friday morning september 4th, last friday of the summer. i am ben simmoneau. kerry: i am kerry drew. frank and roseanne are out this morning. there is a chance of showers this afternoon but the holiday weekend looking for she. mike woods has details. ben: this happened and louis armstrong stadium, a drone comes down, a schoolteacher who was flying the drone is under arrest. kerry: a plane crash land at a soccer field in new jersey, two on board were hurt but there were no kids on the field at the time. we have details on that. dari: of the painted topless ladies in times square was arrested accused of offering an undercover cop lot more than that sexy snapshot. she and her handler are facing drug test prostitution charges.

we had a five day he wave but we're coming in shy of that. and actually we have to keep an eye on radar, may be hard to pick out because we have a lot of ground cover, ground clutter, false returns from the radar machine that this is for real. one isolated shower out there in your parts of westchester county into fairfield county popping up and these sorts of things can pop up from time to time when you have a cold front in the area and that is happening out there but others in that is dry around the tristate and temperatures not so bad, 77 central park, 74 in bridgeport and islip, this is about the same range we had yesterday but we have more cool air working its way from the northeast. you can see that northeast of the wind coming through. that is a backdoor cold front meaning a cold front that approaches from the north to the south, 6 to 12 miles an hour. that is all it will take to keep
a few showers here range you can see on radar and satellite on the border between westchester and fairfield county. elijah hour, more popping up as the day goes on with front in the air and there would be few of those happening. high pressure is taking over with cooler air to the north making a push back into the tristate but we'll make some progress here today. partly cloudy skies are leon, a quick shower pops up, a lot of sun in the afternoon, isolated showers could pop up so keep that in mind, most of us getting away without dealing with rain at all. tomorrow sunny skies, the coolest driest day, 85 sunday, 88 monday and there we have it again, 90 again tuesday of next week ended will begin mid like we had through the majority of this week still possible next week too. let's bring in ines rosales and

trains on or slow. ben: new york city school teacher is under arrest after a drone crashes into the sand at the u.s. open. kerry: isn't drone buzzed over the course before crashing into the seats. teresa priolo live this morning in flushing meadows, queens, with the details. >> reporter: we are learning new information about the teacher that was arrested for flying this drone. you see arthur ashe stadium, the most recognizable here, and then you have louis armstrong stadium which is in the shadow of arthur ashe stadium where this all occurred. let me take you back to that. the drone flying into the stadium, we are told the drone was spotted flying east and crashed into the southwest corner of the stadium. this happened late in the second set.
against monica, the drone was seen and heard flying above. and at the top of louis armstrong stadium into empty seats along the baseline. 40 feet above court level. this exciting, very distracting, players on the field heard it and were startled by it. let's look at commentary while the broadcast was going on, you see players talking. take a listen. somewhere. a bit of a distraction. >> both players heard it. we have a moment we are not entirely certain what it is, something that was left behind, a project or or drone like

hospitalized with a gunshot wound to the arm. atop this painted lady and her handler facing several charges after being arrested for trying to sell sex and drugs to an undercover police officer. kerry: the rest adding fuel to the debate over the so-called des nudas. >> reporter: these undercover nypd officers started chatting with this naked topless painless lady on seventh avenue and realized she was offering up a lot more than pictures for tips. one of the painted ladies from times square was arrested wednesday night, destiny romero is accused of selling drugs and offering to perform oral sex to undercover police officers. the 20-year-old introduce the copter her handler, jason perez, who hop promise to meet them at the lexington hotel. the couple sold the officers cocaine, molly bills and romero
agreed to perform oral sex. the two were arrested. romero was charged with three counts of prostitution and drug possession. 22-year-old perez is accused of promoting prostitution and criminal possession of a charges. the painted ladies had been a controversial topic of discussion in times square reminding many of the city police commissioner bill brennan suggested tearing up the plaza to stop the activity but bill deblasio created a special task force to figure out how to get the women out that they are not breaking the law. top business is allowed in new york. the mayor had this to say next month. >> you will see changes starting quite soon. >> reporter: this has been in place a few weeks but it is unclear exactly what it is doing to help the problem. south carolina businessman went before a judge yesterday after allegedly attacking one of these top list ladies and accusing her of the pocket.
live in times square, back to you. kerry: thanks so much. a coast guard plane crash lands in an new jersey soccer field leaving two people seriously injured. robert: was patrolling afternoon and then when the pilot reported engine trouble and had the the plane down in the fields next to a community pool. police said that was not his first choice. >> they were going to try to make it to the hudson river where from what i am told there were units standing by in case they landed in the river. they fell short. >> the guy did an incredible job. kept it airborne, cleared the tall trees and bathed its into the field over here which was the only place he could have possibly put it down. you know what we're dealing with here. leave the plane came down an hour before kids were scheduled to use the soccer field. this week to crewmembers were taken to hospital. they are expected to recover from their injuries. more troubles this morning for
rutgers university football program. five players have been suspended after being accused of violent crimes. kerry: one player was charged in two home invasions, two others were charged with assaulting a group of people in april. this comes as the scarlet knights creepier to open the season against norfolk state. at the same time if this was happening, the coach is being investigated for potentially violating n.c.a.a. rules by inquiring about a student's epidemics that is. some students on campus remain hopeful that bad press will not affect tomorrow's game. >> that is a concern about the season. of lee we will do okay. >> especially because some of the classes i take were at. kerry: we have a statement by julie herman that says the players have been suspended from the program indefinitely. will have no further comment as this is a pending legal matter. ben: tom brady, i guess cheaters do win because he beat the nfl in court.
kerry: a federal judge tossing out his suspension in the deflategate scandal. birdy will play next week in a season opener against the steelers. nfl commissioner roger goodell went too far with brady's punishment. the nfl has appealed the ruling. we will talk about the suspension was do it coming up in a few minutes. republican presidential candidate donald trump tweeting his support for brady. ben: he wrote congratulations to tom brady on another great victory. tom is my friend and a total winner. he has no he lives in new york, right? kerry: well, hey. ben: come on, he does but you have a fifth avenue address in new york city are not supposed to root for the team. in the meantime speaking the donald trump ps taking the pledge to not run as a third-party candidate. kerry: he turned to run as an independent if he did not get the gop nomination which would have made it impossible for
house. the donald announcing that would not happen moments aftery with republican national committee chairman in the city. >> i will be totally pledging my allegiance to the republican party and the conservative principles for which it stands. we will go out and we will fight hard and we will win. we will be in. most importantly we will make our country great again because that is what it is all about. kerry: trump is leading the pack over other republican candidates vying for the nomination. in iowa he and ben carson are in a dead heat. other political news this morning, joe biden is saying he is unsure if he will seek the presidency. ben: he told a crowd in atlantic it will depend on whether he and his family have the, quote, emotional energy to run.
he thinks he can do it but the question is his family is in an emotional state and he is not sure they have the energy to flee back that kind of run. it does take a tremendous toll not only on you but your family. kerry: they are discussing it. ben: his son's death, he passed away in may, joe biden said he would not make a third attempt to become commander in chief and as he is, quote, able to devote my whole heart and soul to the endeavour. unless he can do that he says it would not be appropriate. kerry: looks like he maybe no but you never know. ben: it is 7:15. the weekend is upon us. kerry: the last weekend of summer. how did it happen? ben: it always happens like this. in april. >> meteorologist: it is not really the last day of summer. it goes on the officials end of summer. kerry: we will keep it going.

very hazy. you conceal little bit of a slow move northbound, traffic backed up to the merge, george washington bridge the mess because of too earlier accidents, we will tell you about those delays. >> reporter: this is a traffic headache to the upper level of sleep after the toll plaza. it is getting better across the span. those accidents have been cleared away, if you head to the gw bridge lower-level tolls on the left-hand side of your screen traffic flowing through, lower level better choice but the upper level is packed to the upper deck. ben: to the tom brady story, the nfl vowing to appeal the ruling that overturned a four game suspension against tom brady. kerry: he can play next week in the season opener against the steelers. the cowboys are obviously having a lot of fun with the decision.
front cover of the new york post, there still your balls, tom. ben: duke castiglione joins us to talk about this. it is not as though the judge made a determination whether or not he actually cheated, just did the league have the authority to punish him the way it did. >> saying roger goodell stepped across, historic ruling really. so interesting from legal standpoint, journalistic standpoint, the ruling yesterday. attorney earl ward from emory, we stopped after a the ruling, shocked by this ruling. >> i am surprised by the ruling because typically an arbitrator's decision is given
tremendous difference and for federal judge to upset or overturn the decision is rare. is not unprecedented very rare. i am surprised. duke: you have been before him in federal court. that make it more surprising? >> he is a fair judge, in the middle, not a judge someone would say favors plaintiffs for the government or defendants, he is a straight down the middle the judge. frankly the opinion, 40 page opinion he wrote is that while recent and well written report. duke: what is the biggest take away you had? >> he concluded that the arbitration proceeded was fundamentally unfair, the proceedings were flawed. that is the biggest take away.
he goes four step analysis as to why it was unfair. one of the key points team makes is brady was never provided notice, he was never told that he would be subject to a suspension. there are two policies at play, the competitive integrity, competitive integrity policy as well as players policy, provides only five and that is what brady was provided with, competitive integrity policy was provided to the managers, head coach, chief executive and that policy provides for suspension. so brady had no notice that he suspension. duke: you think brady could lose on the appeal. >> i think they could win, not
withstanding the judge's decision. they could lose because again the difference that is paid, tom brady could lose. i think the court of appeals listening to this case could very well conclude that roger goodell had the authority to serve as arbitrators and roger goodell's decision should be paid. duke: i didn't know this until i spoke to you yesterday. roger goodell is a 0-5, last federal court appeals case. after talking to you that is tough to do especially when you have all the council. >> he has been smacked down five times and this is again a situation where arbitrators' decisions are typically given great difference. the nfl players association has

reflect true cases and we don't have to be too concerned about over diagnosis that the what in to make the diagnosis, there is no formal test. it is that constellation of finding parents, teachers, pediatricians, to screen for this condition because it is becoming more common, rising 5% every year. ben: kids are restless by nature. asking a kid to sit still two hours. >> my experience with my own kids at school, in school they are required to sit for much longer periods of time than they used to be. is that causing the diagnosis or we are picking it up more because of these controlled situations? not entirely clear but it is important to your concern to talk your pediatrician and get a full evaluation by a psychologist because there are treatments available, medication and on medication. ben: do we risk over medicating kids? >> there is an issue with that,

on what happened. >> good morning, everyone. we're in a bit of a those city area with the trains and planes, so just bear with us while we tell you all about what happened here last night. we're talking about a 26-year-old new york city teacher with the academy of innovative technology. let me first take you back to the match, and we'll show you the video of this drone flying in. it happened at the louis armstrong stadium, which is right behind me. of course, you're familiar with arthur ashe, it's off to the side of arthur ashe stadium. this occurred at 8:30, and from what we are told the drone started flying east, and it crashed into the southwest corner of the stadium late in the match. the drone was seen and heard first over the grandstands, and then it crashed into the stadium, the louis armstrong stadium. the players, as you might imagine, were incredibly distracted and also very much concerned.
it only happened about 40 feet above court level, so quite close to these players. take a listen to the broadcast when they noticed that the drone was coming through as well as the players reacting. >> seem as if that fell from somewhere. a bit of a distraction for pinetta. >> oh, i want the security -- >> we have it. we have a moment here where we're not entirely certain as to what it is that landed in the stands, whether it fell from above, whether it's something that's been left behind. a projectile or a drone-like device, just no real understanding of -- >> the player ares were attempting to keep playing, she thought it might be a bomb. she wasn't sure. of course, it did not turn out to be that. it is a drone and according to police they have arrested a 26-year-old teacher with the academy of innovative technology for flying this drone. according to his facebook as
well as linked inn profile, he is an avid photographer. we don't know if he, in fact, teaches after the my at a city school, but we do know he is a department of education employee with academy of innovative technology. one thing we do want to mention, ben and carrie, drones are not allowed at the tennis center, not at all. this is not something you can bring in so, please, keep them at home, and hopefully we'll learn more information about what this teacher was intending to do with that drone before it crashed. that's the latest from flushing many meadows. >> thank you so much. a topless painted lady and her handler are arrested for trying to sell sex and drugs to an undercover cop. >> the arrests are are adding fuel to the debate over the so-called desnudas in times square. liz dahlem has details. >> good morning, wen and carrie. what happened was these nypd undercover officers started chatting with this topless woman. they quickly realized she was
offering up a whole lot more than just pictures for tips. one of the painted ladies from times square was arrested wednesday night. destiny romero is accused of selling drugs and offering to perform oral sex to undercover police officers. the 20-year-old introduced the cops to her handler, jason perez, who promised to meet them at the lexington hotel. there the couple sold the officers cocape, and pro-- cocaine, and proher rah agreed to perform oral sex. 22-year-old perez is accused of promoting prostitution and criminal possession of a controlled substance among other charges. the painted ladies have been a controversial topic of discussion in times square, reminding many of its once-seedy past. police commissioner bratton suggested tearing up the plaza, but mayor de blasio created a

the democratic nominee. if trump had won a third party candidacy, he almost certainly would help the democrat get elected. we saw this with ross perot against george h.w. bush and bill clinton back in 1992. so taking that off the table is a big win for the republicans. >> it's not really legally binding though, is it, chris? is there anything to stop donald trump from coming out and saying, well, you know, i changed my mind, i'm going to run as a third party candidate? >> no, you're exactly right. he could say, you know, i meant it in general, but when i saw who that specific nominee is and what a loser he is, i'm going to run a third party candidacy. there'd been a lot of doubt as to whether trump was really going to run as a third party candidate anyway. it's very expensive, it's become much harder than back when perot in '92, so it was probably a long shot. but to the degree that this makes it even less likely,
that's something republicans breathed a little easier this morning. >> and, chris, we also wanted to ask you about vice president joe biden, will he or won't he enter the race? yesterday he spoke about it for the first time saying, quote, the honest to god answer is i just don't know. what's your gut feeling on this? >> well, i have to tell you that watching, this was a speech that he made on the road, and he was very open and very heart felt about it. the thing that came through in that speech, if you see a clip of it, is how kind of tormented and torn up he still is. and understandably so about the tragic death of his son beau. do. i don't know that he knows what he's going to do. clearly, he's got some healing still tad before he's going -- to do before he's going to make his mind up. on fox news sunday this week we're going to be talking to dick cheney and his daughter liz, they've written a week very critical of president obama's foreign policy, especially the deal with iran.
and hen -- and i know there's been a fight between your current and your previous police commissioner, ray kelly and bill bratton, about policing and murder rates and the targeting of police. it's a problem all over the country. we're going to have the police chiefs of philadelphia and milwaukee on to talk about the problems, the dangers that our men in blue face when they go out into very dangerous situations. >> chris, it's the unofficial end of summer. is the clock ticking for joe biden though? does he have to make a decision soon? >> uni, i don't know. -- you know, i don't know. go. look, the only way i think he beats hillary clinton -- i don't think he's capable of beating her if she's a strong candidate. he's not going to raise as much money, he's not going to have as big an organization to. she's got the potential to be the first woman president, that's very powerful. i think his best chance is if her candidacy basically falls apart because of this continuing scandal over the e-mails. in that sense he can wait a

breast cancer on the rise for men. >> good morning, dr. raj. >> good morning, we don't hear a lot about male breast cancer and there is increase for the men under doing double mastectomies and it is an area of controversy for the women and more and more women are under going double mastectomies. sometimes the decision is made out of fear, but the science is not backing it up. if you have a predisposition with the genes, it may make sense, but some are getting even without having that. now looking at the men, it is about inyees for 3% to a little over 5%. so not huge numbers. but it is a significant increase. experts are really warning the patients and doctors to make a thoughtful decision about this type of surgery, it is a dramatic surgery and removing
