tuesday. we begin with another night of violent protests in charlotte, north carolina. the state's governor has declared a state of emergency in the wake of tuesday's fatal police shooting. cnn's dianne gallagher joins us live from charlotte where the national guard is moving in to help control the crowd. good morning dianne, what's the latest? but just a few hours earlier, the scene was very different. a second night of unrest gripped the city ... as protesters angry over the death of keith lamont scott vented their rage scott was shot tuesday -- police say he brandished a weapon but his family says he was reading a book in his vehicle. amid the unrest wednesday evening, north carolina's governor declared a state of emergency and said he'd deploy both the national guard and the state highway patrol to charlotte. one person was shot by another civilian, according to authorities, and is in the hospital on life support. several police officers were injured. journalists were caught up in the chaos. (nats boris sanchez gassed) one reporter was knocked to the ground by a passing man. (nats ed lavendera knocked over)

40-year old terence crutcher was unarmed.. and had his hands in the air.. when he was shot and killed by police. officer betty shelby is now on administrative leave. local and federal authorities are now investigating exactly what happened.. officers shelby says she feared crutcher had a gun.. saying he was reaching into his car window.. but crutcher's family paints a different picture. that "big bad dude" was enrolled at tusla community college.. just wanting to make us proud the family's attorney says he has a picture that clearly shows crutcher's window closed... and that the officer was in no danger. community members linked arms during the church service saying they will keep it peaceful... but they do want justice. back here at home.. the black lives' matter protests have moved to the courts.. with a local public defender standing her ground.. saying she will not remove the pin from her shirt. the las vegas

wrote into the police chief.. asking him to ban all black lives "paraphernalia" from the courtroom.. including erika ballou's small pin. fox 5 spoke with an attorney who specializes in first amendment rights. he tells us... the issue isn't about black and white-- the judge has the responsibility of keeping the courtroom impartial. "i think that black live matter should be equated with breast cancer awareness. what we're trying to do is stop people from dying." "there are a lot of symbols and statements being made. was this such a big deal? i don't know" while free speech is protected... the attorney went on to say... a judge has an obligation to keep the courtroom free from politics. sprinklers are to thank for dousing a fire at the golden nugget overnight. a fire broke out in a room prompting many people to evacuate. fox5's peter dawson is live downtown with more on how the fire started. a rude wake up call for many guest here at the

the 8th, 9th and 10th floors were evacuated due to a small fire in one of the guest rooms on the 9th floor. las vegas fire tells us the small fire started after a women fell asleep and the cause is smoking related. a mattress started to smolder setting off the sprinkler system triggering security at the hotel to evacuate three floors of the carson tower. lv fire pio tim szymanski says all guest were allowed to return to their room about 90 minutes after the evacuation, but most guest probably didn't even know this incident was taken place. "this is an 18th floor building...and only the 8th and 9th floors were evacuated. the fire floor, the floor above, and the floor below, the rest of the people were probably not aware of anything going on in the building" investigators believe this was an accident and as of now the woman staying in the

charges will be filed. we just spoke with someone at the hotel and they told us that the cause was an electronic cigarette plugged into the outlet and charging. we're working to confirm this, tim szymanski only told us this fire was smoking related. shortly

countdown to the 20-20 summer olympics is already underway in japan. the olympic flags ceremony officially begins the countdown to 20-20. the ceremony took place in tokyo, the site of the 20-20 summer olympics. the tokyo governor and japanese olympians and paralympians were among those in attendance. the u-s citizenship and immigration services will naturalize 800 new citizens today at the cashman theater. the candidates for citizenship originate from 64 countries. the ceremony is part of the annual celebration of constitution day and citizenship day a local group is daring to take the fight to terrorists at their own front door. at the golden nugget overnight. three floors of the 18 story hotel had to be evacuated because of a fire in a guest room. fox5's peter dawson is live downtown with more on how the fire started. imagine going to bed after a night of partying only to be woken up by fire alarms and security. that was the situation for many guest staying on the 8th, 9th and 10th floors here at the golden nugget. when their floors were evacuated. las vegas fire tells us the small fire started after a women fell asleep and the cause is smoking related. a mattress started to smolder setting off the sprinkler system triggering security at the hotel to evacuate three floors of the carson tower. lv fire pio tim szymanski says all
