california's forest firefighters are state prison inmates. yes, you heard that right. that's because 4,000 low-level felons in the state's prison system are part of a program that allows them to earn wages doing manual labor outside. from clearing brush to starting fires. they live in concentration camps scattered throughout the state. california is the largest program of its kind. the inmates are supervised and crowsen based on good behavior as well as what they were convicted of. for instance those convicted of arson, for obvious reasons, are barred from the program. each day they work in the program, the inmates receive a two-day reduction in sentences. they're paid $1 an hour while on the line fighting fires. it's estimated that the program has saved the state of california up to $100 million a year according to the spokesperson for the california department of correction and rehabilitation, the agency that runs the program with cal fire and the inmates cut containment lines and get close to the flames which can reach 100 feet high on rugged terrain. he said it's life-or-death situations, it's dangerous work. joining the panel is glenn martin, president and founder of just leadership usa and joining me from toronto, canada, is philip goodman, assistant professor in the department of sociology at the university of toronto. i want to first come to you, glenn, because i believe you wrote a dissertation about this issue. i'm sorry, philip did. i will go to you first. tell me about the ethics of this first. you have people who are incarcerated. it's not like they have a lot of choices but giving them this choice, which is to do deadly work for an hour, the ethics of that, in your view? >> thanks for that question and thanks so much for the opportunity to be on the show. so i think you're right to highlight on the one hand prisoners are spending their incarcerated time inside the fire camps, those men and women for the most part would prefer to be in a fire camp as opposed to a traditional walled prison. on the other hand it's important to note that it's in light of the alternative and that really makes it complicated, right, to identify this as purely voluntary or not. ask questions for ways it is and is not coercive is precisely because they're choosing to be in a fire camp, in many cases from the men and women i had a chance to interview because the conditions are somewhat less austere and painful than in prisons. the food may be in many cases better but, again, they're choosing to do that dangerous, dirty, exhaustive work of

>> so, if that isn't enough, i mentioned earlier, there are any number of lead news stories coming out of the white house tonight because of their behavior. there's a lawsuit that's been filed now that says that president trump is in violation of the u.s. constitution. there is a prominent, bipartisan ethics and constitutional group of experts, including former ethics attorneys for george bush and barack obama. so as i said, bipartisan. the suit has been filed alongside, along with the watchdog group citizens for responsibility and ethics in washington, better known as c.r.e.w. and this lawsuit is basically about my favorite word, emoluments. so, there's an emoluments clause that president trump we're told is in violation of having to do with the various business holdings. we are told that he has about 500 -- his companies are linked to over 500 entities in at least 25 different countries and that he is, this lawsuit suggests, already in violation of the emoluments clause of the constitution. now, since i didn't go to law school, somebody explain that to me. >> i'll let you talk about emoluments since you can say it better than i can. emoluments. >> you said it quite well. well, there's a section in the constitution that says that no person holding an office of trust or profit under the united states shall receive any present, emolument, office or salary from any king, prince or foreign state. there's not a lot of case law on this, because every president going back to george washington has thought, okay, i need to divest myself of my assets so i can put it in a blind trust, put them in a blind trust so that i don't have any emoluments issues coming to me, but that's not what's happening here. so we're not sure exactly what the supreme court will say, but it's pretty clear that an emolument is any kind of gift that comes to you because of your office, and anytime someone comes to stay in a trump hotel, for instance, in washington, d.c., so that they can say to the president, i'm staying in your hotel, isn't that great, or i'm holding an event in your hotel so i can impress the president. that's going to cause a potential emoluments clause
