let me bring in senior legal analyst with us here at cnn, jeff toobin. who i know also has been watching and listening. jeff, i'm sure you agree this has been an integral witness thus far in this trial here on day three. what to you make of sort of the questioning from the state and also some of her language on the stand? >> she's unpolished to say the least. she is hard to understand. but i have to say, i think it lends a certain authenticity to her testimony. she doesn't sound like someone who's making stuff up. and the gist of what she's saying, i think, is actually very favorable for the prosecution. she's on the phone. they're talking about nothing in particular. and all of a sudden trayvon martin says this creepy guy, this cracker, he's following me around. is that something she just made up? it didn't sound like it was something she made up. it sounded like a credible story. and if the jury believes that, they believe that george zimmerman almost certainly is the agreser in the confrontation which is the key issue in the whole case. even though sh

i'm going to bring in jeff toobin who has been going over the decision. jeff, it seems like the court has said -- the court -- the federal government does not have a right to not recognize these marriages. >> doma is gone. this is a major broadly written opinion which strikes down the law on the ground that it discriminates against gay people. this isn't a decision about states rights. this isn't a narrowly written decision. this is a decision that says the federal government, by passing doma, demeans those persons who are in a lawful same-sex marriage. that's the -- that's a quote from the opinion. this opinion says that the federal government cannot discriminate against people who have valid same-sex marriages. they are entitled to file joint tax -- federal tax returns. they are entitled to social security survivor's benefits. they are entitled to be informed when their spouses are killed in action. this is a decision that says gay people have equal rights under the federal constitution when it comes to this statute. >> and, jonathan turley, i want to b

let's dig deeper with sunny hostin, jeff toobin. suny, let's start with you. her on the stand, especially the defense spending a lot of time on race, how do you think that played out? >> it was hard to tell from the courtroom. it didn't seem to advance the ball much for the defense. they made much to do about the comment that trayvon martin said to rachel. he also described george zimmerman with the "n" word. certainly, he described him in two ways, with a derogatory white term and derogatory black term. they took pains not to talk about race and didn't say racial profiling, took the elephant in the room, painted it bright pink and i don't think it stuck. >> mark, what do you think? >> i tell you, you put a spin on this that is mind boggling. this sounds like a very sweet girl. i'm sure her parents love her. everybody is texting me, they want to know where you got your necklace. >> oh. >> the thing that remains is this was a disaster. the family realizes, trayvon's family realizes it was a disaster. crump is prepared for any verdict. they know where it is head

jeff toobin, you wrote in the new yorker a couple years ago about arson investigations and how the science behind it was actually proved to be junk science, was that correct, was that you that wrote that? do you think it applies -- >> it was my colleague david grand who wrote it, a story about someone unjustly executed, tyrone willingham, in texas. >> sorry. thought it was you that wrote it. do you think it is junk science, this analysis? >> absolutely. i think the judge made an excellent decision. in 1993, the supreme court made a decision, dalbert, says judges have to serve as gate keepers for science. just because someone has a ph.d., says i did an analysis, that's not good enough. it has to be science that has had testing through double blind tests and the scientific method. this sounds like classic junk science. by the way, the jury can hear this tape for themselves and make a decision. we think it sounds like one or the other. they don't need an expert. this was exactly the right decision by the judge. >> does everybody on the panel agree with that? >> yeah. you know, i agree with it

jeff toobin, i'm going to ask you do a difficult thing in television speak, but basically break this down. the practical, the legal, the financial benefits now for same-sex couples after the decisions today. >> well, ashleigh, federal law gives all sorts of benefits to married people. you get to file a joint tax return. you get social security survivor's benefits. those are probably two of the best known. what today's decision said was gay people who are married in the states where it's legal -- in those 12 states and the district of columbia -- they get those federal benefits, too. the federal law -- the defense of marriage act -- which said that the federal government will not recognize any same-sex marriages, that law is out the window. that law's declared unconstitutional, as demeaning the rights of gay people. that was one decision. today. the other decision is related to proposition 8 in california. and that one is legally a little more complex, but the bottom line seems -- seems -- pretty simple, which is that the appeal of the proposition 8 case was improperly brought. so the

jeff, this is -- of course, just in its infancy. we are learning bit by bit with his whereabouts, possibly in hong kong, that he worked for an american contractor, that he did sp spend some time in the last four years at the nsa offices and also formally worked at the cia. so is there like a contract that people sign when they work for the nsa or the cia that they would be prosecuted if they were to leak information of this caliber? >> very much. yes, for sure. anyone who has access to classified information, whether you work for the government or for a contractor has to acknowledge the very severe criminal penalties that come with intentional disclosure of classified information. in his interview today with "the guardian," he has acknowledged that he gave this classified information to journalists as an act of civil disobedience. and there is no question that the united states government will want to prosecute him. what complicates this, of course, is that he is now in hong kong, which is under the control of the people's republic

i was to bring in our cnn legal analyst, jeffrey toobin, from washington, d.c. jeff, is there any other way to see this other than that the supreme court punted today? they're asked to make a decision and say, hey, state court, back to you. >> it's somewhat of a punt but not entirely. there was a chance in this case where the supreme court could have said race is not allowed to be a factor in admissions, period. the fact they didn't say that. the fact that they said race can be a factor is a real victory nature the civil rights community. the problem, the punt comes in in they don't really spell out how much of a factor race can be and what admissions officers are supposed to do when they're sitting there with applications. so yes, it is -- it is somewhat of a punt, but they did answer at least part of the question. >> what about the issue that i raised with reverend jackson? that you already have a higher percent of degree granting institutions -- african-american enrollment than you do of african-americans in the regular population, and the same with women? if

. >> joining us jeffrey toobin and gloria borger. jeff, in terms of voting rights legislation, how much of it was dismantled today? >> it's important to point out as chief roberts said in his opinion discrimination against people trying to vote and discrimination in voting is still illegal. what is different and dramatically different is the system that had been in place where certain parts of the country had to go first for approval, for what was known as preclearance. that's gone now. and that basically gives a green light to these nine southern states and a handful of other jurisdictions to change the law any way they want and basically to say to the justice department catch me if you can. it looks like these southern states are going to start making some changes and we'll see how that affects the actual right to vote in the relatively near future. >> so the political fallout, gloria, from this is pretty significant. >> it is very significant. i mean, you heard what congressman lewis said. there's going to be a move from the democ

sunny hostin, jeffrey toobin join us. and mark geragos is also here. jeff, what did you make of her, rachel jeantel's performance on the stand today? >> performance, it sure was. it was compelling, even if you couldn't understand half of what she said. i thought it was interesting that you decided to use subtitles. but the jury didn't have those. so it really was hard to understand in places. i thought she seemed like an authentic mixed up, resentful, angry kid. she's in 12th grade, 19 years old, she obviously didn't want to believe there. the core of her testimony is that trayvon was afraid of zimmerman, as zimmerman was pursuing him. that's the only reason she's on the stand. i thought that came across. obviously she's got a lot of problems. she lied. she's combative. she's not very communicative. but do i think the jury will believe trayvon's side of the conversation? i think they will. >> this is the first time we learned she was trayvon's friend. there had been indications before that she was his girlfriend. what did you think of her? >> yeah, i m
