only about 20 of these folks coming into d.c. via the metro, marching down the streets under police escort with bicycle police, several of the different agencies that you mentioned. allowing them to get to lafayette park where their rally was only supposed to begin at 5:30. perhaps because of the small number and the overwhelming number of correspondent protesters here i can't stress enough about how many factors larger the counterprotesters was. i think we have the weather to thank for that. it cleared both protester and counterprotester here a little bit earlier. you mentioned the standoff if you will, the tense moments that we experienced here about an hour ago. that was when with the rally over, police moved as though they were going to bring the rally goers out through the same entrance as which they arrived. some of the antifa folks spoiling for a fight, set up a makeshift barricade. they were ready to push against police and the police took the rally goers out another entrance. made it back to the metro largely unmolested

i think perhaps the d.c. police are little more familiar with this sort of protest than those in charlottesville. they actually said it was the top priority today to keep the groups apart. and that was their goal so that they would not get violent because is not going to get violent usually when you have a bunch of people who agree with each other. the counter protesters are probably not going to get violent if there is a confrontation but that's why i'm curious to see what will happen because a reporter mentioned it looks like there may be a confrontation. i have to say i'll be very surprised if the police let that happen given that they are planning to make sure that did not happen because that is when violence is more likely to take place. jon: a lot of people i think were surprise, myself included last year. you say it goes back generations, really prior to the founding of the nation. in the years since, has anything gotten better in your view? >> i do. i think people are more willing to talk about these

this judge in the d.c. case has previously proclaimed herself in court to be basically bewildered by decision and here today she once again goes back to it. the judge, quote, now i understand, wasn't my decision to move another trial in front of this. wasn't my decision on push that trial up to accommodate that judge's schedule. and you know, it was your decision to push it further. so you're under extraordinary time pressures that don't happen on a daily basis. but we have a pretrial scheduled on september 5th and i need to know what objections you have to the prosecutors' exhibits. so what are we going to do? manafort's defense lawyer kevin downing says, i don't know, your honor. we don't have the resources of the u.s. government. we don't have two trial teams on get ready for two trials. this is us. three here and a paralegal. i don't see how it will get done with all the parts. the judge responds, well, the day you asked for was yesterday. so what are you asking for now? you can't just say i don't know.

and in the d.c. circuit you have a lot of administrative law cases, so that means understanding sometimes very large records. some of the cases that come before the d.c. circuit had been percolating in the administrative agency for a decade or more. and so the record can come in books that are about this big if not this big. and judge kavanaugh would pour over those records. he wanted to know the details of the case as well as the advocates who will appear before him. and we would -- we were just in awe of how hard he would work as a judge to find out what the right answer was and that meant respecting the law, the precedent in the d.c. circuit as well as from the u.s. supreme court, and making sure that he knew what the best arguments were for each side. at oral argument, he would press both sides. he wouldn't come predisposed to make one lawyer look bad or to get the answers he wanted. he did truly want to find out what the best answer was in the case. i think there's no better education in the law

washington, d.c., is not working for you. they do not secure the borders. i think those are all perfectly legitimate policy discussions. some of them i find even difficult to disagree with. for instance, washington is a small. that is true. i do not know that it is being drained right now, but it is a swamp, and it has been for a long time. as i see it,pitch, and it was wrapped in other stuff that you might like or might not like, but that was the policy pitch. since then, i have seen three kinds of disruptions since president trump became president. the first one is a policy kind of disruption, tariffs to push back on trade. border security, pushing back on what basically is going on at the border. tnd questions about wha the role of the u.s. should be when it comes to foreign worse overseas. i find nothing outrageous about any of these policy disruptions. i think they are perfectly legitimate debates to have. are perfectly legitimate discussions to have, and in some cases my personal view, as somebody who wrote a book about afghanistan, i think we should
