suspect in custody for a ooting in roosevelt mall. the gun fire happened during a rormbbery. katherine creag is live with what we know. bu >> reporter: shoppers told us it's frightening enough to hear gun fire but then this happened in a crowded mall at the middle of the day. the person at the center of it, he is the shooting suspect and he's he.e inside this police station in custody. he'll be in court later today for an arraignment. this was an attempted robbery according to nassau police detectives insigned a luxury jewelry store. one single bullet was fired during an attempted robbery about 1:00 in the afternoon. many thought this was an active shooter situation. rkers hid in their stockrooms and brought shoppers in with them. all part of training they received from the police department in an active shooter scenario. we heard from some of the shoppers and workers who hid.

isashing sound in the middle of my purchase. >> we have done a umber of drills and have a very close relationship with the mall security. so they're well-prepared for events like this. >> reporter: and there was a mall worker, a 67-year-old man who was shot in the shoulder by a stray bullet fired by the suspect, according to police. he's in the hospital in serious but stable condition. something you mentioned earlier, an nypd official was apparently there at the mall during this entire scenario. apparently according to reports he's ahen nypind inspector. he happened to be there shopping and he helped take down the suspect. and as you might imagine, he's not calling himself a hero but he was there helping the security guards subdue the suspect. >> thank you. this morning we're hearing from the family of a second local airman killed n afghanistan. staf

bankruptcy fraud. they admitted to hiding assets and submitting phony loan applications. her husband is set to begin a 41-month sentence in march. teresa's lawyer id she's angst to get home to her family. one of the most exciting things for mar coming home is actually sleeping in her own bed. that's the latest from here. back to you. >> thanks so much. surveillance video is giving a good look at aman wanted for a subway assault in queens. this started a the the 71st avenue station in forest hills last saturday. that's where a 42-year-old man said a man bumped him from behind with an unknown object. it hap opened again as he boarded a train and two more times. the victim says he didn't realize until he got home that he had been stabbed four times.

the judge put it off until after the indictment. morgan was badly hurt in last year's crash and his friend was killed. an alleged hacker is behind bars after police say he tried to sell celebrity's private items such as sex tapes and unreleased movie script. the 23-year-old was in a manhattan court yesterday. police say he stole the social security numbers of the ce alebrities and athletes by accessing their e-mail accounts. they say he obtained some of the information after victims mistakenly gave him their passwords. he eould essentially tell them that they were -- that their e-mail account was hacked and he would convince them to send him their passwords. >> the judge ordered noles to be kept behind bars after prosecutors argued he is a flight risk.

you mentioned and he's expected to be in court a little later today for arraignment. what he was involved in, according to police, set off a wave of panic at roosevelt field mall. he was part of an attempted robbery, according to police. one single bullet was fired during that attempted robbery. investigators say at the tore know store, a jewelry store. many thought this was an active shooter situation. workers hit in their stockroom and brought shoppers in with them. what happened yesterday, shoppers told us sent so many people in a panic >> i was at the cashier and there was people running towards the back of the store. we didn't know what to do. >> at some point in time while exiting the store he was struggling with the store security. >> reporter: and there was a mall worker, a 67-year-old man

his lawyer was trying to get the vehicular homicide and assault by auto charges dropped. that motion was put off until next month. forgan was badly hurt in last year's crash. one of his friends was killed. we're learning of new legal developments involving robert durst. the former fugitive is agreeing to go to los angeles to face murder charges, where she's accused of killing his former publicist and friends. he was arrested in march of an interview for the hbo documentary "the jinx". kentucky is changing the way it prepares it marriage licenses. republican governor matt bevin issued an order that will no longer require the name of county clerks on marriage licenses protecting the religious beliefs of clerks who oppose same-sex marriages. this drew national attention early this year when kim davis refuseds to issue licenses and spent five days in jail.

the fog issue in the city isn't bad. but out in suburbia there is a problem. there's the gorgeous tree out there. going to get rained upon again over the next couple of days. but enjoying warm temperatures as we are. morning fog a problem. rain returns especially for the afternoon and the holiday record warm temperatures still on target for happening. and we take a look at that for tomorrow. the record high is 63 degrees occurring back in 1996. we're still forecasting a high of 72 degrees. if we break out into a little more sun we could go higher than that. it determines how quickly the low clouds break up in the morning. christmas day is record high is 64 set in 1982. last year at christmas was 62 degrees. we'll have back-to-back christmass in the 60s.

you were at zero, now it's a quarter are of a mile. and the fog conditions will improve through the morning. we're seeing upper 40s to around 50 in new jersey. 54 is the warm spot in the city and long branch as well. a lot of 40s in long island and the hudson valley. look at this area with the moisture. along with that is milder air and as the warm front approaches, we'll see the showers break out. notice early afternoon it starts to move in. nothing particularly heavy early on but it does pick up during the evening hours, between 7:00, 9:00, 10:00, a heavier push of the showers, even a remote possibility of a rumble or two of thunder. we catch a break tomorrow, a lot of clouds but you note thin spots. that will be the trend in the afternoon. if we get into the sunshine by 2:00 tomorrow afternoon we could get into the low to mid 70s for
