temporarily. the fire is out under control but we have one lane opened on the bridge which is causing a growing backup for those of you coming out of san rafael trying to get over to the richmondsides side just about two bellham boulevard. expect a 20 to 25 minute delay for the westbound ride the commute direction yes there's backup here at the toll plaza coming out of richland but it's normal not related to the eastbound accident at mid-span so this slow down starts at richmond parkway and it will be jammed through the toll plaza and then it picks up. it's crowded on the bay bridge san san mateo bridge james. >> thanks. let's get outside and look at what we are seeing and for that we will jump over to the bay bridge camera. look at the sunshine coming in and things are brightening. i am viewer photos of the sunrise we will share those at

7:15. and they look pretty good. here's look at what we expect going forward. it's the clouds and wind that will be with us a little bit throughout the morning showers. it's breezy right now. san francisco currently 9-mile- an-hour sustained winds stronger in the east bay. concord 15 and 16-mile-an-hour winds near fairfield. cloud coverage has breaks in there and that's why we see the sunshine come through. it's going to be mostly cloudy curing the morning but -- during the morning but will pull back. we are looking at mild temperatures to start during the 8:00 hour low 60s by noon for lun. kids will enjoy that especially inland where we will be in the 70s and the grat gradual clearing will mean sunshine is nice and bright by 3 in the afternoon inland highs from 83 to maybe even 88 degrees for some of the inland east bay valleys. 70 to 75 for bay shore communities. a complete check come up in 15 -- coming up in is a. a-- a home invasion sending a man to the hospital in oakland.

it happened after 2:30 between sequoia road and keller avenue. the will 0-year-old -- 80-year- old was taken to the hospital suffering myor injuries. attackers are on the loose a car was stolen from the home. police have not released information on the thieves. more breaking news we are following. look at this video out of long beach new york. several balconies collapsed on long island. it happened earlier this morning. 6 balconies collapsed. we have no reports of anybody being hurt. and more on a big story we are following the hayward police chief is placed on administrative leave pepping an investigation. >> the question is why and what's going on. jackie is trying to get to the bottom of this at the hayward police department. >> reporter: good morning. yeah more questions than answered from the hayward officials here at the police department about why they put the police chief on administrative leave it was a

brief statement last night released by the city manager saying diane stuart the chief of police sheer in hayward has been put on administrative leave. not a lot of details why she was placed on the leave other than it was a personnel issue. she has been the chief since 2011 and as she is out on the personal or on the administrative leave the acting chief will be captain marc coaler stew hard stuart has been the chief since 2011 and started the 30 year career in san jose when she was named police chief here in hayward she was the first woman ever to lead the organization. obviously we are trying to find more details about the administrative leave why she is placed on it. as we get more details from this city official or the police department, we will pass those along. mark darria.

>> thanks a -- darya. >> thanks a lot jackie>> this comes during a difficult time. oakland is looking for a permanent chief right now. this after a sex scandal involving a underage call girl as well as a racist texting scandal that caused three chiefs to step down in the course of a week earlier this summerch the department has been under civilian leadership since june but oakland mayor wants a permanent chief in place by next year and she launched a nationwide search yesterday. city leaders are reaching out to the public for help and they particularly want younger people to make their opinions known. the city hosting more than 10 forums to weigh nonet search. the mayor has ruled out the possibility of hiring from within the department. she says this is an opportunity for a new chief to come in and do some good. >> oakland represents an incredible opportunity for a reform minded police leader to really make their mark and demonstrate the potential for

21st century policing. >> the job will rei be posted next month. first youth meeting is at 5 this thursday evening in the castlemondmont high school auditorium. san hoe sigh city council can declare a state of emergency because of the staffing crisis. kron 4 was there yesterday and saw the rvs outside police headquarters because some officers can't make it home due to mandatory overtime. the staffing levels hit an all time low prompting the council to consider declaring a public safety emergencies and if they do that san jose's police chief eddie garcia would be allowed to reassign detectives to bring patrol levels up. >> police chief is restricted by state law that requires a lengthy meet and confer and requires the union to meet with the office that has a grievance over how they would be reassigned we have to get past that because we have a limited period of time before the next

packer colin kaepernick sat on the bench behind his teammates and after the game he told reporters he will continue to sit during the national amount um and -- anthem and he doesn't want to stand for aing in a that he claims represents oppression and oppresss black people and people of color and until he sees positive changes he will continue to sit throughout the season when the national anthem is being played. so it no longer was a sports story but a news story with people across the country chiming in and people burning his jerseys and saying i support what he is doing and right here in the bay area, tommy smith the famed 1968 who raised his black fist in defiance in mexico city during olympics it was so controversial back then that we tracked him down and here's what he had to say about kaepernick's stance. >> not all of us are necessarily in agreement with what he is doing what he is

doing it with but we understand the message he is putting out there. young folks ought to listen up. they are tough on him and he may lose more than he thinks by those people who don't understand but i hope they give him a chance. he will stand one day. >> reporter: colin kaepernick angered law enforcement not just for his stance on what he claims is oppression but he also basically said it's easier to be a police officer than it is to be a cosmetologist that takes 6 months to train to be a police officer. that really upset the alameda county sheriff office who challenged him to see what we do to prepare for our jobs every day. so far we have not heard back from colin caper he nick whether or not he will accept the challenge. then the next time you see me i will tell you what legend jerry rice had to say about colin kaepernick and if you are at work at 10:30 when the news conference is taking place we

they are look for big waves out of that system. there's lester behind it and this track is different and should go to the north of the island chain and on the weaker side of the hurricane it will still pack a punch. a lot of wind and rain and, of course, big waves with that too. the exact impact uncertain. it's too far out they haven't issued watches or warnings yet they will see where inside the cone of uncertainty the storm will trace so we will watch this carefully in the kron 4 weather center folks here have family on island. we will keep you updated as both systems make their way closer and closer to the hawaiian islands. breaking news fromth european union says apple must pay 14.5 billion dollars in back taxes. they say ireland gave illegal tax benefits to the company a three year investigation found the tax rate on the european profits dropped from 1% in 2003 to .0005% in 2014. so now ireland according to the

of the north bay it's backed up to bellham and slows up to mid- span the opposite direction westbound is the commute side approaching the toll plaza that is the usual stop and go traffic from witchmond parkway -- richmond parkway it's the usual crowding and folks heading to work so it is backed up. the bay bridge into san francisco slow traffic here at the toll plaza. backed up to the maze and it will be around 25 minutes from the maze to the skyway and will get better on the upper deck but jammed behind the toll plaza that's what we expect for this time morning. so no major problems in san francisco. checking in on the ride on 92 recovering from an earlier stall that was near mid-span and it is out of the way but if you need to leave hayward you will have to sit in slow traffic on nimitz. hayward is recovering from a crash and stuck this traffic on west-92 to the high rise portion and it's less than 30 minutes but packed here heading into foster city and san mateo.

downtown. under partly sunny skies. and that will be breezy and we are looking for pretty strong winds especially around 7 tonight for the giants game. we could see gusts as strong as 25 mice per hour at ball park. here's where temperatures ought to be later this afternoon when we hit the peak heat for the day about 3:00 or so look for about 88 degrees in concord and 85234 livermore and could get up to 90 near fairfield. warm in the east bay valleys warmer than yesterday in the san jose areas santa clara valley similar store jay lot of low 80s and that a little warmer than yesterday. 74 expected in oakland. 67 san francisco. and mid to upper 80s across the north bay. here's short-term outlook wednesday, thursday and temperatures begin to fall and that will be the story for the second half of the week. a cooling trend which will bring us into the month of september on a very mild note. that will be on thursday. the weekend ahead looks pretty mild and i will have that forecast coming up in just a little bit. guys. >> all right thanks james. governor brown is deciding whether to make sexually

assaulting an uns. or severely intoxicated person a crime ineligible for probation the measure is in response to the brock turner case who was sentenced to 6 months in jail for sexually assaulting a unconscious woman and will be released on friday after serving 3 months. the proposed legislation would prohibit probation in such cases requiring jail time for anyone convisked rape or sexual assault of a unconscious or intoxicated person. bill dodge ace it clarifies a victim can't consent while conscious are unconscious orincapacitated by drugs alcohol or medication. fire fighters in northern california are working to try to get the upper hand on a fire near the oregon border and here it is. the smoke from it and the glow you see there about 50 families have had to evacuate as this gap fire it is called is burning. it burned 5,000 acres so far. and that smoke is heavy near

the wall fire started saturday evening and destroyed five homes and several other structures. as of last night, firefighters were working to get a fire line to keep the flams away from homes in the area. they say they still have a long way to go before they can bring this under control. and an update on willow fire burning east of san andreas it's grown to 450 acres and it is 50% contained right now. homes are still threatened and evacuations are underway for one neighborhood. fire officials say a car driven by a woman high on drugs started the fire. they say she was driving on the rim of her car's tire when it started sparking and that caused the fire. and nearly 10,000 workers are suing chipotle claiming they cheated them out of pay. current and former employees claim they made them work off the clock. they retunnel require

clinton while 39% support trump. time is 7:34. and investigators at los angeles international airport are focusing on what prompted the first of several 911 calls falsely reporting gunshots. that sent packed travelers running onto the streets and the tarmac. the initial 911 call came in about 8:45 sunday night after 5 minutes after officers detained a man dressed as zoro who was carrying a plastic sword. shortly after that false reports of an active shooter quickly spread. passengers in five different terminals started evacuating and some even rushed through security checkpoints. a search uncovered no evidence of any gunmen or any shots fired. a burlinggame company is facing felony charges of and may abuse this is the shot of their dog they are accused of boiling hot liquid on the dog and waiting for more than week

men wanted in a armed robbery at a morgan hill business. this robbery happened friday afternoon in latino unitos a money transfer service. one of the guys went up to the cashier showed what looked like a revolver and deman money and the employee handed over the cash. they left in a red sedan possibly a mid-2000 camry with tinted windows. and and sit -- an assistant teacher from la unified school district charged with smuggling heroin terry nichols visited a person on death row for killing 8 people. they found plastic bags in a trash can in the visiting room nichols and mill sap usednichols says she brought contraband into the visiting room she had 18 cell phones and chargers and heroin she had hidden and is due in court in marin next month.
