relatively well around the bay area this morning. this is a look at interstate 880. also this morning we have a look at 80 westbound. we are looking at traffic that is moving well heading out to the mccarthur maze. and if you are driving in san francisco northbound 101 traffic looks good approaching the 80 split. now back to the desk. we begin with breaking news this morning. two children are among the four people reported injured in an apparent hit and run crash. tara moriarty joins us. >> reporter: a woman and her two daughters and another family member were backing out of freeway here in this blue monte carlo and somebody slammed into them in a jeep and took off. it happened just before 4:00 in the morning. the woman spent the night at

her uncles house and was heading home when the jeep broadsided her. she and her two girls were taken to the hospital with minor injuries. when the driver of the jeep crashed into him his license plate fell off but they won't be able to identify him the car had been stolen six or seven miles from here not too long ago. police found that car but no suspects. now the womans uncle that lives here said he heard the impact and came running out in the street. he is grateful that his niece and her daughters will be okay. this morning a group of occupy protestors are still inside a locked uc berkeley agricultural facility. claudine wong is in albany this morning the demonstrators are not budging. >> reporter: that is is right. let's get a look at the occupy the farm protest.

you have folks still outside the campground. you have locked gates inside. you have tents and folks sleeping right now. the situation as it stands right now the university filed a lawsuit trying to get the folks out of this ten acre plot of land. yesterday they locked the gates and told people they would be allowed to go out but wouldn't be allowed to go back in. obviously as you can see from the situation no one is leaving. jesse smith has been out here all night up anding to stay warm. can you tell us the situation? >> everybody is so just you know happy with what we are doing and how fulfilling the occupy the farm experience has been that even the presence of police hasn't dampened spirits. >> reporter: so any plans to leave? you have the locked gates. people have been going over the fence instead of through the

gates. it looks like everyone is holding status quo. is that the plan not to leave? >> i think there quite a few people inside that have put so much into this farm and committed so much emotionally and otherwise they are more than willing to get arrested. we have had such an outpouring of support from the community it's kind of hard to leave at this point. the farm means so much to just us but to the people that live around here. >> is there any chance you will work out something from the university? >> reporter: yeah i really hope we can. the main complaint that i and a lot of other occupiers at the farm have we want some concrete commitments from ub berkeley that they are really going to allow us to continue our agricultural here. i mean food is something that is a right in the minds of a lot of people here. you have the right to not be

hungry all the time. >> reporter: thank you very much for chatting with us. i appreciate it. again, it's kind of status quo right now. you can see security and police officers keeping that gate if you take a close look at the gate there is a lock on that gate. however, you can see there is tents and protestors inside. whether they will take more action and try to clear out this area that remains to be seen. we will keep an eye on things. live here in albany claudine wong. oakland police need your help to find a missing 11-year- old boy. police say jerry walker ran away from his west oakland group home wednesday night. he attends l.a. i'm school but failed to show up for class yesterday. investigators tell us they think jerry ran away because he was facing disciplinary action at school. he could still be in west oakland or may find his way to east mont mall. time is 4:34.

this morning members of oscar grant's family will hold a news conference. they will denounce johannes mehserle's efforts to have his -- overturned. grants family will be outside the county district attorneys office at oakland at 9:00 a.m.. san francisco police now confirm the man killed by a police sharp shooter this week was suspected of fatally beating his own mother in roanoke park. they are also revealing details of the violent attempts. they say 41-year-old dennis hughes barricaded himself inside his girlfriend's post street apartment. and that he began lighting fires and shooting through walls, floors, and ceilings

when officers tried to arrest him. >> due to the significant and ongoing deadly threat that he posed to the community, firefighters, and officers and dangerous fire that continued to grow a sharp shooter shot the suspect. >> they say he flew into a violent rage after 66-year-old dyne hayes told him to move out of the home they shared. a memorial will be held tonight for a new york teenager that was shot to death. an 18-year-old fremont man has been charged in his death. he attended nu ark -- newark memorial high school. today's memorial begins at 6:00 at newark memorial high.

18-year-old redwood city woman is behind bars this morning accused of dousing her boyfriend's bed with gasoline and setting it on fire. they believe her 21-year-old boyfriend were cheating on her. he suffered minor burns to his arm. time magazine has unleashed a storm of controversy with its magazine cover. a lot of people say the images is just too much. coming up we will show you that cover photo that has become quite a hot topic of debate over parenting. the largest u.s. bank lost $2 billion in the last six weeks. ceo of jp morgan chase said it came from bad decisions in a stock portfolio. those are the same beline the 2008 financial collapse. jp morgan has been considered one of the safest and best

managed banks. its stock set to open down 7%. 4:37 is the time. let's check in with sal for a look at traffic this morning. good morning, sal. >> good morning, pam. traffic is doing well around the bay area. if we will look at some of the pictures i will show you for yourself you can see traffic on 80 looks very nice and heading out to the mccarthur maze there are no problems for you. we're hoping for you to have a nice drive. it should be a nice drive getting across into san francisco. no problems at the toll plaza. and this morning on northbound 280 we are off to a good start here. northbound 280 getting up to highway 17 that traffic is moving well. here is steve. >> a little westerly breeze from sfo to fairfield. fairfield is less than ten that tells you there is not much in the way of a breeze. 40s and 50s on the temps.

indonesia. search crews had to trudge through the rugged terrain for almost 20 hours to reach that crash site. so far they have recovered ten bodies of the 45 people believed to be on board. the jet liner crashed on wednesday after a demonstration flight for journalists. 4:39. mitt romney's high school days come back to haunt him. the bullying incident he's apologizing for. >> and disturbing new information for bay area veterans. >> good morning, if you are driving over the sunol grade any time soon 680 southbound looks good. they attended the dinner with their husbands. we are hearing vice president joe biden apologized to president obama for up staging him on the same sex marriage issue. he affianced his support for same sex marriage on wednesday he acknowledged he was going public with this decision earlier than he planned after biden revealed his support for gay marriage in an interview last sunday. republican presidential candidate is altses apologying for what he calls high school pranks. >> i had no idea what that individual sexual oration might be. going back that is not something we all diskissed or considered. >> several romney classmates have confirmed that romney led a group of friends that cut off the the boy's long hair.

bay area veterans wait nearly a year for their disability claims to get processed. that is according to a highly critical report. the yearlong waiting period is nearly double the national average. in response they have pledged to increase staffing and improve training to speed up claims process. the oakland office handles benefit claims for veterans from bakersfield all the way north to the oregon border. santa clara county man will spend the rest of his life behind bars for a murder for hire case. paul received the sentence for life without the possible of parole for hiring a hitman. garcia was jealous that a female bartender loved the owner and not him. the hitman is serving a life sentence as well. marin county teenager accused of high profile crimes will return to court next

two girls and killing their mother and older sister is now dead. authorities in northern mississippi say they repeatedly ordered adam mayes to surrender yesterday but he shot himself in the head. the two girls ages eight and 12 were found alive. the girls along with their mother and 14-year-old sister disappeared from their tennessee home. >> i would have liked to see adam face his charges and stand more accountable. he took the sissy way out. probably thought the girls were safe and that's all that matters. >> the two girls were taken to the hospital and released early this morning. mayes reportedly kidnapped them because he believed they were his daughters. yahoo ceo said he did not give out bad information about hiss education. he did not say he had a degree in computer science either before or after being hired by yahoo last january.

one shareholder is demanding thompson be fired. yahoo will only say the information about the computer science degree was quote an inadvertent error in an fcc filing. when facebook goes public one of the big winners will be microsoft. microsoft hopes to mind peoples online social connections to provide more personal search results. for example the search for hotels in maui could bring up a search for where your friends have searched. voter support for his tax hike initiative is crucial to solving the states budget problems. he dropped after a batch of signature petitions needed to qualify for a ballot. it would temporarily increase sales tax by a quarter percent.

a competing tax plan would raise income taxes on nearly all wage earners with the wealthiest seeing the greatest boost. 4:50. people in palo alto are pleading to the animal shelter from closing. supporters packed a council meeting last night holding signs with the letters s.o.s.. standing for save our shelter. palo alto is considering out sourcing the animal division service. that is after the city of mountain view ended its partnership with the shelter taking away nearly $1 million. >> the animals dedefer they have done nothing bad in their lives. >> there are many domestic animals in palo alto. i believe they benefit. and we need our animal shelter for our sake as well as for theirs. >> last night a city council

committee voted to reject the proposal and explore other ways to generate revenue but the full city council will have the final say. final decision is expected next month. postal workers teaming up with bay area food banks they will be collecting food for the annual stamp out hunger food drive that take place tomorrow. if you want to take part leave nonperishable food items out by your mailbox. 4:51 is the time. price of oil is falling but gas prices are on the rise. the reason bay area drivers are paying more at the pump. >> plus texting behind the wheel is illegal in many states but one small town is taking that ban even further.

4:54. the price of crude oil has fallen in the past two weeks that is not effecting what we are paying at the pump. the national coverage is $3.74. that is almost $.50 less. it has gone up about a nickel here. experts warn we could see another $0.20 increase on the west coast because of problems at refineries. in california it's illegal to text behind the wheel. in one new jersey town police are giving away tickets for people that text while walking. the crack down is all about safety. they have responded to 23 pedestrian accidents just this year. three of those were fatal. 4:55 is the time. sal, texting dustiest tract people from a -- does distract
