are superhero. >> reporter: the u.s. death toll now 35, and one man killed in an officer-involved shooting. police say he was hostile and displayed a hand give up in a flooded area. we have seen rescue boats coming and going in and out of the neighborhood all day. part of north carolina still under dangerous flood risk and will be at least for another three days. abc news, lumberton, north carolina. a gas explosion levelled two town homes chicago. utility workers repaired a gas leak in the village of romeoville when the blast took place sparking a huge fire. two workers were injured. one of them critically. no one was in the destroyed buildings when the explosion took place. residences were evacuated as precaution. there's a new plan to prevent gas leaks and explosions. starting in january, the government requires new or

to shut off gas automatically when the line is ruptured. the cost? $30. the fbi is reportedly investigating whether this deadly plane crash in connecticut was intentional. this morning's new york times reports the crash survivor told investigators it was not an accident. one person was killed when the small plane went down on main street narrowly missing a van. fbi and ntsb is looking into the crash. >> expected to be filed against sheriff joe arpaio. the charges come less than a month before voters decided if arpaio should get a second term. they issued a statement they were confident he would be exonerated and accused the obama administration for trying to influence the race. a mistrial declared in the case of two former new mexico police officers charged with mur. the judge announced the decision when the jury couldn't reach a verdict after three days of deliberations.
