studios, this is kpix 5 news. good morning, everyone. this is a live look out look at that. that's pretty bright. brighter than normal. >> it's tuesday, february 2nd. i'm michelle griego. >> and i'm frank mallicoat. happy tuesday. it's 5:00. in san jose, investigators are trying to determine how a tree crushed a man to death. the tree killed a man who walked by at the worst time. kiet do has the latest on what they're calling a freak accident. good morning. >> absolutely a freak consent in north san jose. we're live where the tree is still out here. they have not cut it up and removed it. apparently, they are waiting for the investigation to finish up. it was a sizable eucalyptus. the city arborist will be out

to do an inspection. someone called 911 yesterday and firefighters found the man pinned underneath and declared him dead. did el niño rains cause the tree to topple over. san jose has gotten a couple of inches of rain and the ground is saturated. the tree did not snap at the base but was uprooted. it's next to a creek where heavy rains can cause the rains to swell. >> it was so windy. yesterday it was very windy. >> reporter: now, the victim's name has not yet been released. this section of the park which has a walkway which connects it to an adjacent neighborhood is closed. but the vast majority of the park remains open. and the drought really could have been the cause. >> yes it could.

>> a combination of that and the gusty winds. it could have made it tilt a little bit. it's hard to guess. there's a lot of factors involved. and this morning did you see kiet do standing in the rain? it's a very soft rain. he probably differs with me there. you can see the different shades of colors, especially right there at the foot of the eastern portion of the diablo mountain range. we can see snow is falling in the mount hamilton area. and right through the 580, 680 corridor. >> the light and moderate rainfall. and there you have the areas of pink. and that's falling around highway 35. meanwhile we have light rainfall in burnett. and bypassing san francisco and on the san mateo coast. there's the beacon on the

transamerica pyramid. and later today we'll have highs in the 50s, under 60 everywhere under mostly cloudy skies. let's jump over to 880. we have a box truck and a vehicle tangled up on the shoulder. the good news is it's on the side and not blocking the main lanes. both directions look good near the coliseum. it's fairly quiet through the bay area and no delays on the san mateo bridge. and things are quiet on the peninsula. no delays north or southbound 101. and santa cruz mountains, there's a possibility of black ice highway 17. use caution in you hit the roads if you're traveling into the santa cruz mountains. no delays on 17. and definitely you want to leave a lot of space between you and the car in front of you. super bowl team flags have been raised over the california center in san francisco.

fittingly they are on the 50th floor. and there was more than enough winds to keep them flying. admission is free for the whole family but remember to bring the credit card. cate cauguiran is live at super bowl city. and tell us about all the things they have for sale there. >> reporter: there's so much. and here at super bowl l. we know that the businesses just right outside are already cashing in. and we know that the nfl is making money. rarely do people leave these gates empty handed. >> beer. >> reporter: and fans tell us they are grabbing souvenirs as quickly as they can. paying the high prices for the memorabilia. between the super bowl l swag -- hats, scarves, sweaters, $9 beers. and fans are saying it all adds up. >> official hat to the super

bowl. and we also have the -- >> basically this was a free event and you spent money. >> we spent $300 on souvenirs alone. >> reporter: and nearby businesses are inundated with fans looking for local flavor. lines have been out the door in san francisco. restaurants, coffee shops, and even ice cream shops. we know it got so bad for the crystal jade restaurant that employees had to put up a sign saying reservations only. and we spoke with local businesses who have hired extra help for this week alone. cate cauguiran, kpix 5. today an opportunity is up for grabs to play flag football with joe montana and another former nfl quarterback. uber is running a free promotion. users can use the app to enter the contest.

>> reporter: the democratic contest in iowa remains unresolved this morning with hillary clinton and bernie sanders locked in a draw. both candidates addressed their supporters. >> i will keep standing up for you. i will keep fighting for you. >> we are going to create an economy that works for working families, not just the billionaire class. >> reporter: both candidates will leave iowa with roughly the same number of delegates. and the results don't bode well for sanders. >> a tie is probably not going to cut it. he didn't turn out the quote unquote obama coalition as you would have hoped. >> reporter: republican turnout shattered records as voters handed victory to ted cruz over donald trump. >> tonight is a victory for

courageous conservatives. >> we finished second and i'm honored, really honored. >> reporter: all eyes are on marco rubio, only trailing trump by 1%. >> it's not only cruz and trump going after rubio. but it's bush and christy and kasich. >> the focus now shifts to new hampshire which holds the first in the nation primary next week. >> reporter: the iowa caucus marks the end of the road for two candidates, martin o'malley and mike huckabee announced last night they are suspending their presidential bids. marlie hall one last time in iowa. thank you so much. and republicans came close to overtaking trump finishing a single percentage point behind. >> i will be our nominee thanks

[ cheering ] >> when i am our nominee, we are going to unify this party and the conservative movement. >> the iowa results prompted two other candidates as marley mentioned to end their campaigns, mike huckabee and martin o'malley are dropping out. >> in the first state to vote in 2016, cruz got a victory. >> and clinton may have squeaked by over sanders. let's get right into it. ted cruz relied on evangelical voters. can that strategy work in other states. >> i have to toot my own horn. i predicted cruz would win iowa. and the reason why is because

of his incredible ground game. this is not a popularity contest. it's a campaign. and it looks a lot like work. look for him to do well in south carolina which is another primary coming up. and super tuesday you have a number of southern states. he's probably going to do well there. whether or not he can replicate in western states -- nevada is coming up -- that's a little dicey. but he's dialed in for the evangelical vote. >> i'm not sure donald trump has ever lost anything. and it's all about momentum coming out of iowa going into new hampshire and he's the second place finisher. >> is that going to hurt him?

>> almost third place. before the new hampshire primary next tuesday, february ninth, february 6th, this saturday is going to be another republican debate. and trump may find himself in a strange position of not being in the middle of the stage depending on how abc situates the candidates. you can see the campaign losing a little bit of momentum. but he's polling well in new hampshire. he'll probably do better there. it's a regular primary, not a vote. you don't have to go to a long meeting. and people in new hampshire who don't feel like they are part of the party establishment can cast a vote without enduring a party meeting. look for him to do all right in new hampshire. >> the democratic side, clinton may have edged out sanders. which benefits the most from last night? >> hillary clinton is about to lose in new hampshire.

state. it's transferred through mosquito bites and can cause birth defects in newborns. doctors say residents worried they are at risk should use insect repellent when necessary. neighbors say signs seem racist. this was posted in the windows of pappy's restaurant. >> the manager has posted the sign for bar tending and cashiers, and two days later our kitchen manager posted the sign for prep and dish washing, and that gentleman is hispanic. he's the one that posted it. >> reporter: the restaurant relies on a diverse staff and it was all a misunderstanding.

right off highway 50 at echo summit the department of water resources -- it's too soon to tell if the winter storms will be enough to put a dent in the drought. at least we're heading in the right direction. the cars are heading in the right direction. >> i hope so. everyone is behaving on the roadways. we've had a couple of minor accidents. the latest westbound 24 at wilder. it's not causing any problems. and we're taking a look at 24. and traffic is pretty light. light conditions towards the bay bridge. a slight backup in the cash lanes. and traffic is quiet at the toll plaza. and no delays or metering lights either. and clear conditions oakland to san francisco. and there's a live look the upper deck of the bay bridge.

westbound 580 to 880 is closed. live rook at the san mateo bridge and so far it's been a bright spot. no delays westbound between 880 and 101. looking at a 14-minute ride for the drive time. taking a look at 880. the accident is completely cleared out of the roadway. northbound is clear, and southbound we start to bog down just a bit. extra volume and the speeds are doing okay on the southbound side of 880. looking good at the golden gate bridge. we're dealing with slick surfaces so keep that in mind as you head out the door. and quiet out of marin to san francisco. and westbound 580 is stacking up through the dublin interchange. the bulk of the traffic is coming out of tracy as you come away from 205. how long is rain going to stick

around? >> it's moving rapidly. and we'll see accumulations in the san jose area. at this time right there, 46 degrees. so says steve. he is in los altos. one-hundredth of an inch of rain. the light rain has started in his area. let's take a look and see for ourselves. this is high def doppler radar. and the shades of pink and white in the eastern foothills of the mount diablo mountain range. it's going to be fun to take a look as the sun coming up. mineta international airport and all the way through levi's stadium? santa clara. and light wind at the approach to the golden gate bridge. and we could obviously see that the roadways are wet. temperature-wise we are in the 40s out the door. 43 to 48 degrees. and the winds are slight under 10 miles per hour.

and most recording stations. remember 24 hours ago we had gusty winds, 22 miles per hour. less winds today. and more clouds. and we have the rain this morning. and mostly cloudy skies during the day. maybe some sunny breaks and a couple of rainbows. we have high pressure diverting the storm track. our future cast illustrates this system is out of here by lunch hour. the evening commute will be dry and wednesday we start cloudy and watch what happens towards the evening commute. more light rain from the north to the south. and by the time we tally it up. we're anticipating up to a half inch of rain in the wettest locations. and that would be north of the golden gate bridge. santa rosa, san rafael. and there's temperatures under 60 degrees everywhere. winds up to 10. if you're heading to super bowl city. mostly cloudy skies, and 55 degrees. otherwise, the extended forecast. i want you to look very carefully at this.

firefighters found the man pinned underneath and declared him dead at the scene. the ground is saturated. the tree, a eucalyptus about five stories tall and 3 feet in diameter was uprooted. the base is located next to the creek where heavy rains can cause the soil to swell and loosen. >> it's been on and off. the tree is a rather large tree, a big eucalyptus. and this area receives a bit of a wind tunnel here. and was it windy at the time? uncertain. most of the people around were not around when we got here to ask questions and find out. >> reporter: the name of the victim has not been released and the vast majority of the park remains open. only this section has a small walkway remains closed. the winds have given way to

city, mostly cloudy skies, and mid-50s. the full forecast at 48 minutes after the hour. we're getting reports of an accident as you work your way westbound 92. a vehicle went off the side of the roadway into a creek. the person was able to get out of the vehicle. and they are now sitting on top of it waiting to get rescued. we have delays for spectator slowing. 92 headed to the toll plaza. once you got on the san mateo traffic is okay to 101. right now 13 minutes so sluggish off 880. eastbound 80 at highway 4 getting word of an accident. no lanes blocked and you might find a built of a snag there. and the metering lines are on at the bay bridge so expect stop and go at the toll plaza. time is 5:33. seven people are hurt after a shooting in a multicar crash in the east bay. it happened on the westbound

lanes of highway 4. it's not known if any of the people being shot at were hit. and a car targeted has not been found. an off duty bart officer saw someone in an altima firing. the bart officer called in the shooting to the chp just as the suspected sped off. >> the occupants sped away and took the off ramp and crashed into several cars. >> reporter: that altima hit four other cars and plowed through with enough force to flip a hummer. three men were inside the altima. and two were 21 and one was 19. each suffered injuries. and authorities have recovered a pistol. there have been six shootings on i-80 and two of them were deadly. >> a driver hit a 5-year-old and fled.

it happened on san marcos street. the driver sped off without checking to see if the child was okay. a brown late '90s camry or corolla. the five-year-old is expected to survive but has severe injuries. >> >> these suspects robbed a safora cosmetics store. police released the video. a woman went in and started loading up her purse. when security confronted her a man ran up and attacked the guard. the male suspect is seen here with a small child on his shoulders. a close call for the broncos, and it wasn't on the field. an suv cut off the broncos bus and the minor accident happened on highway 101 in sunny vail as the team was heading to the hotel in santa clara. and quarterback peyton manning

it's the nearby businesses also catch cashing in and they are trying to keep up with the high demand. >> the man knows his beer. >> reporter: a lot of these fans are filling up the financial district's coffee shops and restaurants. crystal jade restaurant got so overwhelmed they had to put up a sign letting customers know reservations only. and other businesses had to hire extra help for this week. >> i'm getting anybody i can find off the street. i'll take them. they can scoop ice cream for me. >> and inside super bowl city we've seep fans standing in long lines just to grab the big game souvenirs. many of them tells us they spent $300. we are a few days away from the big game. and more fans will be coming to the bay area.

and that's a lot more money for these businesses to cash in on. reporting live from super bowl city, cate cauguiran, kpix 5. hillary clinton and bernie sanders are in a virtual tie in the iowa democratic caucuses after yesterday's voting. both have between 49 and 50% with clinton ahead by 4/10 of a point. on the republican side, senator ted cruz is the winner with nearly 28%. and donald trump has 24%. and marco rubio is in third with 23%. iowa republicans have a clear winner. and the democratic contest appears to be too close to call. but clinton's campaign declared victory. the finish between clinton and sanders means both candidates are leaving iowa with roughly the same number of delegates. and on the republican side, the majority of voters chose ted

san mateo bridge, we have reports of an accident. a vehicle went into a creek. activity there as they retrieve that vehicle. no injuries reported in the accident. slow coming off 880 as well as you work your way to the westbound san mateo bridge. just a heads up here this morning. elsewhere as you across the span of the san mateo bridge, no troubles. traffic is clear to foster city. 14 minutes between 880 and 101. taking a look at conditions on the east shore freeway. westbound we're seeing delays. and yellow on the sensors which indicate slow and go speeds. we have an accident on the eastbound side at highway 4 and it's to the right side of the roadway. the rest of the commute we're seeing slow and go conditions as you hit the bay bridge. and metering lights are on. you're backed up almost to the maze. and busy across the span as you

it's tuesday, february 2nd. i'm michelle griego. >> hi everyone. i'm frank mallicoat. it's nearly 6:00 and we kick off with traffic. >> we are dealing with slick surfaces and we're not doing it too bad. the only snag is working towards the bay bridge, pretty slow and go and you're backed up to the maze. a 20-minute ride into san francisco from the end of the maze. at the incline. traffic is building as you work you way through. the east shore freeway, stop and go conditions out of hercules. and you'll tap your brakes into berkeley. a vehicle was stuck in a creek and now injuries. sluggish conditions as you approach the scene. southbound 880 is slow through hayward. and once you get on the san mateo traffic is light. 15 minutes between 880 and 101. 880 the nimitz freeway, a nice ride as you head
