kpix 5 reporter anne makovec is live at sfo this morning. anne, lawmakers are going to try to make up for lost time when the hearing begins in 30 minutes. >> reporter: they are going to be talking about how the crash happened and what happened here at sfo directly after the crash. but first, they are going to hear from an asiana chief pilot about what the airline teaches about the automated systems on the planes. that is the main focus of this investigation. >>> reporter: at the two-day hearing in washington, investigators will look into the july crash of asiana flight 214. the ntsb found the boeing 777 flew in too low and slow during landing at san francisco international airport, hit a seawall, broke apart and caught fire killing three passengers and injuring more than 180. investigators will focus on if pilots rely too heavily on automated cockpit controls. cbs news aviation consultant chesley sullenberger says there is concern pilots don't fully understand how auto controls work. >> it's important that the pilots have the skills to monit

kpix 5's mark kelly reports. mark? >> reporter: michelle, we can breathe a sigh of relief now all is calm here in lafayette but it was tense for a couple of hours earlier this morning. let me show you where everything happened. just an hour ago it was right behind that maroon colord ford suv. the to -- colored ford suv. the owner of the repair shop next door saw a suspicious container in his parking lot at 8:30 this morning when he reported tubeworks. the container had a radioactive symbol with the label on the side instro tech. it is not dangerous they determined. we just got off the phone with the company, the product manager there says the device has a radioactive source to it. it is used to measure the density of things like soil and asphalt. but he also tells me it's not dangerous unless someone tries to destroy it. which he also said is difficult to do. as far as who dropped it here, that we still don't know. >> still trying to track down the exact nature of that. they did say it was some sort of ground penetrati

kpix 5's cate caugurian live in oakland now with more on the issues in play. cate? >> reporter: frank and anne i have some new information for you. the court appointed doctor just reveled hi findings. -- revealed his findings. he said that mcmath met all of the criteria for brain death. now dr. paul fisher from children's hospital was appointed by the judge yesterday morning. later that afternoon, fisher ran the series of tests on jahi to detect brain activity. and blood flow. >> unfortunately, the medical condition of jahi by the statute you mentioned she needs all of the -- meets all of the criteria for brain death. >> reporter: the family sat in the front row stoic and stone faced after hearing the results. right now the judge and lawyers from both sides are hearing testimony from a dr. shanahan from oakland's children hospital. now he was the first or -- that doctor was the first doctor who declared jahi legally brain dead. 13-year-old mcmath has been on life support for 11 days after complications from a tonsil surgery. the judge ordered the hospital to keep he

kpix 5 reporter cate caugiran is live outside bart headquarters over in oakland. and cate, any movement at all today? >> reporter: not that we know of, frank and michelle. as far as we know, both sides have been at the table for the past two hours over the family leave provision. the unions say presumably this is a face-to-face meeting with a federal mediator overseeing the negotiations. the unions and bart management back at it again for something union leaders call unprecedented. management says one provision in the tentative agreement that allows employees up to six weeks of paid family leave shouldn't have been in there in the first place. bart says it's a mistake. >> when you make's mistake you acknowledge the consequences of your action. if i sign an agreement, my word is my bond, we have to live with that, okay? they signed an agreement. they have attorneys that reviewed it. that was not a mistake. they presented it to us. >> reporter: the unions already ratified the tentative agreement with that so-called mistake. last month, bart directors also approved t

kpix 5's keit do is live at city hall. councilmembers made a late- night vote a minute before midnight last night, kiet. >> reporter: yeah. frank, it seems like we have been here before, you are right. we're talking about how city council passed tough new laws limiting the medical marijuana dispensaries. the dispensaries are fighting back. earlier this week the city council voted to severely limit the 82 pot clubs in the city only allowing them to open up in the northern tip of san jose. now, this has meant to keep them away from homes, schools and drug rehab centers. the city has been getting complaints about kids getting their hands on marijuana from pot clubs easily, sprinkled throughout the city. warning letters are set to go out and the city expects many dispensaries to be shut down in a month or two. but wait! not so fast. if you recall, two years ago, back in october 2011, the council voted to shut down nearly all dispensaries and allow only 10 to stay open. the medical marijuana community responded by turning in ne
