the trial of a des moines murder suspect came to an abrupt end today... 26-year old joe lopez is charged with killing his girlfriend's one- year old daughter... the little girl suffered a skull fracture and broken ribs. this morning the prosecution called the girl's mother to the stand... 'were you still in a romantic relationship with mr. lopez? ' - 'it was on and off, um, he would force sexual intercourse with me.' -- nissa alvarez - mother of deceased toddler 'well, lets just talk about did you write him a love letter? -- nan horvat - assistant polk county attorney
mother of deceased toddler nissa alvarez' claim that lopez raped her forced the the judge to declare a mistrial. she made the statement in front of the jury... potentially influencing its decision... the general motion regard to every witness.... thats what happened here prosecutors declined to comment on the mistrial. lopez will remain in custody until a second trial tentatively scheduled for may second. family and friends are planning to hold a rally in their search for justice for a woman who was gunned down. 68-year old shirley carter shot to death in her home in lacona last june.
