chp says a drunk driver is to blame. we are now live with this grim story. >> a blood test was done showing the driver was intoxicated. chp says the driver slammed into another car, then that, car hit two other cars, spilling all four vehicles involved in this accident. it was a mess and sad situation. >> a viewer e mailed us this information. traffic slowed to a crawl. >> we had a jeep cherokee stop in the number two lane. a gmc hummer. and slammed into the rear. >> a truck driver along the freeway takes it from there. >> as soon as the vehicle impacted there are sudden flames. he showed us his video. the body of the driver of that jeep so charred investigators couldn't immediately identify him or her the chp interrogated the driver. >> there were symptoms of possible intoxication. and there are tests being run. >> he has been arrested and booked into the santa rita jail. sky seven shows a portion of the highway covered in foam used to put out flames. a massive traffic jam went on for miles the investigation continued.

. >>> chp is investigating a deadly crash on highway 280. one person was killed when their car veered off the road and hit a tree. that happened around midnight. the crash closed down the connector ramp from northbound 280 and highway 85. the road reopened two hours later. >>> there will be no classes today at a san rafael elle men tear -- elementary school. alex savidge is joining us now. >> reporter: good morning. that out of control van hit laurel dale elementary school in the worst possible spot. it took out the service line here on the side of the building. that triggered a gas leak but thankfully firefighters managed to prevent what could have been a larger catastrophe they say.

chp has given the issue. typically around this temperature, around freezing, we do get word that the ice may be forming across that span happens around this time of the mornings. they might send a sand truck out there. use caution north 280. it's an indication of how cold it is. smooth drive for 101, 92 coming off that bridge. also a smooth flow of traffic. although we do have reports of debris coming off that high-rise. sounds like more installation and some cardboard, a distraction there. south bay, not really showing any major problems, but we do have your northbound route showing slowing. that's the 101, a typical pattern for that area. also, pretty typical over livermore. a little bit lighter because some of the folks held up over here, that stalled big rig filling lanes, no bigger issues through the area. we'll look at the toll plaza for a quick show of the backup. that's an unusual pattern. we'll see it start to even out and track this over the next few minutes. and the north bay looks smooth, as well.

chp just released this surveillance photo of his vehicle, a 2001 to 2003 ford escape hunter green in color with a roof rack and custom wheels. chp believes they may pass through the bay area on their way to mexico. >>> a man is in custody after slamming into a police car and then trying to escape in san jose. kpix 5's kiet do spoke with the security guard who saw it and stepped in to help. >> reporter: from the looks of it, it was a violent collision. it's unclear how fast the suspect was driving. but the force of the impact pushed the san jose police car into the middle of the intersection. it happened just before sunrise when a security guard from the hilton san jose leaned over to talk to the officer. >> literally just stepped back as the officer i guess was about to leave stepped back on the sidewalk and thank god very fortunate that's when the accident occurred. >> reporter: police say the driver of the cadillac tried to run. that same security guard with the help of another guard tackled the suspect and held him until backup arrived. >> doesn't surprise you? >> absolutely not.

tonight, chp is talking to people who knew the victim it to put together what he did during the last 24 hours of his life. 32-year-old nathaniel robinson senior was killed not long after midnight on thanksgiving night. his father tells us, nathaniel had called him shortly before the accident. >> as always, he and i laughed and talked about a lot of different things. >> reporter: jack robinson says it appears his son was headed to his girlfriend's home. he was driving his maroon buick, when he struck the median wall for some unknown reason. after the collision, the chp says robinson got out of his car and tried to cross several lanes of traffic to get to the shoulder of the road, but the driver struck him and took off. after that, robinson was hit by two other drivers who said at the scene. the chp says it doesn't have a description of the driver or the vehicle that person was driving. >> there could even be blood, or pieces of clothing on that vehicle which would indicate that it hit a pedestrian. >> my emotions are a roller coaster. >> reporter: robinson's father described nathaniel
