right now on wral nows. the man that called 911 to say he shot at someone outside of his home is now indicted for murder. what the victim's family has to a very disturbing story out of raleigh tonight as 219-year- olds are a accused of beating and drowning a dog. one local community is coming together on support officers in the area. adam has a live report on how you can adopt a cop. a raleigh homeowner accused of killing a man was indicted for murder. hello, thank you for joining us.

for the shooting of thomas. candace sweat is joining us from the courthouse, candace? >> reporter: i spoke with the attorney for the family just a couple hours ago. he says thomas's mother cried tears of joy today when she found out the news. of course we know an indictment is not a conviction and both sides still do have a long road ahead. >> reporter: they say copley fired a shotgun through the garage. the shot killed a 20-year-old. two wokes later he is intighted on a period charge. the attorney for thomas's family spoke with us over the phone notoday was a very -- a very good day. it is bittersweet. -- thomas'family spoke with us over the phone.

a bittersweet day. >> reporter: after the shooting copley said he was protecting his family and he believed people outside had firearms. there has been no evidence showing that thomas was armed or on his property. with an impending trial he says his family is prepared for a long process if necessary. >> the family not be satisfied until a jury of mr. copley's peers finds him guilty of murder. >> reporter: his attorney did indictment but refer to a statement he released previously that reads in part, we have seen too many wrongful convictions for anyone or organization to jump to conclusions on the bases of someone being charged. we urge restraint and folks not rush to judgment. >> reporter: of course, as for how long this process could take, of course we can expect ongoing discovery between the state and the defense. he says he probably does not expect to see significant

next couple of months. of course, we will keep an eye on it here and bring you updates as they bottom available. >> we are live in raleigh. thank you. a man told the deputies he shot a teenager who broke into his home. it happened at union county. he woke up to noises and saw burglars jumping out of a window. two people came back for something they left behind. that is when he confronted and shot waters. the investigators is have not filed the charges in the case against the homeowner or the other teen accused of tr break into the home. we are following breaking news tonight. crews were called out around 6:00 p.m. a few hours later they were still you putting out the hot spots. the house was badly damaged. no reports of injuries. a 6-year-old was injured today. a teen was pulling out of her driveway when she was struck by a pick up truck. she was flown to the hospital. her name and condition have not

hearing. investigators said little could be done to stop a gator attack in disneyworld. the who-year-old did mothing to provoke it. the gator grabbed the boy while he was building sand castles on the shore. his father was right there and tried to pry the animal's mouth open. a pan told the staff about gators near the shore 45 minutes before the attack. disney add more security measures. two raleigh teenagers are charged after the police found a drowned dog in an apartment complex swimming pool. they are each charged with 1 felony count of animal cruelty. peterson was released after posting bond. one remains if in jail tonight. the animal was found at the complex on friday morning. the dog was then beaten and drowned in a pool. the police k-9 is said to receive a bullet and stab proof protective vest.

relatives of a man accused of driving drunk and killing 3 people say they are praying for the victims. >> show appeared in court to face a judge on 3 counts of aggravated felony death motor vehicle and dwi. his father and other family members sat in the courtroom choking back tears. montez was drunk and speeding killing 3 passengers including his cousin and injuring 3 others. >> we got to make sure all of

i know every family is crying out. >> montez is in jail on $750,000 bond. a man pled guilty to leaving the scene of a deadly crash on i-40. he hit and killed 2 men who were trying to help a truck driver that got -- got stuck on a snowy road in february of 2014. his lawyer says he left because he had been drinking and he was scared. the victim's families forgave him in court. he set a people. a roller coaster got stuck today in pennsylvania. the second time something like this has happened in just a week. today's incident involved the side winder, a steel roller coaster. according to park employees the right just stopped. fortunately it happened at a point where guests can get off safely. it took 35 minutes to get all 27 passengers down to to the ground. the side winder was closed for the rest of the day. an amazing river rescue in cocoa beach, florida. boaters returning to the dock

power line and capsized. everyone fell into the water including a 2-year-old. passers by rescued the passengers but no one could find the little girl. her mother, tammy, says they could hear her crying. it was not until the police officers jumped into the water that they found her in a life jacket in a pocket of air under the boat. >> we heard kennedy crying and we could not find her and i jumped in the water and we tried to search and we could not tell where the coming from. we kept searching and searching and got the phone to work under water. called 911 and they came out and we all kept looking and looking and we kept hearing her and i cried to hear and they thought they heard her and she was under the boat in an air pocket. they got her. >> oh my gosh >> thank you for saving my baby. i can not imagine. i just can't million. [crying] >> all passengers went to the hospital for evaluation.

wral weather. the most experienced team of meteorologist in north carolina. students headed back to school in miami despite concerns of the zika virus. they issued a statement saying there is no evidence that zika is dangerous for kids. they are often unlikely to show symptoms. still, they are making robo calls to raise awareness and offers out repellant uniforms.

cool spell. the front that came by here last night brought several weather and brought it from the east. this is video of tornado damage outside of boston. winds reaching 100 miles an hour. crews were folk used on clearing roads giving residents safe access to their homes. the ef-1 twister stretched half a mile long. no we have a newly formed tropical storm. let's take a look at the tropics. starting with the broadview. top winds at 30 miles an hour. tropical depression. the hurricane center says it now has a 40% chance of becoming a storm within the next 48 hours. 60% chance over the next 5 days. it is moving to the west. we will track the movements coming up in a moment.

gaston. now, when i put the graphic together it was a tropical depression. let's look at the stats. top winds at 40 miles an hour. earlier today when it was a depression it was moving to the west. the forward motion ended up being northwesterly and it is well away from north carolina now, rapidly intensify by thursday. top winds 90 miles an hour. when we see storms take this track. this far out in the atlantic. unlikely that it will make its way to north carolina. at this point we are not worried about gaston. worried not worried but aware of the next tropical storm. the one that i showed you moving to the islands. these are the forecast models in the coming days. the next 7 days it could make
