takoma park station to investigate the crash last month. sarah simmons has more. >> reporter: it is relatively quiet here at takoma station. it is closed due to the ntsb still investigating from 10:00 a.m. to 3:00 p.m. today and from 7:00 a.m. to 7:00 p.m. on saturday. the ntsb is continuing to test the circuits on the track that have been in question since the crash. shuttle buses will continue to move from fort totten to the takoma station. the ntsb has been testing the track since the june 22nd crash that killed 9 people on the red line. the ntsb has said the system that was metropolitan to detect the train on the tracks failed the day of the crash and during following tests. now the ntsb is also calling on metro to develop a realtime system that would immediately alert the control center if there was trouble on the tracks. it's something that doesn't even exist at this point. and would have to be built from scratch. but the metro general manager says he hopes to have a company working on it within the next month. >> i received dozens of e-mails from vendors, some who say they ca

survived. sarah simmons is there live. >> reporter: we were there as they wheeled him into the courtroom and appeared frail, was in a wheelchair as you said. and he was difficult to hear. he did speak out. just a few things he did have to say during the arraignment. when the judge and his attorney were discussing the issue of whether or not he needed to go -- undergo a competency exam, something they would do in the next 30 days. during that time he was noticeably shaking his head and was trying to speak. he did utter a few words, saying this: the constitution grants me a speedy and fair trial and he also spoke up saying, as a u.s. naval officer, i'm sworn to protec my country and take my vows seriously. the attorney was asking for a competency exam at the time to see if he is exeat helicopter to stand trial. the judge did advise him to listen to his attorney and undergo the exam. he has four charges that will make him eligible for the death penalty. he has been hospitalized since the june 10th shooting. you can see as he came into the courtroom, there was a wound to the right

is unconstitutional and now the county could be forced to pay up. sarah simmons joins us with more on the top story. >> reporter: good morning, guys. this has been a contentious issue, but a judge has ruled that the furlough forced by the county are unconstitutional. the furloughs expected 5900 employees, a majority of them from the public safety and the fire and police department. the judge ruled county violated the contracts agreed upon with the collective bargaining unit by imposing those furloughs. they have fought with the county over this issue. last week the county approved another round of furloughs. it's unclear if those will be put on hold. a county spokesperson said it was a difficult decision to save jobs and save the county $17 million. in a stam by spokesperson james keary, he says the court has substituted its judgment without acknowledging the economic challenges acing the country -- facing country. to comply with the court's opinion, they say they will have massive layoffs. now the judge's decision requires both sides to meet within ten days to refund the money, but t

homey morris. >> i'm allison seymour. both showing up after metro's deadly accidt last month. sarah simmons has been sitting in on a metro board meeting this morning. she's here now. >> reporter: metro just announced at its board meeting they will implement a zero tolerance policy. that means any train operator who is caught using a cell phone, to call, text or pda, they will be fired immediately. this is a significant change since it used to be a three- strikes rule and then you're out. they would have a little bit of leeway there. the only time a trioperator will be able -- a train operator can use their cell phone is for emergency purposes. metro says this will start on july 13th so they give train operators time to get used to the policy and know this is how it works and their skill writing it at this point. this is in response to a metro train operator caught texting by anther passenger june 5th. metro says the operator admitted to texting while on the job. he was begun a five-day su preparation but der the new policy, th is no longer. anybody caught will be fired immediately.
