developing this morning.. a jewelry store employee is fighting for his life... after trying to stop a robbery. a thief made off with nearly 25-thousand dollars worth of jewelry from a store at the brandon town center mall. fox-13's shayla reaves is

((jen thanks, shayla. we begin with a developing story out of polk county.. the sheriff's office is investigating an officer-involved shooting. they say a man opened fire... deputies and officers fired back. and now the gunman is in the hospital. this started as a traffic stop. a drug task force -- including a polk deputy and 3 officers from other local police departments... pulled over 32-year-old francis perry. perry was pulled over on active warrant. officials also believed perry had a large amount of drugs in the car. officials say as they approached his car... perry shot at them. officers then returned fire... hitting perry several times. judd says officers immediately began c-p-r and called for an ambulance. perry is in the hospital right now. none of the deputies are hurt... something sheriff judd is

francis perry has an extensive criminal history... including attempted second degree murder, fleeing to elude, impersonating a law enforcement officer, and possession of meth. he'd just been released from prison in march. the state attorney's office is investigating. we're expecting to learn more details later today... including what investigators found inside the car. the department of justice has decided to drop its fight over the release of 9-1-1 calls following the deadly nightclub shooting orlando. before this... prosecutors were working to keep in the matter in ?federal court. even though a judge had ruled it was a matter for the state of florida to decide. right now... about a dozen media outlets are suing to have those calls released. orlando police have released about 9 calls so far... but none of them are from people ?inside the club at the time of the attack. hundreds of calls were

detectives just charged a polk county man with some very unsettling crimes... they say james ballone molested 2, two-year-old boys... recorded the acts and showed it to other children.. investigators also say he showed adult porn to 2 six-year-old girls. detectives are concerned that there may be more victims. ballone was already in jail after being arrested a few weeks ago for possession of child pornography. a st. pete man says 7 phone started a fire that torched his beloved jeep. there's been a nation-wide recall on those devices... after dozens caught fire. the last thing anyone thinks is a device like this could do so much damage. this is a real problem for samsung and note owners... that's why many are turning them in. unfortunately for this guy in st pete ... he didn't know about the recall -- until now.

ticking time bomb... he'd only had it 4 days. insurance will pay for the car... but likely he's out a lot of the money that he put into all the modifications. for now... they're getting help from friends-- but this certainly puts them in a bind. city officials have delayed aerial spraying for mosquitoes that carry the zika virus in miami... after many people complained about its toxicity. this man accuses governor rick scott of quote "poisoning us." he's part of a crowd of protestors who poured into miami beach city hall yesterday. they believe pesticides used to kill mosquitoes aren't safe for humans... even though the

protestors want to shut down aerial spraying. state health officials say they have little choice-- because miami beach is one of two hot zones in florida where the zika virus is being transmitted. and florida certainly can't look to the federal government for help in the zika fight anytime soon... for the third time... congress failed to pass a spending plan that would have provided money for prevention of the mosquito-borne illness that causes severe birth defects. when it comes to explaining ?why the bill failed... republicans and democrats are pointing the finger at each other. meantime, zika is spreading in florida and the congressional stalemate is frustrating both floridians and lawmakers. so much so... that one of them-- republican david jolly of pinellas county... took a jar of mosquito larvae onto the house floor yesterday... to make a point: floridians -- especially unborn babies -- are facing a ?real health threat everyday -- and congress is doing nothing about it... because of partisanship.

swim advisories at four beaches in pinellas county... it includes honeymoon island... sand key county park... indian rocks county access and redington shores county access. the advisories were issued last week... after hurricane hermine. during routine sampling testers found bacteria... which is an indication of fecal pollution. in pasco county... advisories remain in effect for 2 beaches. both robert j strickland beach and anclote river park beach tested positive for the bacteria. the water samples were taken on tuesday. w know when they re-test those beaches. now we all know how great our viewers our... and now we have the study to prove it. the tampa bay area was just named the third most charitable city in the entire country. the study was done by charity navigator... they looked at 30 metropolitan areas across the u-s. and number 3 is a huge improvement for us... just last year-- we ranked 27th! the report

charities put more revenue toward programs and less toward administrative and fundraising. we also tied for first when it comes to accountability and transparency. houston took first place... the same as last year. others in the top 5... st. louis, dallas, and san diego. and speaking of charity..... a non-profit organization has donated bullet and stab protective vests to three of tampa police department's k9's. "vested interest in k9s" made the donation withthe help of several people and other organizations. xavier, and jagger will receive the vests within 8 to 10 weeks. vice president joe biden declared his goal to cure cancer in a moonshot initiative earlier this year... and now we're actually seeing some progress.the new report that outlines the goals for this massive undertaking. someone to be inside a self- driving car while testing it on public roads. right now... a researcher has to be inside the car. another part of the bill would let "platoons" of semis travel closely together at coordinated sppeds. supporters say the measures keep michigan in competition with other states. the bills are on track for final approval by the end of the year. in other car news... it's a victory for uber. a federal appeals court ruled drivers for the company will have to resolve their claims ?individually... not through a class action lawsuit. the judge says most of the nearly 400-thousand drivers now suing the company.... "willingly" signed an arbitration clause. meaning that any claims against the company need to be filed as individuals. a year after millions of gallons of toxic waste spilled into rivers in colorado, new mexico and utah... the

the worker chased the thief all the way to the parking lot and hopped on the hood of a getaway car. he couldn't do enough though. the thief still took off--- throwing the worker from the hood of that chevy camaro. the worker was not only thrown, but run over too! he's in the hospital in critical condition.mirage diamonds remained closed wednesday. right now-- deputies are focused on finding the thief he's believed to be between 25 and 30 years old. been described as a two-door newer model chevy camaro last seen heading north on i-75. if you have any information contact the hillsborough county sheriff's office.

5:??. let's get you up to the minute on today's top stories: crime stoppers of tampa bay is offering a three- thousand dollar reward for information leading to the arrest of an armed robber who held up a hotel. it happened at the hampton inn on waters avenue monday night. depu pointed a gun at a clerk... then took money from the register and the clerk's wallet. ((walter and a warning for teco customes... tampa electric says scammers have been calling customers... trying to get their money. at least tampa man ended up losing hundreds of dollars. a caller... whose number came up as teco on caller i-d... told him he owed about 15-hundred-dollars. and if he didn't pay... they would cut the power. teco says between 10 to 15 customers are

((walter flood damage in pasco county could make hermine one of the county's most expensive storms ever.. officials announced at least 89 million dollars in damage to properties. now they say they want to buy people out of their homes that continually flood... to prevent damage like that again. they'd like to buy and bulldoze homes near the anclote river and turn the area into be weeks before the county knows if it will get federal funds for recovery. developing this morning... don't shoot at us-- and we won't shoot at you. that's the warning sheriff grady judd has for criminals in polk county. it comes after a man was shot by officers several times during a traffic stop. high tide, heavy rain and strong wind did a number on our beaches last week.. and it's making it difficult for baby sea turtles. this is the end of sea turtle nesting season. they have until october 31st, but hermine washed away many stakes that lay out where nests are. on anna maria island 80 nests are still visible, but they believe

buried. that doesn't mean every nest is destroyed... the turtles could still hatch very soon. the sea turtle watch will have volunteers checking the beaches until mid november. just because the season ends in october doesn't mean there were a few late nests laid. the days of swing sets and monkey bars are fading away... there's a new era of playground equipment in tampa.. it combines technology and aerobic exercise.. the "neos 3-60" was installed yesterday at perry harvey senior park off north orange street in downtown tampa.. like a video game -- kids choose from eight activities.. at the sound of music, they run around pressing flashing buttons..trying to get the most points before their time is up.. unlike an x-box or i-pad... the goal of this game is to get them on their feet. friends of tampa recreation helped fund the playground. they added a similar game
