cosby is back in court this morning. we'll tell you what attorneys on both sides of the case will be looking at today. and only on nbc 10, police respond to a 911 call at a local elementary school but arrive hours after the fact. good morning, welcome to nbc 10 news. i'm vai sikahema. >> i'm tracy davidson. let's go to bill henley in the first alert weather center trafficking showers. >> hugging the coastline this morning. dry in philadelphia, we did have showers move through the suburbs, philadelphia, delaware. those are in the cape may area. those showers streaming through cape may. it's about to start drying out. still continuing up in the atlantic city area. this is more likely where we'll see more wet weather during the day. possibly even thunderstorms this afternoon. right now, 57 degrees in new jersey. the lehigh valley, still some clouds around. we will see the clouds break for sunshine. 61 at 8:00. near 70 degrees at 11:00.

a quick warmup for philadelphia, too. clouds are over the city. we'll see them thin out at 7:00. 59 degrees. look at thecj$áquick warmup, 67 degrees by 10:00. still a slight chance of a shower for philadelphia. some of the inland areas this afternoon. it's more likely you'll see them over new jersey than the lehigh valley, delaware or the suburbs. 78 in interior new jersey. low 70s at the shore. a chance of showers and thunderstorms popping up this afternoon. over the coming days, it's the temperatures that are really going to start popping up. seven-day forecast, at the bottom of the screen it has more than one 90 in it for our area. a look at the warmup when i come back in ten minutes. right now, let's find out how the traffic is looking with jessica boyington. >> watching the boulevard for a set of traffic lights on flash. you can see that in here this is around 9th street. traffic is moving through. a lot of confusion in the area.

the boulevard and 9th street. traffic leets are malfunctioning, on flash there. if you're heading out the door, also still in philadelphia, northeast philadelphia, watch out for this accident investigation on cottman avenue and bustleton avenue. police activity there. in new jersey, small reports of flooding on 295 headed northbound around the black horse pike. some lanes blocked because of that. more updates in the next ten minutes. it's 5:03. breaking news on nbc 10ment police are looking for the driver responsible for a deadly hit and run at a bus stop in northeast philadelphia. katy zachry is live in northeast philadelphia this morning. the driver also took out the bus stop shelter. >> took out the bus stop shelter, that's what caused him to hit this individual who police say was waiting under the shelter either to get out of the rain or simply waiting for the bus. not long ago accident investigators collected dna evidence from the suspect's

vehicle, which is still parked in the middle of bustleton avenue. it will be towed soon, we understand. now, the damage is startling. as we push in behind this vehicle along the sidewalk, that debris there, that's a septa bus stop canopy that used to be at the corner of cottman and bustleton a news, but earlier this morning, just around 12:30, police say that's when the suspect's car hit the bus stop canopy and then hit the man who with you standing under it, throwing both of them at least 100 feet. let's go to our video of the scene. you'll get a better shot of the damage of this vehicle. right now police say they are looking for the driver of a 2003 lexus that they believe hit and killed a 40-year-old man who was waiting at the corner of this busy intersection. the damage to the lexus shows you how fast it was going and how hard it hit the bus stop. police say the driver crossed over cottman avenue an drove on

to the sidewalk, taking out nearly everything in the car's path. there are witnesses who saw it hit the bus stop and the man. according to those witnesses once the driver -- after the impact, the driver stopped the car, because he couldn't drive it anymore because of the damage, got out of the car, walked over to the victim, looked down, saw how badly injured he was and how near death he was, and then ran away. so at this time police have a vague description, according to witnesses. they say the driver was a man, standing about 5'10", medium build, last seen fleeing from the seen going southbound on bustleton avenue wearing a white t shirt. possibly a silver lining in this, because this is such a busy intersection, there's so many businesses around here, there's a number of surveillance cameras pointed in the area of where the crash happened. they're reviewing those hoping to find more information on who the driver is. katy zachry, nbc 10 news.

happening today, bill cosby is back in court this morning in his sexual assault case. this comes just after cosby and his legal team tried to delay today's hearing. matt delucia is live for us outside the montgomery courthouse in norristown. give us some context of the hearing. >> reporter: the point of the preliminary hearing is to decide if there's enough evidence to continue on and take this case to trial. there's a small chance the judge could throw the case out, but that's not likely. bill cosby has been in the spotlight of late. yesterday the pennsylvania supreme court denied an emergency stay presented by cosby's legal team. he's been trying to get this case dismissed from the beginning. part of the defense argument has been that cosby had an agreement with former montgomery district attorney bruce cast their there would be no criminal prosecution in exchange for testimony in a

civil case. some of that testimony became public recently, and the new d.a. vowed to prosecute cosby. cosby is accused of drugging and molesting a former temple employee at his home in 2004 what is expected to happen today is a back and forth over the evidence in the case. the prosecution may put the accuser on the witness stand. cosby's hearing is expected to begin this morning at 9:00. there's also media here from across the country. it happens every time bill cosby made an appearance here at this courthouse. that's what we're expecting here later on today. we'll have reporters in the courtroom following what happens. by the end of the day we could have a trial date for bill cosby. live in norristown, i'm matt delucia, nbc 10 news. new jersey lawmakers have a plan to save atlantic city from bankruptcy. at least for now. yesterday leaders from the state assembly and senate approved a

deal that gives the resort town five months to come up with a plan to balance its budget. the city will get a temporary loan of $60 million and be able to offer employees an early retirement plan. the full assembly will vote on the package on thursday. now to a story only on nbc 10. >> a man threatens children with a gun on a school playground and a 911 call from the school is placed but goes unanswered. >> sir, you are coming in very low. >> tinted windows pulled up, a gentleman pulled out a gun. >> last week police say a man in an suv used a gun to threaten fifth graders on pennsauken's urban promise school playground. the school called 911, but because the school sits on the border, the call got bounced from one police department to another. >> i don't care who responds.

>> the camden county director of public safety says from now on police in both towns will respond. happening today, philadelphia city council will hold a public hearing on the proposed soda tax. the mayor wants to add a 3 cents an ounce tax to sugary drinks. the money would be used to pay for universal pre-k, rec centers and other community events. city council has until june to decide on that proposal. after live view from camden, new jersey. we've seen some showers come through overnight. those showers have broken, now we're waiting for the clouds to break in camden and philadelphia. rainfall is at the shore. we've seen showers. these showers moved through philadelphia. still coming down for of the

shore. even inland areas, burlington county seeing light rain right now. in the southampton area and to the east, just falling to the south of trenton, pemberton, woodland and tabernacle getting a faw rain drops. we could see downpours this afternoon. the seam area of low pressure is still with us and still spinning showers our way during the day. this is 11:00 this morning. you can see the clouds over new jersey and inland. the further west you go. the better chance you will see sunshine and stay out of the showers. the further east, look at the storms that may pop up this afternoon. that's 3:00 this afternoon. heavy downpours will stream through the area and move off shore. there's a slight chance of a late day shower popping up. this is 6:00 this evening. cape may, a few rain drops and then we'll be drying out. 80s for the lehigh valley. bethlehem, 82 degrees.

sunshine for west chester, phoenixville and newtown. after clouds this morning, breaks of sunshine. 80 degrees for philadelphia. a slight chance for a late day shower in the city the better chance that parts of new jersey will see a shower, possibly a thunderstorm. the storms most likely along the coastline, atlantic city, galloway that will keep temperatures in the 70s. might see a spotty shower in delaware, more likely in rehoboth beach. 76 this afternoon. temperatures climb to near 80 for dover and wilmington. i'm tracking showers for parts of the area during the day today. summer-like heat is around the corner. the warmup really started yesterday. we were at 76 degrees. today, around 80. middle to upper 80s tomorrow afternoon. and 90 on thursday. that may not be the only 90 degree as we get closer to the memorial day weekend. the ten-day outlook when i'll back in ten minutes.

in new jersey, governor chris christie is starting a plan to remove lead paint from homes after vetoing a previous bill. the governor said he is putting $10 million the new program and

boyington. >> watching the boulevard, that's because there's a set of traffic lights malfunctioning on the boulevard around 9th street. just a few moments ago i saw a police officer head to the scene. i don't know where he went. he pulled over on to the shoulder for a minute. maybe they'll send somebody here to direct traffic around the scenement you can s ment scene. this is the boulevard around 9th street. reports of flooding on 295 northbound around the black horse pike. clouds are here. the rain, we've seen some showers move through delaware. this is a live view from crawly stadium. the sunshine will come through. a nice warmup during the day. 58 now in philadelphia. seeing rain at the shore. 57. about the same temperature, though it is clearing up in lehigh valley and showers have ended for pennsylvania suburbs.

for delaware, 57 degrees. and we'll be warming to near 80 degrees this afternoon. about a 25 degree warmup. still seeing a few showers to the south. this is where we're more likely to see rain during the day today. along the coastline. the further inland you go, the better chance you'll stay dry. showers are still moving through dover. that's very light rainfall to the south. it is a steadier rain in lewis. but even there you'll see breaks in the rainfall. clouds will be hanging in along the coast. the further inland you go, the more sunshine. less likely you'll need an umbrella. all of this is finally going to push out of here over the next 24 hours. we'll be drying out and the temperatures will be warming up. right along the coast, that's your best chance of showers. possibly even a thunderstorm this afternoon in new jersey. less likely to see those showers inland. more likely to see sunshine other than an isolated shower threat at 6:00 this evening.
