man charged in her murder. >> reporter: cole walked out of the police department about an hour-and-a-half ago. escorted by police and as he was walked out. only said one thing. >> did you kill mrs. jones? >> no. >> that's all he said as he hid his face from cameras and loaded in a police cruiser. detectives say that cole killed 5 6-year-old amanda jones, a mother well lined where she operated an informal daycare and found murdered on tuesday morning. police say they developed cole as a suspect early on in their investigation based on evidence and interviews. >> at this point we believe this person in custody is the only suspect and the only one charged in this case. >> now, the relationship between jones and cole remains unclear. we do know that a civil disagreement between the two ended up in court in a prince george's court back in 2013 but

what that was about and what role it may have played in this alleged murder is unclear. now, all police will say is that jones suffered trauma to her body and still waiting on autopsy results for details on how she was killed. breaking tonight, dc police officers on the scene of a shooting in the 1900 block of q street southeast. police say they found the victim, a man unconscious and they rushed him to the hospital and we do not know his name yet or any information about a suspect. transit police say the same man involved in this brutal attack heat t eastern market metro is out at again. the teen is in a relief program and waiting to be sentenced but he got arrested again. >> and this time he accused of assaulting a transit police officer. allison barber is in china town with the story. that's new tonight. >> reporter: metro trains

arrested elijah smith last night, it is the third time he has been arrested in an assault related to metro. he is 19 years old. >> thousands passed through this part of china town every day. most of them never stop. but yesterday transit police say two officers were arresting someone on this street when this man, elija smith stopped. according to charging documents, smith walked up to one of the officers and said you will not disrespect me before my god. and then he started talking to hae person police had in ndcuffs. the one officer who was in plain clothes reportedly told smith to leave. that's when they said smith yelled next time i see you i will break your blank face. as he walked away the officer said he tried to stop smith and grabbed his jacket but smith turned and punched the officer. police say the other officer stepped in but smith kept fighting them. in the report the officer said they hit smith in the face, stomach and back to try and

stop him. elijah smith is not unfamiliar with the metro police. he was arrested in july after caught on surveillance repeatedly punching a 69-year- old man at the east market metro. >> this young man shoved me and told me to get blank out of the way. >> when that happened he was already on probation after pleading guilty to his involvement in an attack on a local actor. smith and four others assaulted and robbed the man steps away from the silver spring metro. >> smith is said to appear before a judge for sentencing in that market case. in that incident, he pled guilty to simple assault back in september. reporting in china town, i'm allison barber, wusa9. after yesterday's altercation a paramedic came to the scene and check both of the of the officers and smith for injuries. transit police say around that time smith told the officers that he was drinking and had taken a number of pills. police in montgomery county

are investigating the death of a pedestrian in bethesda. we don't know a lot about the victim but our partners at the washington post are reporting that it is a woman. i'm told that woman was walking with she was hit by a vehicle in the 5500 block of river road at 7:00. southbound river road was shut down at springdale drive while investigators were on the scene. the person that hit the woman did stay on the scene. no word on whether charges will be filed. new information on the murder of a maryland woman that crashed her car after she got shot. police now say that the killer shot marquita willms in the head while she was driving and he was in the front passenger seated. it happened on october 3rd in district heights. the car crashed into an parm building. the shooter climbed out and ran. they found the murder weapon on the floor of the car. eyewnesses helped to track down the suspect joseph poddy,

he was taken into cuffed. the custody in. >> no word on the murder. the accused murder took to the stand. the son was diagnosed with schizophrenia and by polar and the medication he took the mother said that he was so disoriented he wouldn't take it. he is on the trial of a music teacher and a transportation planner and real estate agent. jurors saw security video from a neighbor of ladoto that saw a red ford escort. at her home the day the murder happened in. >> vice president joe biden said he is not running for

president and that takes hillary clinton's biggest challenger out of the race but she will face controversial questions on what she will handle as secretary of state. i believe we are out of time for a winning campaign for the nomination. >> senior political editor john dickerson says vice president joe biden's decision not to run for president is a major boost to hillary clinton's campaign. the biden campaign was the one thing they couldn't control. if he ran that would take them off of their game plan and now they don't have to switcheroo but biden will not beside lined. >> i will not be a candidate i won't be silent. >> and now it comes down to bernie sanders. >> we are talking about the real issue. >> but hillary clinton has a major obstacle, she testifies

thursday in front of the benghazi committee. they are talking about the attack in libya where christopher stevens was killed. >> can she weather a full day's of testimony where some republicans said is aiming to hurt her. if she can do that, she will be on stable ground after a shaky summer. >> the candidates that are left, their first test with voters is in about 100 days at the i -- iowa caucuses. >> and donald trump says he is glad that biden is not running. he says it is not biden but hillary clinton he looks forward to defeating in the race for president. and i think he did the smart thing because frankly i don't know that he would have won. he wouldn't have gotten the nomination. i don't think he probably would have. and frankly i really want to run against hillary clinton. i really do.

trump says that clinton did a "horrible job as a public servant. " he says she is not worthy of being president. representative paul ryan may have the unity he was looking for to become housespeaker. a few hours ago the hard line house freedom caucus is supporting ryan. one of the conditions he demanded. the support from the group was not a guarantee since they have repeatedly opposed leaders and pushed out john boehner. tonight's action clears the way for ryan to be selected as the next nominee on wednesday next week and formally confirmed in a floor vote the next day. wikileaks says it has posted documents from the personal email account of c.i.a. director john brannan. there was a security application containing personal information. wikileaks web site doesn't
