substance. donald trump es style is attractive. pretty soon there has to be substance. when we hear what the substance is of what his programs are for vision of america, i don't think his candidacy will last long beyond that. >> on the other side of the race, controversy for hillary clinton. her state department chief of staff, mills, a lawyer long at her side, testified behind closed doors to the benghazi committee. today, andrea mitchell's one on one. >> joe biden gave emotional explanation of where his head is at right now. he honestly doesn't know if he's going to run. >> i'll be straightforward. the most relevant factor in my decision is rather my family and i have the emotional energy to run. everybody talks about a lot of
factors. other people in the race and whether i can raise the money and whether i can put together an organization. that's not the factor. the factor is can i do it? can my family undertake what is commitment that would be proud to undertake under ordinary circumstances. the honest to god answer is i just don't know. >> the first presidential debate is next month. a clear line as to where religious freedom ends and law of the land begins. kim davis is behind bars, jailed for contempt of court for refusing to issue same-sex marriage licenses to same-sex couples. that didn't sit well with those that feel it violated god's law.

against her ordering her to do her job. the supreme court declined to block orders. the judge found her in contempt and ordered her to federal custody. >> she will stay in jail. she will not bow to nobody. that's our beliefs. that's what people don't understand. >> social media lit up in response, in favor of and appalled by the judge's ruling. major victory. the suspension has been overturned. he was spotted walking in the hallways prior to the game. richard wrote there were significant legal deefficient says against brady and the league didn't treat him fairly. the league has appealed the decision. brady will be able to play in

run as i a third party candidate. it comes down to that. he's surging at the top of the polls, maintained the lead. he's looking to keep that. to keep that he'll be able to hopefully grow that lead with folks who are weary in the republican party he would run a third party run. >> is he becoming too serious of a candidate in his attempt of becoming a serious candidate? >> it really does cut against the political brand of his off the cuff. i've got to tell you at the press conference, when talking can way west in one sentence and bush in the other, still classic trump. >> still another day, another poll. a lot more between now and november 16th. trump and carson higher. this time it's a national poll. it's not just iowa poll. how do establishment republicans deal with this? >> that's a good question. if you look at top of the polls,
it's close to half electorate if not more going for political outsider. for republican party, it's interesting. it's no more of a contrast than to hillary clinton. if you're marco rubio to some extent or even someone like senator ted cruz, i think there could be an argument that should one of the non establishment candidates collapse, you could see some of those voters going in that direction. it's fascinating that 15 months out from election day, political outsiders have skyrocketed to top of the polls. >> quickly in 30 seconds we have remaining, clinton e-mails for a moment. today the buzz. what's the buzz in washington? >> the buzz is the scandal is only going to continue. the larger story is quite frankly when hillary clinton is on capitol hill testifying in october. that's just around the time as the first democratic residential
