>> catherine : tragedy in walnut creek tonight. two young people are dead following an apparent murder- suicide. police say a 21-year-old man killed his former 19-year-old girlfriend. then turned the gun on himself. good evening, i'm catherine heenan. kron 4's alecia reid joins us live from the walnut creek. with reaction from neighbors. alecia? >> alecia :two families are mourning the deaths of their children tonight. police tell me this is a completely shocking murder-suicide. these were both college students from supportive

families. >> : nothing that anyone would've seen coming. >> alecia :but tragedy struck early this morning. just before 7 o clock police say scott bertics walked up to his ex girlfriend's holton court home. at the front door, bertics fatally shot 19 year old clare orton, then himself. >> : this is really shockingand sad. >> alecia :authorities say there were no previous issues of domestic violence, or warning flags, and bertics did not have a criminal history. >> : this one is especially painful because the victim and suspect both come from supportive families. >> alecia :on this quiet cul de sac, neighbors say they did not hear the gunshots ring out. >> : i left this morning around 8 o clock and saw a bunch of police tape and cars >> alecia :both families have been extremely cooperative with police.

neighbors say the 21 year old shooter studied engineering at stanford university. this is one of his videos posted on youtube. >> : my heart goes out to all of them. it's sad. >> alecia :not a lot of details being revealed tonight. the circumstances surrounding the murder-suicide are still being investigated. reporting live in walnut creek >> catherine : the father of pier 14 shooting victim kate steinle made an emotional plea to a congressional committee today. jim steinle testified before the senate judiciary committee. asking for changes to sanctuary city policies. he wants a new law meaning mandatory jail time for convicted felons who return to the u-s illegally after being deported. during the testimony. steinle described his daughter as an enthusiastic world traveler, contrasting her life with that of francisco sanchez-- her accused killer.

>>:everywhere she went sheesh and the lead of a good citizen of the united states of america. unfortunately due to loss and basic incompetence on many levels the u.s. has suffered a self-inflicted wound by the deaths of some my daughter who was murdered by someone who should not have even been in this country >> catherine : the house is scheduled to take up its own legislation in response to the pier 14 murder. it would block federal funding to cities that resist turning immigrants over to federal authorities. san francisco supervisors meantime, are pushing for legislation to impose new reforms to the city's sanctuary city policy. kron 4's emily turner was at today's meeting. and has details on the proposed changes. >> emily : this is the first time since her murder and that san francisco's center rate policy has been on the floor for

debate. --sanctuary policy >>:we are making sure we take a very hard look at the public policies that are in place to make sure that someone like this can never happen again >> emily : the plan is aimed mostly at the sheriff's office to get rid of the gag order that restrains communication about illegal immigrants >>:it simply makes set no sense to dismiss all charges and have them released on the street >> emily : her killer was kept

in jail when he should have been released and he did not want to comment even though there was very obvious blame placed on the sheriff's office >>:he failed to exercise his discretion we are putting additional laws in place to make sure that what happened cannot happen again >> emily : a member of the legal team has agreed to give us a statement, but unfortunately i was unable to get a hold of that person for a statement. as soon as we get that information will be sure to pass it along to you >> catherine : early this morning. a 4-point-oh earthquake struck fremont.followed by at least 14 aftershocks. although damage from the quakes were minimal.scientists warn a big earthquake could strike along the hayward fault "any day now".

the hayward fault runs from fremont in the south.to san pablo bay in the north. the u-s-g-s says a big earthquake on the hayward fault could cause injury to tens of thousands of people. and even thousands of deaths. such a quake is devastating because the fault runs under densly populated areas. >>:scientifically this fault has potential to rupture and it would rupture it under a very populated area. so different scenarios have been considered, and is expected to have a lot of loss of property >> catherine : divorce court documents reveal more information about martin martinez.the prime suspect in the modesto murders. amanda cruz is a victim of the massacre and a former girlfriend of martinez.

she had 2-year-old son who died in october. the documents show a conversation between cruz and her soon to be ex-husband timothy ripley. they reveal that ripley told cruz's daughter that martinez killed the 2-year-old - and said that he'd go to prison for the rest of his life. police say it was her son's death that led to the arrest of martinez. he remains behind bars awaiting transfer to a modesto jail. a man who was shot by fremont police last night remains hospitalized in intensive care. it happened on his front yard on baffin avenue. police say they'd received reports that he had threatened his wife and another woman with a knife. and say he was outside with the knife when officers arrived. after a brief confrontation. two officers shot him. a pit bull puppy shot by u-s mint police in san francisco today - will likely need to have his leg amputated. it happened this morning - just outside the mint building.. the dog named "blue" escaped from its home with another pit

bull. and attacked a mint employee as she was walking to work. the dog then attacked a homeless after that. officials say the dog ran toward the officer.who felt threatened and shot it -- hitting the dog in the leg. the incident is being investigated. coming up. thieves target a church in east palo alto. how the pastor is responding. also - we're learning more about a camp counselor accused of child molestation. about him - before his arrest. and. california could be divided into six states. details of the proposal that could make the 2016 ballot.

>> catherine : a proposal to split california into six states now has enough signatures to make the 2016 ballot. venture capitalist tim draper created the proposal. he argues that californians would better be served by smaller governments. where elected officials could work closely with citizens. the proposal would break california into 6 states --- jefferson, north california, silicon valley central california, west california, and south california still ahead. an east bay preschool is forced to move out of a city-owned building. how employees are coping with the move. also -- robbers steal thousands of dollars worth of electronics from a peninsula church. the damage they left behind. next.

>> jeff :reverend albert macklin is upsetthieves broke into the new sweet church and stole thousands of dollars worth of electronicsand, in the processdestroyed doors and made a mess. this is where the 70 inch television was mountednow, there are holes in the sheet rock and loose audio and video cables. the reverend took me upstairs where the burglars kicked in the doors to steal more electronics. you can see the doors are destroyed and will need to be replaced. reverend macklin says many projects will have to be put on hold because of the break in. >> reverend albert macklin : this is our 75th church anniversary in just a few weeks. we were raising funds to do some renovations hereour kitchen, our parking lot, our wheelchair rampjust different areas where we needed some work doneand, now, this happensit kinda pushes me back. churches don't have a lot of money to begin with and now i have to raise money to replace items and

to fix doors and then to also upgrade security stuff so i can have some type of security for my church. the reverend says he feels violated by the burglary. he said that he never thought there'd be a day that he would have to install security i'm jeff bush in east palo alto, kron four news. >> catherine : while the immigration debate is heating up in washington d.c.--- bay area cases are on the agenda. not just the kate steinle case. but the case of a camp counselor at walden west in saratoga. edgar covarrubias padilla. was charged with child molestation and possession of child porn. today.iowa senator charles grassley said padilla came to the u-s illegally as a child. and was granted approval to stay and work. grassley believes that government officials knew padilla was part of an ongoing investigation for distributing child pornography before his arrest.

>> reporter :to mostly cloudy conditions for the rest of the evening and hear your temperatures for overnight lows of around 5:00 a.m.. san francisco and the peninsula are staying in the upper 50s. the rest of the moisture that brought us the humidity is continuing to move out to the east patchy fog and more high clouds in place for the afternoon but first there is fog and low clouds in the morning by around 11:00 a.m. and most of the clouds will have pulled back giving plenty of sunshine. east bay shoreline will have some high clouds in place which will keep the temperatures cooler.

> > haaziq :it is the final packing day and an emotional one for the faculty here at kids' club preschool in antioch. the education program is the largest state funded preschool facility in contra costa county and has annully served an enrollment of 300 students at the bidwell education campus for the past 11-years >> : "we do not have a place to go and i never thought that would happen to this program" > >haaziq:carolyn mokski took over the preschool program from the city of antioch 20-years ago. now that their lease has ended, the size of the preschool has been the major problem in finding a new facility >> : "we originally had 8 schools. we came together and combined all the schools into this building because we thought it was a great idea to have all the kids in one building, but now backfired on us because now we've lost this building >> reporter :this has got to be kind of heartbreaking huh?
