we start this morning with a fatal accident out of summerlin. we're working on getting more information but right now we do know that one person has died. roads have been re-opened in the area. this story is developing we will update you as soon as we know more. a metro officer accused of domestic battery will appear in court tomorrow. officer james burt was taken into custody yesterday. he is accused of domestic battery by strangulation and first degree kidnapping. hannah brook/safe nest it's very unfortunate because it shows that domestic violence can happen between anyone regardless of career choice or economic stature. usually when it gets to this point where the police have been called to arrest someone it's been going on for quite awhile.. many times domestic violence will start with simple verbal abuse emotional abuse and that's something to look

it's a crime of control. metro says burt has been relieved of duty without pay--pending judicial and internal investigations.. if you or someone you know may be in an abusive relationship you are urged to contact 'safe nest' for help... right away. a former metro officer is indicted on charges of violating a woman's civil rights while trying to arrest her. the justice department says "richard thomas scavone" used excessive force during the arrest, then falsified a report about it. this happened on january 6th, 2015. metro says the incident was captured on body camera. scavone is accused of grabbing the victim around her neck and throwing her to the ground. he faces up to 30 years in prison, if convicted on both the civil rights count and obstruction count. police are looking for a suspect they say stabbed a man, and took off. it happened

morning--at the safari motel on fremont and bruce. metro says the suspect came to his ex-girlfriend's room and stabbed her friend several times. the victim was taken to the hospital in critical condition. police did not say who they are looking for. if you know anything about this stabbing, call crime stoppers at 702-385-55-55. president obama delivers his seventh - and final - state of the union address. where he laid out his vision for the country. fox news correspondent caroline shively has more shively says: "the president said it's time to stand up... speak out... and fix our politics." president obama used his last state of the union address tosk americans for civility and optimism but still got in a jab at the presidential candidates. obama says: "for this final one, i'm going to try to make it shorter. i know some of you are antsy to get back to iowa." the president avoided the usual laundry list of legislative goals that congress has no intention of even bringing to a vote, instead he

democratic presidential candidate hillary clinton releases a gun ad during president obama's state of the union address. an average of 90 people are killed by guns in this country every single day. it has to stop. she goes on to talk about how the president wants to make universal background checks the law of the land. and asks viewers to join him and stand up to the gun lobby. the ad is titled, 'i'm with him'. police in pennsylvania release new details about a deadly shooting that took place while serving an eviction notice. one that killed a 12-year old girl. officers say a pennsylvania state constable was serving the notice to a man living with his wife and daughter. a confrontation ensued. the man pointed a gun at him--and the constable fired. the bullet struck the suspect in his upper arm-- traveled through him-- hit his daughter--and killed her. no one is immune to

"and then for someone to be injured, be killed, especially a young person is unimaginable." the father of the child is expected to survive. he's facing a number of assault charges. 10 u-s soldiers are free this morning... after being detained by iran. the group includes 9 men and 1 woman. their small boats reportedly experienced mechanical problems in the persian gulf... and drifted into iranian waters... that's when they were picked up by the revolutionary guard. there's no word from u-s officials explaining why the boat drifted, but an iranian spokesman claims the boats' navigational system failed, causing it to drift near an iranian island. powerball is now sitting at a fat 1.5 billion dollars... and will likely be close to 2 billion by tonight's drawing. fox5's shannon moore is live near primm where hopeful players are lining up

commissioners invited buskers...which is just another name for street performers...to give feedback at city hall. many say the performers are upset with the city. earlier this week we brought you the story of a man who took his shirt off...and gave it to a homeless man on a new york subway. now... we hear from the good samaritan himself. the homeless man was freezing-- shivering from the cold. so 23-year-old joey resto took the shirt off his back and dressed him. he then gave him his knit cap as well. 2:25 - 2:34 it was crazy it was crazy that everyone was just looking. and not doing anything about it and it was freezing. thats the least that i could have done. resto says he tried to do even more by offering to buy him a hot meal. but he says the man fell asleep while they waited on the train, so he called 3-1-1 hoping to get the man some help. fans react! the first runnin' rebels game of the season--without head coach dave rice!

lake mead parkway and industrial yesterday afternoon. henderson police say the s-u-v was trying to turn left, when the motorcycle crashed into it from behind. the biker was thrown to the ground, and later died at sunrise hospital. police say it's too early to tell if drugs or alcohol were involved... but they do say the biker was speeding and the driver failed to yield. former clark county commissioner tom collins says he still plans to eventually run for north las vegas mayor. collins was arrested on a charge for driving impaired back in december... after a crash while leaving the n-f-r at the thomas and mack. on tuesday--he pleaded "no contest". he will have to pay a 685-dollar fine and complete d-u-i school... which he's already finished online. collins says this is a lesson learned. ge history. i made a mistake. but im still tom collins. im still the man that goes out there and works hard for everybody. everyday." collins' attorney

not receive any special treatment. they will put a motion to close the case out early... once the fine is paid. the public utilities commission is set to vote today... ...on whether or not to suspend a rate hike for rooftop solar power customers. a rallagthe hike is scheduled for today, as well. fox five's nick lagrange joins us live from the p-u-c building near 215 and russell, with what the commission will debate and vote on today. nick? state regulators are reviewing the rate hike that went into feefct january first. in the meantime -- the public utilities commission will vote today on whether or not to suspend the hike while that review takes place. this is the issue: december 22nd -- the p-u-c approved a new rate structure for roof-top solar customers that imposes an increase in the fixed monthly service charge, while lowering credits for excess power generated from these systems, as well. as a result --

customers have questioned why the hike and credits have been changed, after they spent tens of thousands of dollars to install the systems under the previous metering guidelines. also as a result -- major roof-top solar companies -- sunrun and solar city -- say they are cutting jobs and leaving the state. "definitely any uncertainty definitely hurts your business. and theres so much uncertainty here. and especially in light of what the potential is for the things that they're talking about its definitely an industry killer." commisioner david noble is presiding over today's vote. noble is against suspending the rate -- arguing if the order is found to be erroneous as it relates to any rooftop solar rate-payers, the issuance of a suspension is unnecessary, he says. noble says any amounts that will be paid by those rate-payers that should not have been paid can be refunded and otherwise corrected through billing mechanism. noble also argues the average rate hike over the first

former clark county commissioner tom collins says he still plans to eventually run for north las vegas mayor. collins was arrested on a charge for driving impaired back in december... after a crash while leaving the n-f-r at the thomas and mack. on tuesday--he pleaded "no contest". he will have to pay a 685-dollar fine and complete d-u-i school... which he's already finished online. collins says this is a lesson learned.
