live from the bay area studios, this is kpix news? a landlord blames blame for being -- blamed for being part of the crisis. tonight, he explains why he shouldn't be called a mega evictor. new at 6:00, he has filed more than 3,000 eviction notices: a landlord is getting a bad wrap. emily is on the high profile landlord whose business conduct is being called into question. >> reporter: he said at first glance, the numbers may seem shocking. of we took a second glance and in fact we found there's more to this than just meets the eye. she had been a part of protests for affordable housing. now they have launched a recent

attack against this man. william, an oakland owner of 1,000 units that she has deemed the mega evictor. >> it's pretty ridiculous that they can issue that many in such a short time period. >> reporter: he and his company have issued at least 3,000 eviction notices since 2008. the most of anyone in the nonprofit collected. william who was part of the mayor's housing task force says the numbers are misleading and inflated. >> i would never characterize myself or any of my people as mega evictors. the report on mega eviction is distorted in so far as it says three day notices are eviction and they are required by law and required to be sent to the rent board. >> reporter: the data included what william says are mostly three day notices to pay rent or quit the property. something legally issued when a ten ability doesn't -- tenant doesn't pay. only a small percentage turn into evictions and then after

giving them a chance. the problem with housing, he says, isn't him or his company. it's oakland. >> you have to have the city work. oakland is a great place. it now has a very diverse group of people living here. we need to find a way to allow those people to continue living here if they make that choice. >> reporter: it's a call that ironically is echoed by the woman accusing him showing that two sides of the coin aren't always so far apart. >> you know, as rents are going up, as the minimum wage is not going up, as evictions are going up, all these things together, something need to be done. it's up to the city government to actually do something dramatic. >> reporter: so they both agree that it needs to be the city that does something. so we did reach out to the city. in fact, to the mayor's office. while she didn't comment on either this project or on william, she said that task force she created was meant to be full of diverse people from all walks of life and all different edges of the real

estate agencies. that way, they could tackle all of the very diverse issues that face housing in oakland. kpix 5. we're following developing news getting word that a united airlines plane that took off from sfo from paris has been divert the back to sfo because of a mechanical issue. it's united flight 990, a boeing 787 dream liner. it took off at 3:47 this afternoon and from the flight tracking service, flight radar 24, you can see the purple lines very faint, but it shows it turned around near boise, idaho. it has crossed back into california. this is a live look at sfo right now where that plane is supposed to land in just the next few minutes. united airlines telling us the pilot did not declare a flight emergency, but the decision was made to bring the plane back to sfo where the airline has a maintenance facility. we'll keep an eye on this story and bring you the latest information as it comes in. an unusual and deadly pedestrian accident early this

morning in concord. a man was hit by two vehicles, and one of them was a police car. it happened here at the intersection on kirkwood drive. police say that a motorist hit the man about 2:30 this morning. now, that driver stopped and called 911. at the same time, a police officer heading to another call also hit the man as he was lying in the roadway. a civilian and a police officer are both cooperating with the investigation. a break in a brutal and unprovoked attack on a homeless man. two men now under arrest. the crime sparked outrage when surveillance video was released showing a group of men kicking a 69-year-old man as he was sleeping on a san francisco sidewalk. that man later died. police tracked down joseph and david using d, in a evidence -- dna evidence. each is being held on a $5 million bond. new at 6:00ing a deadline was set for a dispute between the city of santa collar a and

the 49 -- santa clara and the 49ers. they are arguing over operating costs. this dispute has gone public, and now the '9ers are firing back. >> reporter: that's exactly right. the mayor is threatening to take control of the stadium away from the 49ers if they don't fully and quickly comply with the auditor's request. it's the latest skirmish between the team and city hall. >> it's unfortunate that our relationship that's come to this. what i would say, for the citizens of santa clara, what's being said out there is misleading. >> reporter: the 49ers organization is slamming to turn over financial documents to a team of auditors hired by the city. >> we're going to look at taking back the management of the stadium. >> reporter: the mayor says the team is stone walled auditors failing to hand over the -- to see if they are paying for city services like firefighters and police at stadium events. >> the auditor determined that

we have been using general fund money on the stadium through public safety that's a violation of measure j. >> the company is not -- we receive bills and pay them. if they were not billed properly or something didn't come our way, then they should bill us and we'll pay it. >> reporter: not long after the super bowl, the relationship between the 49ers and the city soured and has grown more axery moanious since. the watchdog says they are likely to uncover blame on both sides. >> what we're going to find out is, i think there's a lot of money that santa clara has not received. i think it's going to go this way. i think we're going to find it all over the place. >> reporter: the mayor is not about to fumble the opportunity to make sure the team is paying its fair share. >> it is a business relationship. if they're not pulling up their part of the business relationship, then we are going to have to change things. >> reporter: now, the 49ers say they will only be able to

partially meet today's deadline. they say some of the information that's been asked for, they either don't have in the right format or with the level of detail that has been requested. they are trying to prepare that information and promise to turn it over to the auditing team by the end of the week. for anyone who is hoping for a cease-fire in the war of words, just a few minutes ago, i got an e-mail from the team in which they question the objectivity of the auditors. kpix 5. you saw clouds there. let's look outside. dark clouds starting to fill the sky with another round of rain moving in. it could be a wet night for trick-or-treaters. our chief meteorologist is here with what we can expect. >> all the costumes with hoods, good idea this year. halloween rainfall, it is raining outside right now. we'll bring be you closer to the bay area. rain moving into san mateo county, albeit light. it's not like what we had yesterday. it's not raining in portions of

take chopper five is live over san francisco international airport.. where un we are following this developing story for you. chapper -- chopper 5 is live or san francisco international airport. this is united airlines flight 990 that you are seeing landing at sfo or about to. the boeing 787 dream liner left sfo about 3:47 this afternoon. it was headed for paris as it comes towards the runway to touch down at sfo right now it had to turn back around in boise, idaho. it was a mechanic ale issue. mechanical issue. they are telling us the pilot did not have to declare a fight

emergency. if there had been an emergency, it would have landed right away. the decision was made to bring this plane back in to sfo where the airline has a maintenance facility for it. again, it's united airlines flight 990 headed to paris carrying 230 people. it is now attempting to land at sfo. but still, no word exactly what went wrong. but, again, this plane left sfo this afternoon. it was headed towards paris, 230 people on board. the united airlines pilot declared some type of a mechanical problem. again, we don't know what went wrong, but as the plane comes in on the runway at sfo, all appears to be okay with the plane. there it is now touched down. it has landed safely at sfo. they do have the maintenance facility at united -- for

united at sfo. as they release more information about what went wrong, we can tell you and you can see it has landed with all 230 people aboard. we'll get you the latest as soon as we get details. new at 6:00, ap courses have always been a way for high school students to take advanced classes while earning a higher gpa. in palo alto, that may no longer be an option. we explain the controversial move on weight the grades. >> reporter: over the next few months, palo alty unified school district must answer the question to weight or not to weight the gpa. >> do we need to add something and make it more competitive here? >> reporter: normally to calculate it, an a gets 4 points, a b3 points and so on. since ap classes can be more stressful, an a may be worth 4.5 points, a b, 3.5 points and so on. over the course of a high school career, those extra points can add up and give you

a significant boost. the superintendent says it's a problem when all students caring about is padding their gpa. >> my worry is numbers and not just to learn. >> reporter: last school year, they had a cluster of suicides where a number of students took their own lives. he spoke at reducing student yeser stress and improving mental health. revamping gpas is a part of the solution. do you think getting rid of weighted grades is going to prevent the next suicide cluster. >> no, i don't. >> reporter: get this. of he recalls talking to admissions officer at the top schools like stanford with surprising thoughts on students who take a bunch of ap classes. >> we ask you are 0 selves, who would he have been doing instead of taking more a ps? could they have been doing a job or research project? >> reporter: gun high school weights theirs but palo alto

you're watching kpix 5 news. our top story at 6:30, two measures targeting grocery store bags are on the ballot. there's a big difference between them. kpix 5 explains much of the difference is explained by where that money goes. >> reporter: you scroll through your state voter guide, past gun control and the death penalty, you'll find two ballot measures about grocery bags. >> the notion that four companies from outside of california can just kind of prop down $3 million, pay for the signatures and get something on the ballot, honestly, i'm jealous. >> reporter: sometimes it's referred to as a bag band, would end bags at the market. they would have to charge at

least 10 cents per back at correctout. checkout. any profit would have to be spent on education about the bag law. prop 65 says when they have to sell bags, all money collected must go to an environmental fund, not just profit, all money collected. john is with the american progressive bag alliance. his group opposes the bag ban, but they still put both measures on the ballot. >> even if they want a ban, even if they think that's a good idea, we know that people believe that fees on bags should not go to corporations. it should go to a public purpose. that's why you have two ballot measures. >> reporter: mark is the executive director of californians against waste. he says prop 65 is meant to confuse voters. >> you know, two-thirds of california voters support the idea of banning plastic bags. so a lot of them are getting to the ballot. they're looking for where is that plastic bag measure, and the first one they come to is 65 and some percentage of

voters are choosing that one thinking that's the bag ban. >> reporter: murray isn't alone. newspapers are called prop 65 misleading and a cynical ploy to confuse voters and one of the most -- in state history. a recent survey shows the -- [ no audio ] [ no audio ] if you look at specifically who supports it and who opposes, you can make the decisions on your own and make it on the merits. >> reporter: he says voters should be skeptical of environmental laws proposed by the plastics industry. >> to figure out what's best for the environment, we should did he ever to out of state plastic bag manufacturers instead of relying on hundreds of california based organizations. >> reporter: he's being sarcastic there.

goes back out on the campaign trail for clinton tuesday. the white house is neither defending nor condemning comby's actions. he doesn't believe that director comby is intentionally trying to influence the outcome of an election. the justice department informed congress it will work closely with the fbi to quickly review any e-mails that may be relevant to the clinton investigation. cbs news, the white house. >> it's too late to register to vote for the election. you still have a chance to mail in your vote. tomorrow is the deadline to apply for a vote by mail ballot. the fastest way to get it in on time is by going straight to your county election office. and the election office in santa clara county is scrambling to fill slots for poll workers. they need about 200 more poll workers to work the election next tuesday. a lot of voters have already cast votes and they're expecting a lot more. >> we've been seeing over 200

the makers of "my pillow" have agreed to pay one-million do the maker of a pillow is going to have to pay up.

the makers of my pillow have agreed to pay $1 million to settle a false advertising case brought by prosecutors in the 9 bay area counties. the suit took issue with the company's claims its pillow so cure or reduce the effects of a host of medical problems, including migraines, joint disorders, insomnia and restless leg syndrome. >> they can't do that unless those assertions or claims are backed by medical evidence and they weren't. >> in addition, they advertised it was the official bed pillow of the national sleep foundation without disclosing the 2 had a financial connection. they have agreed to change its advertising as well. part of the settlement money will go to organizations that provide sleeping accommodations for homeless people and victims of domestic violence. mcdonald's will pay more than $3 million to cover back pay and legal fees.
