>> this is cbs-3 "eyewitness news". a judge has granted bail for monsignor william lynn after almost three years in prison for his role in the philadelphia archdioces handling of the clergy sex abuse scandal. good afternoon, i'm brooke thomas. >> i'm jim donovan. monsignor lynn's case being argued in philadelphia while mean senior lynn is jailed in northeast pennsylvania, our joel holden is in center city with the decision handed down this afternoon. good afternoon, joe. >> reporter: good afternoon,

monsignor lynn's family will drive up to the prison north of scranton where they will pick him up and bring him back here, it was a rather anti-climatic hearing here earlier this morning at the cjc with monsignor lynn attorney arguing he should be set freon the $25,000 bail. and it is our expectation, according to lynn's attorney, that he will be released from prison immediately. now, thomas bergstrom emerged from the cj seat around 10:00 this morning, and he spoke with us, telling us, that of all things, he says, that lynn has been scapegoated by the district attorney's office. he says, and i quote, da seth williams has been over the top, inaccurate, dishonest in his handling of the landmark priest sex abuse case. the first where high ranking church official was held responsible for not acting to stop dozens of preditor priests from praying on children. now, the da has vowed to retrial lynn after the supreme court ordered a new trial, after monsignor's conviction

was overturned. lynn spent 33 of the last 36 months, of the initial sentence in jail. lynn's lawyer, directly challenged the da, outside court. >> he continues to want to beat up on this guy. and i think we all know where he stood, meaning, where lynn stood in this hierarchy. we all under stands that lynn never touched the kid, and we all under stands what the sue peer court did twice, but yet in the face of all of that he wants to retry it. well, we're ready to go. >> and we have this statement from snap blasting news of lynn being released from prison writing, quote, some who are hiding child sex crimes will be relieved or maybe even unfolded by this news, they're both wrong and stupid, it says, increasingly law enforcement officials are pursuing both those who commit and those who conceal sexual violence. at this point the archdioces has referred all comments toilings' attorneys, we are awaiting a statement from the philadelphia district

temperatures little cooler but depends where you are. check it out. south jersey, cape may courthouse, full sunshine right now, 75 degrees, but we have east winds, 14 miles per hour, coming off the cooler atlantic. so that's knocking temperatures back down just a little bit. generally upper 70s, close to 80 in wildwood and dover, delaware, you can see where the clouds are right now. delaware, parts every extreme southern new jersey seeing little bit more sunshine. and, some of these clouds should break up even around the city. so, partial sun this afternoon, temperatures eventually in the lower 80s, that's below average, and humidity continues to drop throughout the day. on our way up to 83 for philly, near 80 at the shore. talk about more heat, humidity, making come back later on during the week, brooke, jim, back to you. >> thanks, justin. >> five year old delaware county boy was kill by a lightning while vacationing with his family. it happened in north carolina on beach in the outer banks. the boy, steven little, was a member of the lansdowne swim club. we're told the family was trying to get out after storm and into their suv when the boy was struck by lightning.

california freeway. the charter bus caring 30 people from southern california to sacramento crashed into a highway exit sign around 3:30 this morning. the impact of the crash nearly split the bus in half. at least five others were injured in that accident. federal health officials are warning pregnant woman to avoid a popular florida neighborhood that spawned more than a dozen cases of zika. >> the first time the centers for disease control has issued a travel advisory for the virus in the united states. david begnaud in the wynnewood section of miami where health officials are struggling to contain the virus. >> with more than a dozen case this is small miami neighborhood of wynnewood is home to the largest on-going zika transmission in the continental us. health officials are struggling to control the 80s mosquito. >> they've been applying both chemicals to kill larvae mosquitos, adult mosquitos, every day, it isn't working as well as we had hoped, that

could be because some of the mosquitos are resistant to those insecticides. >> doctor director of the center for disease control and prevention says the mosquito only traveled about 164 yards, in its lifetime, but it moves quickly. >> it has been referred to as the cockroach of mosquito it, lives indoors and outdoors, it can breed or hatch in a few drops of water, the ex can last more months, and it can bite four, five people at once, spreads the disease rapidly. >> in the last two weeks, 14 seek a cases have been identified as locally transmitted, in two south florida counties. twelve of those infections, are with men, the virus is most dangerous, though, with pregnant women according to the cdc, women with zika symptoms should wait at least two months before trying to get pregnant. infected men should wait six months before trying to have a child. doctor diego smell said he's ramp up testing for all

that's not in my vocabulary. >> just regular human being. >> yes, let's go with that. cooler than average, good stretch of weather for early august, but we will crank back some heat in the seven day forecast, nothing too crazy, show you that in just a bit. but at the shore people still out on the beach this afternoon, even though not a loft sunshine, but still need the umbrellas up. and people are taking that advice, as the sun very strong coming, even with the cloudy sky, you can get a sunburn, so wear the sun block, low tide, ocean conditions, kick up little bit with the east wind, so moderate threat for some rip current today, really the next couple of days, be aware if you are headed to the shore. storm scan3, quiet, rain free, may get pop up shower specially west of the city later this afternoon, notice still some clouds hanging tough, few breaks in the clouds, extreme southern new jersey, into delaware, that's where we find the warmest temperatures, pretty clear across western pennsylvania, what we can look forward to later this afternoon into tomorrow. than is the visible satellite showing the thickest clouds pretty much over the city to the north and south over

camden, gloucester county, new jersey, but, where we have the sun, look at the temperatures, much warmer, near 80 in wilmington, 80 millville. still nice breeze off the water, keeping the temperatures from getting too hot today. dew points, coming down. yesterday they were in the 70s, felt very humid tropical, by tonight, going to be in the 50's to low 60s, that's nice for early august, that's the trends through the day on wednesday. so great day to be outdoors tomorrow, even into thursday, humidity levels stay on the lower side. they start to move back up as we head into friday. here is the tropical system of the season, earl, just south and west of jamaica, winds currently 45 miles per hour, may strengthen up to 60 before it weakens again as it hit the uketon peninsula, looks like late this week thursday or friday. so if you have plans down to mexico, late in the week, could run into some disturbed weather. all right, back home though, we have low pressure moving off shore, still maybe stray shower later today, but quiet tomorrow, little bit more sunshine, temperatures in the low and mid 80s, few degrees below average. thursday still looking good,
