even more shocking than this was the lack of response. >> no one who was working for whole foods called for paramedics. they were interested in getting back up. they wanted -- the young man was conscious in lying in a pool of blood. >> reporter: shoppers say the security guard should be arrested. >> the security guard is out of control. he has some anger issues. >> reporter: paramedics took that victim to a nearby hospital. last we heard, he was in stable condition. live in oakland, da lin, kpix 5. families are demanding better treatment for inmates. they gathered to be heard after the death of an inmate at the santa clara county jail. kpix 5's len ramirez talked to some families who say the mistreatment of inmates has got to stop. len. >> reporter: ken, they say that this has been going on for years, mistreatment of inmates but their complaints have mostly fallen on deaf ears

until an inmate was killed while in custody. >> we want justice! >> reporter: the family members of inmates joined with community groups to march on the santa clara county main jail. they demanded major reforms to prevent any other inmates from being killed or mistreated. >> we are coming together as a group as a family as a people. >> yeah! >> this is not okay! >> reporter: 31-year-old michael james tyree was found dead in his cell last week the coroner saying he had blunt- force trauma injuries that caused him to bleed to death internally. three correctional deputies, matthew farris, jereh lubrin and rafael rodriguez were arrested on suspicion of murder but critics say that kind of jailhouse violence is not isolated. >> this type of horrific incident could not occur without systemic failures and gaps of accountability. >> treats them like animals. >> reporter: several family members came forward with

stories of how loved ones have been mistreated this jail. >> they cuffed him and he was beaten while he was handcuffed. >> reporter: william mendoza is talking about what happened to his 27-year-old son earlier this year. >> these guys are constantly filing grievances and complaints. and -- and they mostly come back as nothing. >> reporter: dollar is county sheriff lori smith who runs the jay, santa clara county sheriff is taking the complaints very seriously. in fact, she met with families and community groups for about an hour yesterday after she announced the three correctional officers had been arrested on suspicion of murder. in addition to that, what came out of that meeting, is that she will ask the board of supervisors for an increase in her funding to expand and install new security cameras in the common areas of the jail so that when complaints do arise, they may have a greater possibility of being substantiated. live in san jose, len ramirez, kpix 5. >> the district attorney's office told kpix 5 that it has

begun to review the case to determine what if any charges should be filed. if charges are filed, those officers will be arraigned tuesday. a san francisco judge ordered the suspect in the pier 14 killing to stand trial. juan francisco lopez-sanchez will be tried for second-degree murder. it's a charge that will require prosecutors to prove malice and forethought of a crime. stein was walking with her father when she was shot. this trial could hinge on whether jurors believe it was an accident. >> if you believe that he wanted to kill kate steinle, why not get closer to her? why not fire more than a single time? >> we are very confident that there's sufficient evidence to prove the crime and we look forward to trial to providing justice ultimately for kate steinle. >> sanchez says he found the gun wrapped in a t-shirt under a bench and that it went off when he picked it up. a ballistics expert testified the bullet "may have" ricocheted before hitting kate steinle in the back. breaking news.

a bizarre accident at ocean beach. a gust of wind blows a kite surfer out on the great highway then he gets run over by a car. kpix 5's betty yu is live for us near ocean beach with details. betty. >> reporter: veronica, san francisco police have shut down the southbound side of the great highway right now for this investigation. we know that very strong winds this afternoon picked up a kite surfer and then pulled him out of the ocean him or her and then he or she came crashing down across the great highway. this happened around 3:15 this afternoon. at that point, a car then hit the surfer near sloat on the great highway. san francisco police say this surfer had serious injuries. we are talking about head trauma. but at this time we don't know his or her exact condition at the hospital. and again, police have shut down part of the great highway for this investigation. again, this afternoon a kite surfer was picked up right out

of the ocean by these strong winds and then dropped and dragged across the great highway where the person sustained serious injuries. we'll bring you more details as soon as we get them. live in san francisco, betty yu, kpix 5. new at 5:00 a better look at the cyclist who turned violent in that road rage attack last week. this video went viral. a woman behind the wheel of a car confronted, then her vehicle attacked by an angry cyclist. kpix 5's joe vazquez with the new leads that could lead police to the rampaging bike rider. joe. >> reporter: ken, the new lead, new video, shot in the hours just before the attack here in the marina district. the video has gone worldwide. >> you're not going anywhere! >> hey! hey! >> reporter: a cyclist with critical mass attacks a zipcar

with a woman inside as she tries to drive around the scrum. >> hey! >> reporter: the man with the destructive bike long has a long moustache wearing khaki shorts and a t-shirt that reads nonviolence is our strength. kpix 5 has obtained video from earlier in the evening from an anonymous person who doesn't want to be identified. it clearly shows the face of a rider wearing the same clothes same shirt same shorts, the man with the moustache smiles a lot as he rides through the street of san francisco. >> yeah, the video here is definitely clear. >> reporter: but police are not smiling now. they want to talk to the guy. >> we are hopeful that you will put the video out on tv. we are trying to get the best still photos that we can of the individual so that you can put those photos out and we are hopeful that either the video or the pictures will jog someone's memory and will cause

them to notify us. >> reporter: captain greg tells me zipcar has shown police the vehicle. the windows were smashed and it's got about $3,000 in damage. also, investigators have identified the woman inside the car who escaped without injury. >> we have reached out to the victim and left a message for her. and we are still waiting for a reply from her. >> reporter: police say they are working with zipcar so even if the woman does not come forward, they should be able to file charges of felony vandalism against the suspect. they are hoping she does come forward and they are hoping that anybody who recognizes the man with the mustache will give investigators a call. reporting live, i'm joe vazquez, kpix 5. two alarm grass fire ran right up to some homes in san jose today. you can see from chopper 5, firefighters were able to stop just in time, those flames, this is near the ranch golf club in southeast san jose. the fire broke out about 3:45. firefighters had it under control in under an hour. no word on how it got started.

a little earlier a fire crew was able to douse a grass fire that broke out along interstate 280 near belmont alongside the northbound lanes just after the morning commute. this was near the highway 92 interchange. smoke billowed into the air. a driver shot this cell phone video showing us just how close those flames got to the freeway. two lanes had to be closed for a time. helicopters picked up water from the nearby crystal springs reservoir to drop on the flames. 15 acres burned up. fans of "lululemon" yoga pants upset because of a price increase. >> reporter: they increased the price even more. coming up why it might be good for business. >> we're not going to list these miscreants stopple apple fest. >> a crime -- stop the apple fest. >> a crime cutting the community to the core taking

new as 5:00 police have made an arrest in a deadly shooting at sacramento city college. but the actual gunman is still on the loose. police say 24-year-old rico ridgeway was injured in that shooting and likely a friend of the man who was kill. he is facing charges of assault with a deadly weapon. the shooting started after an argument between two groups of men in a campus parking lot. verbal fight turned physical. when the men brought out both a knife and a gun, the 25-year- old student was killed. ridgeway was grazed by a bullet. and another man was seriously injured, as well. classes were back in session today at sac city college but

students were still shaken. >> is it hard to come to class? >> um, yeah, because i don't know like if it's going to happen again or anything so -- >> grief counselors were on hand for students and faculty. the gunman still at large described as a tongan man. police say it was likely an isolated incident, not a campus shooting spree. and they are investigating as if it was gang-related. speeds topped over 100 miles an hour this morning on a wild police chase to the north bay. [ sirens ] >> it started in santa rosa when a sheriff's patrol car and black suv crashed. the driver of the suv sped off driving south on 101. the car finally crashed near the marin and sonoma border. police wasted no time moving in. >> come out with your hands up ] >> the woman followed police orders getting out of the car with a cigarette and a cell phone in her hands.

the deputy she crashed into which started the chase was not injured. traffic alert on this getaway friday for the labor day weekend. this is interstate 880 in oakland near the airport. southbound lanes you can see there pretty busy as people head out for the long weekend. don't forget no bart service through the transbay tube this weekend. service between oakland and san francisco shuts down starting tonight. so crews there need to make some repairs to the tracks just outside the west oakland station. service resumes at 4 a.m. on tuesday morning. our gianna franco on ways to get around the traffic tie-ups. >> reporter: and you can expect traffic tie-ups throughout the weekend. let's start with bart. no transbay service for bart between oakland and san francisco. bus bridges will be in place. but expect big delays on the bay bridge. use ferry, caltrain or ac transit as an alternate. use the san mateo bridge to avoid delays on the bay bridge as well as the richmond/san rafael bridge.

a mixed bag of news from the latest jobs report. unemployment fell to a 7-year low of 5.1% last month. but hiring slowed. employers added just 173,000 jobs in august. that is the fewest in five months. but the numbers could be good enough for the fed to raise rock bottom interest rates later this month. the prospect sent stocks down again. the dow was down 272. broader indices took double- digit hits. sticker shock for yoga pants. the pants were already pretty pricy. but now they are even more expensive. consumerwatch reporter julie watts went to find out why.

julie, what's going on? >> reporter: yeah, veronica. the starting point for a pair of "lululemon" leggings is $98. you can imagine that people weren't happy when they found oat they were increasing some prices. but the pricy pants have a lot of people around here talking and it turns out, that could be good for business. they are the holy grail of yoga pants. why "lululemon"? >> there are amazing. they have a lot of options. >> the fabric is high quality. it's thick. and besides that they are just really flattering. >> reporter: but even the "lululemon" loyal are having a hard time swallowing the recent price increase. >> i feel they are already expensive and i don't want to pay an extra 22%. >> reporter: some have taken to social media in protest to complain about the prices. and this is not the first "lululemon" controversy. "lululemon" is teflon coated. >> they are. they have been able to get away with the ceo's saying unkind things about women's butts, see through pants, you name it. >> reporter: this consumer psychologist says those

missteps along with a couple of recent recalls put "lululemon" on some analysts' list of the top 10 brands expected to disappear in 2015. but in spite of it, "lululemon" is still standing and yarrow says the price increase might elevate the brand for lou young's core demographics. >> you know, the yoga mom is like the new soccer mom. and having "lululemon" is sort of like having the louie vuitton of yoga pants. >> reporter: though she says that price increase is dangerous, it will likely push average consumers to cheaper alternatives from the growing number of copycat competitors. even though she says most agree "lululemon" continues to revolutionize the yoga pant and why the leisure wear went mainstream. >> the new design is designed to get rid of camel toe. who thinks about that? "lululemon." [ laughter ] >> reporter: they say the r&d for that new seam technology is part of the reason for the price increase. and they say they are still

comparable to competitors. they point out that they have 12 different styles. they increased prices on five of those and decreased prices on seven styles. >> i guess some good news there. julie, thanks so much. we appreciate that. [ laughter ] police in hayward are on the lookout for an apple picking scrooge. they say someone stole hundreds of apples right off the trees in the garmin park orchard. they were going to be used for the annual apple festival there. the event draws huge crowds. now with an apple shortage, festival organizers say the event will take a big hit. there will be enough apples forting but none for people to take home. >> the cause for great sadness here because the apple fest is a great tradition here in hayward in the east bay and the fact that somebody would do this, steal apples from the apple orchard, we don't know why. people are so sad here that we are thinking next year of putting in security cameras to protect the apples. >> before the theft even happened, the festival was

already facing an apple shortage. only nine of the 300 trees yielded fruit this year because of the drought. the festival organizers say the events will still take place next saturday. apples will be brought in from other growers. the chicken famous for fouling up the wednesday morning commute is the center of attention once again. now, there is a custody battle over the bird. no one knows how it got to the bay bridge toll plaza wednesday morning. but now three people say that bird belongs to them. the chicken who has been given the name chip was found running in traffic near the bay bridge toll plaza on wednesday. chp officers caught the bird and took it to the oakland animal shelter. the shelter says chip is doing well. she even laid an egg yesterday. [ cluck cluck ] a wild sight in southern california today. a 3-month-old tiger cub was found roaming a neighborhood in riverside county. it was captured and brought to a nearby animal sanctuary. wildlife officials say the tiger is doing well but a

little feisty from all the attention. so the wizard world is descending on san jose this weekend. >> comic-con is under way. and kpix 5's devin fehely is live right in the mix of all the costumed acres. we can see them behind you there. >> reporter: yeah. we do have some costumed characters right here behind me. these are folks from, you know, some of these guys from, um, videogames, some of them from other -- from other comic movies, comic books. you know, all of us probably have the experience when we were little of kind of taking that cape, you know, and tucking it in the back of our shirt and pretending we could fly or that we had superpowers. most of us as we got older stopped playing dressup but the folks that come to a comic- convention, they never stop dressing up. they never stop playing make believe. that's part of the fun that's really the point that's coming out here. some of the popular costumes this year, we have seen a lot of "star wars" as you might imagine. we have seen wonder woman from the comic books. we have seen characters from

comic books and movies like teenaged mutant turtles, and we'll have more of this costumed world coming up all these people have been fun. >> there's a little dance contest going on behind you right now. football is back. it feels like football weather outside today. it's windy and cool. high cloud cover streaming overhead. in the city of san francisco, windy and only the mid-60s. san jose only 72. santa rosa the warm spot 82. san bruno currently 65. oakland 73. livermore 74. that's 13 degrees cooler than average. winds have been an issue all day. san francisco at the airport winds gusting to 35 miles per hour. 20 miles per hour or stronger in san jose and half moon bay. out toward travis air force base in fairfield winds also in excess of 20 miles per hour. we have an area of low pressure to the north which kicked up the wind and dragged down cooler air lows in the 40s. and we'll see lows in the 40s again tonight. napa 47. santa rosa 46. and livermore tonight only 53. that low pressure area that's kept us cool and breezy the next couple of days, the past couple of days is moving east. high pressure builds in from the west albeit slowly temperatures will be above average for the majority of the

holiday weekend so more warm and less wind tomorrow. breezy and foggy at the coastline. plenty of sunshine this weekend with a gradual warming trend for the next several days. back to the 80s for you in san rafael. 81 degrees tomorrow. redwood city kicking off the holiday weekend 81. concord up to 84. it will be very comfortable in san francisco 72. and santa rosa 86 degrees. kind of getting hot away from the water sunday and labor day. we'll be in the low 90s inland. upper 70s low 80s near the bay. and upper 60s along the coastline and once we get warm we stay warm. the cool weather is gone after tonight. warm weather for at least the next seven days. back out here live capuchino running, guys, one of the most famous alumni of burlingame high school, marc benioff. class of 1982.
