" plus... the billzard cleanup continues as siouxland digs out ... these stories and more... on abc9 news this morning. lukas: good morning siouxland and thanks for joining us... i'm lukas voss. we begin this morning with the case ainst iconic comedian bill cosby. a pennsylvania judge ruled cosby will have to face a sexual assau charge ... and the case against him will move forward. reporter mary moloney brings us the very latest. "the case dates back more than a decade. and it involves andrea constand -- who claims bill cosby drugged and assaulted her in 2004. initially -- constand kept quiet. but a year after the alleged assault -- constand went to police. the prosecutor at the time did not file charges -- saying there wasn't enough credible and admissible evidence. cosby's lawyers say the prosecutor made a promise never to criminally charge the comedian ... if cosby agreed to testify in constand's civil case. he did. and in sworn testimony -- cosby admitted to giving drugs to some women he wanted to have sex with.

settled the lawsuit -- the amount not made pubc. the case was closed. cosby's testimony sealed. but late last year -- a judge oped those civil court records. and in december -- a different prosecutor citing new evidence charged cosby with criminal sexual assault. cosby's attorneys cried foul... claiming the promise made by the former district attorney protected the entertainer from prosecution. the star's attorneys argued cosby only testified in the civil case -- because the state agreed to drop the criminal case. ( joey jackson/legal expert): "you would think there might be a written instrument, a written document that would suggest that the commonwealth would not prosecute him. ah, therein lies the rub, there is no such agreement." late wednesday the judge ruled... promise or no promise... the case against bill cosby will move forward. and his attorneys said they would appeal. i'm mary moloney reporting.

been set for an akron man accused of killing his mother nearly two years ago. johnathan neunaber's court date is scheduled for may 10th. just last month, a plymouth county judge ruled neunaber was mentally competent to stand trial for the killing of esther neunaber, back in july of 20- 14. lukas: also set for court is a storm lake man facing kidnapping charges the trial for scott banks has been set to begin on may 17th. he's accused of keeping the iowa human services department from taking custody of his chilen. scott entered a plea of not guilty monday, court documents kept his two department in december and lied under oath the same day. after a year long lotto mystery bringing down lottery fraud ... been filed in polk eddie tipton hot lotto system so he would win... another person however, from webster city, says of a very big jackpot. here's his story. director at the multi state lottery association was convicted of fraud for rigging the hot lotto jackpot. tipton tried claiming the 16 million prize for himself back in december of 2010. the main evidence - this quik trip video surveillance showing tipton buying the ticket himself. "he was caught, if that video didn't exsist, who knows if hed be there and this still going on" now the crawford mauro lawfirm has filed a landmark lawsuit- stating by allowing tipton to rig the jackpot- the iowa lottery and multi state association deprived the legitmate hot lotto winner millions of dollars. "the odds arent exactly great,if you actually win you should get your prize" attorneys are asking the courts to award their client - larry dawson, of webster city- 10 million dollars, plus interset. they say, after tipton's rigging in december of 2010, the lottery reset to 1 million. meaning when, dawson won on may 7th 2011, he won significantly less. then in december of 2011, tipton's unclaimed 10 million was returned to state lotteries... shorting dawson millions. "on may 7, 2011 our client won 6 million dollar cash value

lottery by the executive, he wouldve won 16 million in total" according to the lottery rules published, the jackpot is to carry over, until a legitmate winner is drawn. thats larry dawson" attorneys are also questioning the iowa lottery and multi state associations security and surveillance protocols. they're unsure if mr. dawson's is the only case rigged by eddie tipton. "this was a theft. this was a rigged game. there was no prize as lottery rules. shouldnt have gone back and should go back now, should be reverted" j- ending " lukas: the lawsuit says dawson is ed 10 million dollars, plus interest, and requests a jury trial for proceedings lukas: the man ... notoriously known for raising the price of a cancer and hiv drug by 5- thousand percent ... will face a congressional committee later today. when martin shkreli was c-e-o of turing pharmaceuticals... he hiked the price of the drug daraprim... charging 750- dollars per pill instead of the usual 13-dollars and 50-cents. shkreli has been subpoenaed... but is not expected to answers any questions regarding the

through your in home appliances like a furnace, hot water heaters, and fire places. and when we receive several inches of snow, sioux city fire department says residents should check outside vents to ensure that they are not covered. because if not, the results can be fatal. "we want to make sure that those gasses are released into the air and not coming back into our home. so it's important that we look around our house to make sure that the vents are clear of any snow or ice build up in front of it. same thing with our gas meters, we want to make sure they're clear and free of anything," said rodriguez. steve kistner the general manager at kalin's indoor comfort who offers residential services says that's not the only thing home owners should make a note of. "this would indicate at different levels so one threshold is 15 ppm, which sounds very low, it seems low, but that's when the first risk comes in for those that might young or carbon monoxide monitor will run at about 200 dollars and should be placed at eye level in either your bedroom or living area as for the newwell family ... their condition is currently unknown... mother nature this week... and there is still plenty of snow on the ground outside. now that the blizzard is over... the metro area is dealing with the aftermath. people in the downtown area were trying to make it through the snowy streets all day yesterday... and in some cases trying to smash through windows ... clean up continues all over siouxland ... in correctioville ... loud engines and beeping horns from construction vehicles echoed off the buildings all day yesterday... with neighbors helping each other dig themselves out of the snow. "i mean it just comes to a screeching hault. there's no deliveries, people can't get out to go to work and if they do get out they can't get anywhere anyways," says carla mathers, deputy clerk at correctionville city hall. to help remove the massive piles of snow, city hall contracted some of the local construction companies to help dig out the city...

think about... and even harder to talk about... but several local families are starting the conversation in order to help others. last spring ... we introduced you to michelle criss ... who's son, amos, was stillborn. just months later, michelle had raised enough money in his name to donate a cuddlecot to mercy medical center the cuddlecot gives families more time with their baby. then, in december, the first cuddlecot was donated to avera sacred heart hospital in yankton by the koupel (coe-pull) family, in memory of their son, joseph walter, who was delievered there in september.

now, the siouxland hospital that delivers more babies than anyone else will be getting the same technology. a sioux city couple wants to make sure unitypoint health -st. luke's has a cuddlecot... and a lasting memory of their daughter's impact on the community. with more on this... here's jenna rehnstrom with this week's your health matters. jeremy and lisa cotter have a beautiful family. two girls and a boy... including little evelynne, who's not quite a year old. but, there's another member of this family who's just as important, although you can't hear her tiny voice or see her take those first toddling steps. jeremy cotter says, "we were expecting twins last year, and we would to go all the appointments, eager to see their development... [one appointment] they couldn't find elizabeth's heartbeat." evelynne and elizabeth cotter was delievered at unitypoint health - st. luke's last february 23rd at just shy of weeks. there are happy memories of celebrating evelynne's birth, but the cotters say it was also like a bad dream as they struggled to make sense of elizabeth's death. jeremy says, "i feel like we had to grieve on someone else's schedule, because we would have to ask our nurses to bring her body to the room so we could spend time

would have to wait and after awhile, send her back." that's because the natural process of death makes the body change quickly, especially with babies, so when a child is stillborn, their body is taken back and forth from the hospital's morgue for preservation. but, the cuddlecot, a medical tool gaining popularity in the u.s., would've lessened the trauma for the cotter family. labor and delivery nurse, suzie gosch, explains how it works. suzie gosch, r.n., unitypoint health - st. luke's birth center says, "what this does is preserve time. it's actually like a cooling blanket and it lowers the body temperature to a nice cool temperature and just sort of haults the changes that are taking place." lisa cotter says, "we were looking for wayso honor elizabeth and her birthday is coming up. we know it was something we would've benefitted from, so we wanted to help other famlies." the cotters have been raising money to donate a cuddlecot to st. luke's - and the

administrator in norfolk is warning everybody to stay off the roads ... here's susan risinger with the details. "street conditions in norfolk today are likely to be "dicey," according to city administrator shane weidner. weidner says some snow plows and pay loaders got stuck yesterday trying to move the wet, heavy snow that was piled up in six-to-seven- foot drifts. the norfolk city council has voted to restrict parking along mckinley avenue in tahazouka park. public works director dennis smith says allowing parking on both sides of the street has created a narrow traveling area, so parking will only be allowed on the north side of mckinley. nebraska legislative speaker galen hadley believes the state will create an infrastructure bank to accelerate roads construction. during monday's northeast nebraska day in lincoln, hadley said the only question would be whether the bank would receive the full $150-million suggested. these and more stories can be heard on newstalk wjag, literock 97.5 and 106kix.
