5:00 a.m., monday, may 9 we're working on several new and breaking news stories. in fact this is just in, police capture a man who called 911 to tell operators he just murdered his girlfriend. we're live with the details. a prison inmate who has been on the are you positive for nearly a week was spotted overnight. we'll tell you where. penn state has new information how it settled claims involving sandusky going back four decades. let's go over to david murphy and tell you about the weather and karen rogers has the roads. >> reporter: sunday was gorgeous, and today will start out with sunshine even though we're cool. there's a frontal boundary that's close enough to us, where clouds will have a tendency to get thicker as the day goes on. 52 degrees, philadelphia current temperature, 44 in allentown. 45 in reading, 43 in lancaster.

county last night. he went missing when guards did a count. he is serving time for drug burglary and spent time for killing a baby. we'll have more in the next half-hour of "action news." this is breaking, the man who may have murdered a woman in her home in kensington is now in police custody after leading police on a chase. katherine scott is live in the kensington section of the city. on the 3200 block of roarer street with more details. good morning, katherine. >> reporter: good morning, tam we have an update after a brief chase with police, the suspect is in custody taken to had had n university hospital to be checked out. the crime scene unit is here, as well. this happened around 2:00 a.m., police say a 24-year-old man
called 911 early this morning and told the dispatcher he got into a fight with his live-in girlfriend. the fight turned physical and he said he choked her. he said he was suicidal and the search continued from there. four children were inside the home, they were not injured. he did call 911 at least a couple of times from what we understand. in the last 15 minutes police caught up with him. we were tracking the video, we got an exact location on him. one of our units spotted him, we had a car pursuit successful ending where the male was apprehended and no injuries and no auto accidents. >> reporter: there were no injuries to the officers involved in this. this investigation is underway. the crime scene unit homicide detectives remain on the scene.
the suspect is in custody. he was taken to hahnemann. a four story home in atlantic city went up in flames along the 100 block of north florida avenue at 1:00 a.m. fire crews say it started on the 4th floor. the home was unoccupied at the time. it was divided up for multifamily use. we have information about a chain-reaction crash in delaware. i495 is open after an 8 car crash shut it down. one got out of the vehicle to check the damage and hit by another car and became trapped between two cars. it is unclear what caused so many vehicles to crash. new here on "action news," a penn state university said its legal settlements with jerry sandusky's accusers go back to
1971. that's 40 years. it's the first time the school said how far back in time the settlements reach. the university paid out $90 million. this comes after the penn state president said allegations that joe paterno new the abuses since 1976 are unsubstantiated. the montgomery county district attorney is expected to release more information about the deadly fire in norristown. two adults and a child were killed in the fire. 6 others were injured including a child who was taken to the children's hospital of philadelphia. at last check they were each listed in critical condition. happening today, new jersey lawmakers will vote on a work leave bill. it will require employers to offer one hour sick day for ho hours of work. business groups say the bill
