a construction accident killed a colfax man this afternoon... the worker was inside a trench in altoona when it collapsed around him... channel 13's jodi whitworth is following this story. she joins us know with more justin jorgensen was just 30 years old. he lived in colfax but worked at j-r-s excatving in saint charles. family friends tell us today was supposed to be an exciting day for him. after work he was throwing a birthday party for his four year old son authorities say jorgensen was working to install water and sewage lines in a trench when the dirt caved in around him. crews estimate the pit was about 10 to 12 feet deep and it did not have a trench wall to brace it's sides. they also said the dirt and clay was extremely unstable. under o-s-h-a regulations , in trenches deeper than five feet -- trench walls are required. when crews arrived on scene -- they said jorgensen was partially buried but knew they couldn't save him.
as a rescue but once we got on scene we could tell by visual cues that this was gonna turn into a recovery o-s-h-a is still investigating this case and it could take weeks before it is finished. a spokesperson tells me if they find any wrong doing -- the company could be fined jury selection started this morning in the trial of a clive man... 26-year old joe lopez is charged with first degree murder and child endangerment resulting in a death... prosecutors say lopez assaulted is girlfriend's one-year old daughter at this apartment building in 20-14. the toddler suffered skull and rib fractures. she died five days later at the hospital. police say lopez claimed the child was hurt falling out of a high chair. they say the injuries aren't consistent with a fall. jury selection will resume tomorrow. a chicago man is in custody
police say the victim was treated at a fort dodge hospital in july. officers arrested 21-year old shannon sago this week. police did not say how sago knew the alleged victim... and would only say that he was known to frequent the fort dodge area. former iowa congressman tom latham is fighting cancer... latham announced the lymphoma diagnosis online today... he's also staying positive... on twitter latham writes, "i have never lost an election & i'm not going to lose this battle either! thanks for positive thoughts and prayers." latham retired from the u-s house last year. iowa national guard soldiers are back in iowa after a short deployment to missouri... the soldiers left on friday... responding to severe flood that knocked out the water treatment plant in high ridge missouri. while there they purified thousands of gallons of water to supply the entire town. the soldiers returned to camp dodge about a half hour ago... we'll hear from them tonight at ten. the estimated jackpot is unable to keep up with powerball

i'm not really worried about that because i have faith in the american people, the american electorate and they are smart enough to analyze what people are saying
