dennis: yes. lori: checking the market on the floor of the new york stock exchange with a wireless deal. >> big news today, indeed, and leap wireless leaping higher to an exorbitant amount in one day. 115% gain, dow components, telecom company dun 1 #%, 35.51 for at&t, the name to watch here. the dow component. what we're watching here is at&t's making this bid, 1.19 billion dollars, nearly 1.2 billion dollar bid for leap wireless. leap wireless, prepaid mobile service provider, obviously, at&t gains air wave, and you see leap is gaining there, and what's interesting in with this i said an 88% premium, jumping an exorbitant amount, but this is a ten-year chart of leap, which, today's move, a huge one, but this was a hundred dollar stock back in 2007. that was not that long ago so people who have seen the market come back and shares of so many different equities come back have not seen leap recover at all, obviously, in comparison to the levels seen back in 2007, so the great day for today, but iss

dennis: yes. i imagine it is only in the past decade or so we've seen more of these blatant patent trolls. they buy underutilized dusty old patents and go out and start holding up industry for fees. isn't it partly your fault? companies pay off the patent trillions and lawyers rather than fight them. don't take it to the court. too afraid the treble damages you are subjected to when you lose a patent award and they keep paying guys and they keep asking more handouts? >> yeah maybe there is a point on our side for that. what do you do? do you spend your day dealing with lawsuits or clear litigation. dennis: you crush them! >> you crush them? well that is easy to say. when it takes you hours of deposition and millions of dollars and that is time taking away fn very hard to make that these guys are parasites. living in the gutter of our capitalistic system and putting hold on call -- capitalism. alexander gram bell, thomas edison, used patents to build stuff. i am okay people challenging real patents

dennis: okay. i think 20 years to the last couple of meltdowns we were 19.6 over all with a 20 year average but the markets have been so afraid of raising interest rates. you see the inside and house stocks perform? >> if you go back and look history with the influence of rising consumer confidence together stocks have dental% for years raising interest rates actually look good in the market. and that is exactly what we have going on this year's regis' of the june consumer confidence number in may. dennis: in the 10 year treasury yield is soaring. and you find good news? you like consumer discretionary and tech. that is up 30% just in the past year but texas' only '06 percent. does that make it the better by? >> it is the value kleve you also look at technology with earnings growth of 13 or 15 percent that is almost three times the growth rate so mobile devices, called computing, the network or sir security bodes well for growing tech earnings fell we are expecting others to grow 6917%. dennis: con

dennis what happened? >> i haven't figured out yet because it is a huge beat to the upside for earnings per share. wall street wanted only 40 cents a share. revenue comes in and matches wall street expectation, $1.07 billion as wall street wanted dead on that. is a 20% increase over year ago quarter. what is bothering investors right now? q2 streaming revenue up 26% here in the u.s., more than doubling internationally. they have very little on international play. they are largely a u.s. company so far. second quarter year ago they had earnings downside surprise and they warned for the third quarter. we'll have to see what they say in the earnings call. so far we have a great beat on the upside. wall street is more concerned with all companies in similar media space about revenue growth. where is the growth? they matched revenue. still not good enough for some on wall street apparently. david: the key is really the number of subscribers. a lot of people are looking for the number of subscribers to increase.
