosquito and its life cycle needs to survive in areas where temperatures are consistenly in the 80s, even if it made it to this country, there are only a couple of areas where they could spread the disease. certain

dr. wilson: americans love their air conditioning, americans have screen doors. americans have much better access to mosquito control. dr. wilson says he's not ruling the moquito connection out here in our country. but we may be more likely to see it enter the united states by someone who has traveled to a country impacted by the zika virus. dr. wilson: it can spread through sexual contact. if you are a man, get infected, you have virus in your blood stream, you go back home within that narrow window of time up to 21 days, you can potentially infect your spouse. and if you are trying to have children, well you are now in that same risk zone. that was terri russell reporting chances are either you or somebody you know owns a fit-bit. those bracelets track your steps.and in some cases your heart rate. but as mary moloney explains... some are asking-- does it actually work? this year -- the word chances are either you or somebody you know

those bracelets track your steps.and in some cases your heart rate. but as mary moloney explains... some are asking-- does it actually work? this year -- the word health is almost synonymous with the word fitbit. not only do you see these brightly colored bracelets at the gym or work -- but the catchy commercials run frequently. they promise to help get you in shape -- but do the wearable trackers work? this month -- fitbit was hit with a class action lawsuit -- alleging fraud. according to the suit -- two of the company's heart rate monitors -- the fitbit charge h-r and the fitbit surge -- don't accurately measure your heart rate. and that could be potentially dangerous. especially for people looking to push their heart rates past a certain mark. the suit surprised consumer reports -- who tested and recommended the fitbit charge h-r and the fitbit surge. so -- consumer reports retested the devices. and compared fitbit's products with another device that has proven accuracy -- the polar h-7

testers again found both fitbit models were on point. and if there was a variance between the polar device or the fitbit -- it was no more than three beats per minute. which isn't big. but consumer reports noticed one exception. the fitbit charge h-r would give more inaccurate readings at higher intensity workouts depending on where that strap was put on the arm. if you follow fitbit's directions and wear the device in the place it recommends -- the monitor is accurate. while consumer reports says it will keep an eye on the fitbit lawsuit -- it says it will continue to recommend the fitbit surge and the fitbit h-r trackers. i'm mary moloney. ?have you ever waited patiently for concert tickets to go on sale, and then in an instant. they're all sold out? in new york, a three year investigation was launched into ticket pricing. the new york state attorney general's investigation-- found less than half of tickets for concerts, sports and other
