california is running out of money again. the state controller there sending a lower lawmakers saying if they don't act fast they will be broke by march. we followed this year after year. the thing that gets people upset is they get an iou on their tax returns. is that happening? >> reporter: apparently whoever did the math forgot to carry the 1. governor jerry brown and the state lawmakers thought they had enough money to last through the end of june. turns out california came up short, $2.6 billion short. so now california has to borrow another $860 million from a state account then delay payments to the university system as well as medi-cal, the understand for the poor. then the state controller says he doesn't believe right now at this point that the state will have to issue ious for tax refunds like they have done in the past. when you owe them money you pay payments and interest. when they owe you money you get what you get. the hope is california can pay all of this money back when they start getting tax revenues somet

the california voters passed what's known as proposition 8 back in 2008. now, that law outlawed same-sex marriage by amending the state's constitution to only recognize marriage as between a man and a woman. then in 2010 a u.s. district judge struck down that marriage ban, and the federal court of appeals, the ninth circuit federal court of appeals, just agreed with that rule anything a 2-1 decision. when you say the ninth circuit, you're talking about, basically, a panel of three judges. it's a 2-1 ruling. we're going to have a live report on this, but you can expect that those who backed prop 8 are either going to ask for a review by the entire ninth circuit, all the judges -- which you can do -- and/or appeal up to the u.s. supreme court. more on that shortly. >>> well, we are closely watching a developing story involving the efforts to free 19 americans blocked from leaving egypt. up next, we will speak with a man who came close to being one of those hostages, and find out why he says he wants to go back and challenge egyptian leaders. does that seem l

marines are dead tonight after two helicopters collided in mid air last night in california. it happened during a routine training exercise. they are trying to determine what caused it. our fox station there fox 10 from pheonix sent us this video of the crash site. you can see the wreckage on the ground. the choppers went down in a remote area outside of the training complex near an the arizona border. the helicopters were similar to the ones you see here and they were operating in the area known for its rugged terrain. >> our marines will go out there and use the training ranges out there. a lot of them are very similar to what the terrain will be right when they deploy to afghanistan. so they go out there and conduct training exercises so they have the familiarization before they deploy. >> officials have not released the names of the marines killed, but we know all but one of them had been stationed at camp pendleton in san diego. this is the latest deadly aircraft incident involving a marine base in over a year. what else do we know about the two choppers that collided? >
