a motion filed earlier this month seeks recognition of the split from "old gm," into the post-bankruptcy "new gm." if approved, gm's request could protect it from claims over the defective ignition switch linked to at least 13 and possibly hundreds of deaths. general motors knew of the defect for over a decade but only issued a recall earlier this year. the company's request was disclosed in a federal lawsuit filed in texas over the defect. in its court motion, gm says, "just like the other 'ignition switch actions' that other plaintiffs have filed in the wake of public reports regarding the outstanding recall, this case relates to a vehicle designed, manufactured, originally sold and advertised by old gm." meanwhile, gm chief executive mary barra said the automaker will create a global organization that will focus on product safety and quality. this is barra speaking in new york earlier this month. >> this new way of developing vehicles will provide the highest level of safety, quality, and customer service. it ensures that a situation like the ignition switch recall does not happen aga

it is also the day old gm went out of business, new gm, the company we know today was born. lawyers representing vims estimates injured as a result of gm's faulty ignition problems filed their own motion asking the judge to dismiss part of the restructuring agreement. they claimed old gm committed bankruptcy fraud because it knew it had a problem and failed to disclose it. gm says it has taken responsible for its actions and will keep doing so. it has recalled 2.6 million vehicles so far this year. unrelated to the recalls is the new potential problem. the national highway traffic safety administration is investigating reported malfunction of the automatic braking system on the 2014 chevy impala. it has what is called an autonomous braking system which automatically activates when the car is in ink danger of hitting something in front of it. nhtsa ereceived a complaint one driver that the system acted several times without cause. the car stopped at once moving 40 miles per hour, causing another car hyped it to crash into the impala. nhtsa open ad preliminary valuation to det

neil: so with bankruptcy law, they should take claims that this is part of the old gm. but others argue that they can make good on that they could bankrupt the company. you agree with that, and is not a legitimate fear? >> i don't think it could bankrupt the company. but the consumer groups have written a letter suggesting an alternative, which is that gm set up a 1 billion-dollar fund nk people out of back so that the limits of how much they would allocate, i think that would take care of what they would do and i think the more important issue is i think this company will survive this. but the more important issue is whether or not there's going to be criminal enforcement of the general motors this behavior. and whether or not the people that stop this investigation will have some kind of penalty applied to them. and i think that there will be criminal sanctions here. but no one was put into jail. i think until someone is put into jail in these companies, that they're never going to get the message that they cannot behave this way and harmed the public. neil: good for
