who it is...his reason for calling it quits...what he might do next. a des moines police officer is in the clear after shooting and killing a man in june... good evening, i'm erin kiernan. and i'm dan winters the chief says the suspect charged at the officer's squad car, leaving her no choice but to shoot... 13's justin surrency looked into the policy that the chief says provides justification... he joins us first on 13. des moines police chief dana wingert says senior officer vanessa miller had to react fast when 28 year old ryan bolinger approached her squad car door after he lead officers on a chase through northwest des moines...he believes her reaction was well within the department's policies... "how would a reasonable person react under those circumstances in

that moment, not 20 minutes before or 20 minutes after but in that moment...that decision... "when you take all that into consideration, factor all that in and compare it to our policy, her actions do not violate our policy" the incident began with a traffic stop... captured on video by a squad car dash camera. police say bolinger was acting over and lead officers on a short chase through northwest des moines. bolinger eventually stopped... say he charged at miller's squad car and miller opened fire from inside her vehicle... shooting bolinger...who was unarmed... through the window...chief wingert said that miller was fearful for her life which he says also lands well within the department's use of force policy... "being in fear for their life or the life of an employee or another person" "any loss of life is tragic and having to deal with it from that day forward is certainly difficult" the attorney's for ryan

reaction... the opinion of the des moines police department on the matter is not a surprise to us. only by verdict of a jury of the officers peers will justice truly be had. we have prudently taken this situation one step at act reasonably as we move forward in our pursuit of justice." officer miller has been cleared for duty but has decided to go on personal leave at this time... chief wingert says senior officer miller has been cleared to return to work but has chosen to take a personal leave at this time... a newton man is accused of trying to kill three people with his car...including a 5-month-old. 50-year-old john britton faces three counts of attempted murder. police say britton hit a man with his car last night, then hit another vehicle multiple times... inside that car was a 50-year-old woman and a 5-month-old child. all of the victims are expected to recover.. but britton reportedly

told police he intended to kill the victims. we'll hear from one of them... describing the terrifying encounter tonight on channel 13 news at ten. a polk county jury was unable to reach a decision today in the attempted murder trial of pete polson..... but they did have a few questions for the judge. sot-judge jeffery farrell 09-does attempted murder necessitates premeditation, and two does attempted murder necessitates a motive." 15---7 seconds the jury asked if attempted murder meant that the crime was premeditated and for an explanation on what 'intoxication' means. they also asked if they had to be unanimous on all counts... the judge told the jury to go back and re-read the instructions and continue to deliberate. polson is charged with three counts of attempted murder after a random shooting spree in pleasant hill last november. polson is using an intoxication defense...claiming he doesn't remember what happened after a bad hit of meth... the jury will return tomorrow at 9 a-m to continue those

a woman from eastern iowa died house fire this morning. waterloo fire fighters were 4-30. appears accidental but crews haven't pinpointed the cause yet. fire officials say rebecca lavenz lived hurt. a firefighter was taken to the fire at a vacant home in walcott. crews were called to the building just south of the night. by the time they arrived, the home was engulfed. the firefighter who was hurt is expected to recover. a nearby corn field also caught fire. rain fell for the first time in october this morning....meaning the threat of fires is now all but gone. we'll go now to chief meteorologist ed wilson for a first look at weather. it has turned into a beautiful evening with partly cloudy skies as rain moves

a deer crashed through westerlin residence center at augustana college. you can see the deer slide into view after breaking through the glass. a staff member opened the door building. a town's former city clerk misspent more than 200-thousand dollars. leaders in the town of neola requested a special investigation after the current city clerk found irregularities in their finances. investigators now report that deb schierbrock misused 230- thousand over five years. over 100-thousand worht of that money went to pay for non-city expenses. she also didnt' charge herself or others late fees on their utility bills. schierbrock was fired back on 20- 13....she has yet to be charged with anything. a new report shows that iowans are not having a problem finding jobs. according to work force development officials the unemployment rate dropped

both rick perry and scott walker have already jumped out of the race for the republican presidential nomination. today the first democrat called it quits. former senator jim webb announced that he is dropping out of the race. this comes exactly one week after the first democratic debate. but webb says he will now meet with people from across the political spectrum to consider a third- party run for president. during his press conference he was critical of the democratic party for going after the republican party so strongly. "americans are disgusted by all this talk of republicans and democrats calling each other the enemy instead of reaching across the aisle and finding ways to work together. i know what an enemy really is, from hard personal combat. the other party in america is not the enemy; they are the opposition. in our democracy we are lucky to have an opposition,

meeting at boone's city hall auditorium. one of the topics brought up was the future of the national guard aviation facility there. last summer it was announced the black hawk helicopters would be moved from boone to the des moines international airport. the guard says something will replace those helicopters, but won't say what. the governor made sure to reassured community members that he knows what the facility means to them gov 13-32 the f-16s out of the des moines airport replaced with the oversight of drones, actually that mission is going to be more of a long-term mission, we didnt really like it, but were trying to adjust to it and preserve the jobs, and its very important to keep a strong presence here in boone. governor branstad also held meetings in jefferson and
