reports now from the justice department and from the pentagon. let's start with pete williams and talking about the justice side of this. what more have we learned, pete, in terms of the investigation about the shooter's history and his involvement in domestic gun violence, domestic violence? >> well, i think the facts of his violence in domestic violence are very clear, but i think an important point has to be made here about what information the government should be providing, all levels of government, specifically in this case the military. it's not just the domestic violence part of this. which of course was the reason that devin kelley was brought before a general court-martial and convicted. under the law, the government has to -- the military has to tell the fbi not only if somebody is convicted of domestic violence, which he clearly was, but anybody who is convicted before a general court-marti court-martial. i'm sure hans will have more to say in a moment but that's the highest or most serious level of court-martial, most serious basically military trial. under the law, a

news justice correspondent pete williams. pete, this is politically explosive. this agency is very dear to the hearts of democrats. this is an obama appointee stepping aside. the court has to decide mulvaney or english. any clue of how the court looks at this legally? >> the fact is that she has the tougher burden here. when you're asking for something like this, a temporary restraining order, you have to have the evidence on your side and the problem is there is a conflict between these two laws and what the justice department says and the general counsel of the agency itself. they both say, yes, it's true, the deputy shall become director when there's a vacancy. the fact is that another federal law, the vacancy reform angct, gives the president the option to put in someone else if he likes. that's the justice department's contention. the judge, i think, will rule pretty quickly here, steve, on the short-term question of whether she gets this instant temporary victory and then it will play out for the next couple of weeks if it does continue. it seems likely where this is headed.

teen gunned down near his high school by a shooter dressed as a clown. pete suratos is live where a memorial is now growing. pete? >> reporter: good morning to you. students and faculty deal with this tragedy. concord police tell us it appears to be targeted. the question is why the student was targeted. you can see the memorial set up for the student that was shot and killed near campus. you can see the candles down there. there's a picture above the candles of that student. here is information that we know at this time. we know the students were just getting out of school for the day, yesterday afternoon when a black car pulled up at the corner of beach and salvio. a man armed with a gun, hops out, gets into a brief argument with the group and shoots the 17-year-old several times. that teenager was taken to the hospital where he was pronounced dead. crews spoke to neighbors in the area, who are reacting to this tragic news. >> it's like, you know, what's happened. it's relatively a nice neighborhood to live in. it's close to things. yes, when you see something like that, your firs
