joining me is legal analyst sunny hostin. first, a lot to talk about obviously as the story continues. what do you make of this vote of no confidence? what exactly does that do? ultimately it is the city manager who we will be hearing from perhaps he will make news in half an hour and ultimately his call whether or not the chiefs stays or goes. >> that's right. it is his call. we know, brook, because there is such outrage in this case that many people are calling for the resignation of the police chief or the firing of the police chief and the city manager has made it very clear that he is going to listen to the recommendation and he was waiting for that recommendation. so as you mentioned, we know there will be a news conference at 3:30. i wonder whether or not we'll learn how he felt about that vote of no confidence 3-2 vote, but certainly i think it spells some serious concerns about how the trayvon martin matter has been handled by the police department under the lead of the police chief. >> and apparently this news confe

sunny hostin, you and i looking at this for the very first time. what do you make of this, and why is he in court today? >> you know, it's remarkable, isn't it? he appears so young. this judge initially ruled that he could not be photographed, that no video could be taken of him in large part because we're in juvenile court. apparently the judge revised that ruling and said that he could be viewed as long as he wasn't shown in restraints, because typically, brooke, when you show someone in restraints, it has the possibility of affecting a jury pool, someone that's going to ultimately pass judgment on this young man. my understanding is that he may, indeed, be eventually charged as an adult. we know that there were three people that allegedly he was the shooter and he murdered three people, and so my understanding is there are a lot of issues that are going to be dealt with today. i don't know if that determination is going to be made today, whether or not this will be held over or transferred to an adult court. but i suspect that ultimately he will

sunny hostin on the case. here's what we know. he was fired for violating a school board rule. he conducted himself both in his employment and the community in a matter that reflects credit upon himself and his school. so his job was in the past, and he was also arguing porn is not exactly against the law, so what's the deal? >> that's right, and the commissioner agreed with him, brooke. i think what's fascinating is that many people don't think about these moral clauses when it comes to teachers. it's something that we hear about in actors' contracts, entertainers' contracts, but it's something you don't often hear about in teachers' contracts. but teachers in lower schools or middle schools have a unique opportunity to affect the lives of young people, so sometimes you do see these moral clauses. he argued just what you said, porn is not against the law, and moreover, something he did in the past. let me do point out, though, brooke, that when he was suspended or fired from his teaching position, he then wen

sunny hostin is on the case. do we know more about who this young man is, and did he come forward because of this fas car? >> this is remarkable. apparently yes, he did come forward because of the nascar picture and information on the trunk of that car. his name is david mccarthy of naperville, illinois. he's 27 years old. and he told melissa lech's sister michele lech that he saw the nascar thing and i want to say that was driver kevin conway who helped that family and he told her sister that he did see the nascar thing and that he wanted to clear his conscience. now, he didn't apologize for it though, brooke, and he didn't say that he was going to turn himself in to police. and he left her home, but the savvy family got the driver's license plate number of david mccarthy, reported to police and he was arrested shortly thereafter. so really just bravo. i think to nascar driver kevin conway because as you mentioned, this was a cold case four years, no one had come toward. and because of him, i think that's why we

the former prosecutor sunny hostin. were you surprised? >> i was. i've been following this case since day one. i actually was in the courtroom when the case first began, and i thought that it was going to be difficult to prove bias intimidation, because as these two jurors just said, the prosecution had to prove what his motivation was. what was in dharun ravi's mind, and that is a very difficult thing to do, and, also, you know, anderson, this is the first time, in my view that bias intimidation, hate crimes, have been prosecuted in this way. >> explain what biased intimidation is? >> sure. in new jersey, what they had to show was that rathdharun ravi io intimidate tyler clementi by spying on him. he was motivated by his bias, and intended to intimidate him because of his sexual orientation. they also could have proven 2 a different way. could have prove than he intended to intimidate and was biased against m.b., the person tyler clementi was with. what they did convict on, he was biased against tyler clementi and tyler clementi felt intimidated by

senior legal analyst jeffrey toobin and sunny hostin is here. the attorney for trayvon martin's father and family says that trayvon martin was actually speaking to his girl friend on his cell phone when this began. ultimately the call. how does that change the -- what we have heard? >> well, the police say they didn't arrest george zimmerman because they had nothing to dispute his self-defense claim. we know that trayvon martin was on the cell phone with his girlfriend. he was nervous and scared and concerned because someone was following him. she advised him to run and then zimmerman runs after him. she says that trayvon said why are you following him and george zimmerman says who are you, why are you here? she believes she hears zimmerman pushing trayvon martin. well, that means that if that's taken as true, george zimmerman is the first aggressor and he cannot avail himself of the self-defense theory. i think what's so remarkable here, anderson, is that this is information according to the family attorney and i have spoken to one of the attor

>> cnn legal analyst sunny hostin with us. a number of new developments today. let's start with the fact that you hear the recording there, the young woman saying she was on the phone at the beginning of this incident. trayvon said he was being followed. he pulled up his hoodie. in terms of the value of that as evidence, what is it? >> it cannot be underestimated because the police, john, in florida have said that the reason that george zimmerman has not been and was not arrested is because he claimed self-defense under the florida stand your ground law. there is an exception to that law and that is if you are the first aggressor, if you are the pursuer. you cannot avail yourself of that defense. the police have said that they have no evidence to dispute the self-defense claim. well this young girl's story, her depiction of what happened while she was on the phone with trayvon martin, if taken as true, disputes entirely the self-defense claim, because it proves, i think, certainly in conjunction with the fact that george zimmerman also says that he pursued and f

sunny hostin from "in session" joins us from new york with more. what have you found out? >> we found out, kacarol, there are legal findings involving george zimmerman. he was arrested in 2005 it appears, july 16th, and he was arrested for resisting arrest and assaulting a police officer. he entered into a pretrial diversion program and pled guilty and his record was expunged because of that pretrial diversion program. we also now know there was some domestic violence allegations against him by a former girlfriend and fiance. he also the next day after that filing filed a domestic violence charge against her as well. and so we're learning a bit more about george zimmerman. he had some brushes with the law and i think what's so interesting about that, carol, is because apparently the police department told trayvon martin's family that george zimmerman came back squeaky clean and that was one of the considerations in not charging george zimmerman but we're learning there have been some scrapes with the law. this is really quite a revelation not only for us that are following

sunny hostin joins me now. this hasn't been a good year for paula deen, sunny. >> that's right. she's coming off of the controversy of her diabetes and her alleged spokesmanship for a diabetic company. let me say this, this certainly was filed yesterday, march 5th. we're talking about a 33 page complaint alleging, as you mentioned, sexual harassment, battery, many things. lisa jackson, the former manager of it's called uncle bubba's seafood and oyster house, she alleges that -- which is pail la dean's brother's place, she alleges that paula deen condoned sexual harassment, racism. she used rachael epithets and startlingly, carol, she alleges that bubba displayed pornography at work, was physically abusive and interestingly enough, she says that paula deen also used these racial epithets and discussed having a southern plantation style wedding and using a racial epithet towards african-americans, she said she wished they could wear long sleeve white shirts, black shorts, black bow ties in the shirley temple days but that wouldn't work out because the media would have a field day

joining us to talk about the case is legal analyst sunny hostin. sunny, first of all, explain to us, because it's confusing here. how is it that the watch captain claims self-defense when the teen is unarmed? >> it certainly is confusing, but that is because in florida -- and i'm hearing a little bit of feedback, but in florida is one of the only states that has something called stand your ground law. and that means, suzanne, even if you are in your home and someone breaks into your home, burglarizes your home and then retreats, you don't have a duty to retreat. you can shoot the person in the back. or if you're in the place where you're supposed to be and you are attacked, you feel threatened, you can use deadly force if you feel that deadly force will be used against you. so it's one of the broadest laws, about 15 states have this law. what concerns me here, suzanne, is as you mentioned, you've got a child, a 17-year-old kid, that had a bag of skittles and a can of iced tea. he was completely unarmed, and even in florida, there is this exception
