good afternoon we begin with breaking news in the trial of david creato jr. the south jersey father accused of killing his own son. the judge dismissed the jury after failing to reach a verdict. for more on what this means for the case we go live to katherine scott live at the courthouse in camden. >> reporter: that is right rick and sara, the jury said they could not reach a verdict so this morning the judge declared a mistrial in this case and dismissed the jurors, there was an indication this could happen. yesterday the day wrapped up the jury saying they were having trouble reachling a verdict and the judge encouraging them to go back. and today they influenced they could not do it >> in light of the -- that the jury is not in a position to be

able to reach consent in this matter. accordingly at this point in time i'm going to dismiss you and thank you for your services. so the judge thanked the jurors for their service and left the courthouse without any comment. around 11:30, prosecutors and little brendon creato's mother left the courthouse without comment either. since closing arguments, the jury spent a lot of time together revisiting evidence and some evidence they heard multiple times. including the video of him hearing his son was dead. he maintained his innocence but prosecutors say he killed his son because he got in the way of his then girlfriend. there was no video or dna evidence linking creato to the

case. through the trial they felt they established motive and opportunity the defense team said that prosecutors did not meet their burden of proof. creato's attorney is decision pointed with the outcome and his family walked out with the attorney but they deferred to him comment. >> dj wanted to go home to his family. and it's heart breaking for all of them. >> so at this point creato remains in custody and his attorney says he will file a motion to reduce hi bail so hopefully he can walk free but the judge will revisit this matter on july 5th, the thought is that they will have a retrial in this case but that is not determined as of yet. katherine scott, channel 6 "action news." >> developing now this noon the upper darby police department is asking to you call 911 if you

strange night. it became with a call about a stolen car and ended with a 7-year-old girl fighting for her life. >> beautiful, smart, intelligent, active played with all the kids on the block. >> i'm in shock and disbelief. >> rihanna says she was jolted out of bed with terrifying screams that seemed to be coming from her neighbor's home and walked out of her home into the night and a streetlight illuminated the scene below. >> the child was on the grown and the cop was trying to resuscitate her and they brought her to the hospital. >> they got a call on the 5900 block of north american street when an officer arrived she told him that her 18-year-old car sped off with her car. they went down into the basement to get her i.d. and made a horrifying discovery. she ran out with her 7-year-old

daughter in her armed, she was frantic and stated that the child had a plastic bag over its head. >> they performed cpr as the hysterical mother paced back and form. >> she was walking around like oh my god. >> she didn't know what to do. the officer called for backup and continued cpr in the back of a police cruiser as they rushed to einstein hospital. and the search for the brother intensified. >> the vehicle reported stolen was recovered. >> reporter: and the search continues for the girl's brother. there is no update since 1:00 this morning on where he might be. reporting live in logan, channel 6 "action news." >> thank you. testimony is underway in the trial of a bucks county man charged with sexually assaulting six girls from the same family.

attorne attorneys completed their opening statement. that the defendant lee kaplan fathered to children with a 14-year-old girl. that the parents gifted them to kaplan in exchange for his financial help. and jim kenney made a stop in new england. as part of non-stop iceland flights to iceland. and the plane ran into mechanical problems and landed in boston. the diverted flight is expected to leave boston this afternoon and reach iceland at 3:30 in the morning. kenney is excited to continue his trip and enjoy the best in-flight meal he ever had. turning to accuweather we are finally seeing some sun after a string of gloomy days but still the chance of a shower or storm and some storms. karen rogers is in for david

murphy with a first check of the accuweather forecast. >> that is right. this is big news that we can actually see some blue sky and sunshine mixing in with the clouds, it feels like the first time in a while. seven of the last 10 days are cloudy and gloomy. we started with drizzle and low clouds and fog and the clouds are starting to break a bit and more sunshine on the way this afternoon out to the west as you look near pittsburgh that is the front that will tricker a few more showers and thunderstorms. ahead of it, we move nicely ahead with the temperatures, 69 in bethlehem and 67 in malvern and 69 in media, but 71 in long wood and 73 in coatesville and 70 in center city. in new jersey looking like 71 right now in bounds mills and 70 in cinnaminson and upper 60s in sewell andville mill. and 75 coming in right now smyrna. look going with the wind

switching from the south and lowing the temperatures to bump up and the clouds to break apart. and over the next 12 hours we see the temperatures bump up to 80 and 2:00, 76 and at 4:00, 80. and you see throughout the afternoon and evening clouds mixed with sun and the chance for spotty showers or thunderstorms and we see them trying to brew as we look to the west on stormtracker 6 live double scan. but we are under a marginal risk for anyone storm becoming strong. we'll talk about that and further improvement in the accuweather forecast in a few minutes. >> thank you karen. in washington, president trump is getting trod announce his decision on the landmark paris climate agreement. he said his official decision will be reveald this week. according to abc news trump is leaning towards dropping out of the major international deal. that includes countries agreeing

a deadly explosion killed 90 people today in one of the most secure sections of afghanistan's capital. the blast went off near the german and british embassies. >> reporter: the deadliest attack in the afghan capital in years, during the muslim wholly month of ramadan and during the heart of rush hour traffic. here is the moment the massive car bomb explodes captured by the office camera striking in one of the most secure fortified areas of kabul just a mile from the u.s. embassy. the death toll more than 80 people and nearly 400 others wounded. there are people inside of this car he says, they are still

hunters. a marine is under avest after allegedly storming orlando airport with a fake gun. and they surrounded pettigrew if the airport last night. police say he was in mental distress pointing what appeared to be a real gun at police and himself. after a standoff police got pettigrew to peacefully surrender. is he held for a mental evaluation. people on social media want this father prosecuted for carrying a toddler on a motorcycle with no helmet. a concerned citizen snapped a picture of the man and child and gave it to police. and they identified the father as anthony welsh. and he may face charges of child endangerment for having a child younger than 5 on the

the government is accusing united airlines of flying an unsafe plane 23 times that the carrier failed to inspect a repair job after putting it back into service. they repaired a fuel pump pressure switch in 2013 and used on 23 flights before final inspection was performed many they are seeking a $40,000 fine against the airline that says they are working with the faa to review the matter. a new home security system comes with a high tech camera to keep watch of your home.

more than 250 athletes get to participate in the track meet at horsham high school. beginning with a pep rally with a competition of a ring toss and races and soccer drills. each athlete has a trained buddy that assisted and cheers them on throughout the day and due to the popularity of last year's meet. students and teachers have excitedly volunteered. what a great cause. >> and they may see sunshine. >> how about that. we are all winners. we do. lets take a look right now at stormtracker 6 live double scan we are dry that is not the way we startd this morning. it was drizzly and damp and foggy and the action cam was doing a little driving and why not. a beautiful day and clouds and

sun like this morning. we start to see the sun breaking out this morning. and the temperature is 70 degrees, better than yesterday our high was 62 and that is the dew point and the pressure is falling and the winds are southeasterly and the southerly component to the wind bringing in the dry air mass and breaking up the clouds a bit. and the ocean temperature is 61. lets look at these numbers, 70 in philadelphia and 71 in wilmington and 74 already in dover, 73 in lancaster and 71 in trenton after a few days in the low 60s. we'll take these numbers, satellite 6 along with action radar you see that we have a good amount of clouds and morning showers that are out of there and breaking up and a front out to the west that squeezes through and triggers a spotty shower. future tracker 6 showing it at 3:00, may see this and the reason we warn you it may produce hail. and we are watching more hail

declared. he was found dead in object of of 2015. nora muchanic is live outside of the courthouse in camden with the latest. >> reporter: rick, the jury convened for an hour this morning but soon came back to tell the judge they were unable to come to a verdict in the guilt of david d.j. creato on murder and child endangerment charges and the judge declared a mistrial. >> it appears in light of yesterday afternoon that the jury is not in a position to be able to reach consensus in the matter. accordingly at this point in time, i'm going to dismiss you and thank you for your services. >> now the jury was un able to decide if david creato was guilty or innocent and the judge declared mistrial. christine shaw and members of david
