has infuriated someone where they feel they have to vandalize our building. >> reporter: the first unitarian society of denver has dealt with this problem before. >> last year, they had a better red aim. it was aimed at the black in black lives matter. >> reporter: it is almost a year to the day. a team showed up to help the church clean the vandalism. >> about 20 people showed up the next day with garbage bags and tried to get the paint off the wall. >> reporter: this time, reverend mike moran is debating leaving it up. >> it is a reminder of the battle that needs to be waged. we live in a country where systemic racism has been a part of our national dna since before its inception. that has not changed. >> reporter: a police report was filed but the detective told reverend moran it is unlikely anyone will get caught. one thing is certain, the

one day after the sudden closure of heritage college. students enrolled in its certificate program gathered in denver sharing frustrations saying now, they want to know how to get their records. proof of their training. >> i have nothing to show for ten weeks of class. i have absolutely nothing but a mound of debt. >> i put $15,000 into this program. >> reporter: tuesday, the for profit college with ten campuses nationwide and nearly 3,000 students abruptly shut its doors. telling students by posted sign the college had run out of money needed to continue operating. according to students, heritage promised a fast path to jobs in medical and healthcare fields. some students say the school gave them conflicts information about their student loans. >> i was furious. they were telling me i owed money out of pocket when in

small refund. >> they tell us we are here for you. where is that support? >> reporter: first thing tomorrow morning, both teachers and students say they plan to start calling the local and state lawmakers voicing their concerns and demanding answers here. a spokesperson for the u.s. department of education says for those students who had federal loans, they may qualify for a loan discharge or be able to transfer their credits to live tonight in lake side, lauren dispirito, cbs4 news. the presidential race tightens in colorado. a new poll shows donald trump and hillary clinton essentially running neck in neck. the university of denver commissioned this poll. in a head to head race, clinton has a one point lead. at 42-41%. but, when you factor in gary johnson and jill sign support, they each get 39% of the vote. our specialist shaun boyd in

running mate mike pence held a rally. shaun boyd, those numbers are keeping the campaigns busy in our state. >> reporter: jim, you know, we talk a lot about the national polls but at this point, the race hinges on just a handful of states. and colorado is one of them. >> we are leading in two different national polls in the denver post just reported it is all tied up in colorado. >> reporter: mike pence told an overflow crowd in lobatoland it is game on. >> l like we were out there fighting but this movement is coming together. colorado is coming together. we are going to make donald trump the next president of the united states of america. >> reporter: but, the path to victory remains narrow. in colorado, factors into almost every map. >> how critical is the state of colorado? >> colorado always seems large on national elections but particularly so this year. i think donald trump has a message. it is really resonating with people here in colorado.

freedom. people who believe in rugged individualism. >> reporter: appealing to a party deeply divided. >> the time has come for us to say one voice to our fellow republicans, it is time to come home. >> reporter: but republicans are not enough. they aim at those still on the dependence. >> whoever is the next president, that president will likely set the course of the supreme court for the next 40 years. that is for real. >> so colorado, we have rk you have six days to do it. >> reporter: yeah, this race is hardly over. if trump is able to pull off two to three bigger states like ohio, florida, north carolina, he is up in ohio and florida at this point, this race will come down to a collection of smaller states and colorado is prominent among them. trump has been here at least ten times in the last three months and his campaign is not ruling out another visit before next tuesday.

>> certainly keeping shaun boyd busy. hillary clinton was in nevada tonight. another state with very tight poll numbers. she has been ramping up her attacks on trump's treatment of women and his attitude toward hispanics and muslims. chelsea clinton was in boulder today encouraging that crowd to get out and vote. we will see visits this week from bill clinton, bernie sanders and donald trump jr. you can see the campaign here is the latest on colorado's controversial ban on taking receive fees with your filled out ballots. they asked a judge to file a restaining order so the law would not be enforced. it has been around for 125 years to prevent people from selling their votes. there is some financial relief for the family of a woman who died in a jefferson county jail two years ago. cbs4 first told you about this

lobato died of dehydration in custody withdrawing from opioids. her family says her cries for help were ignored an her family was awarded $2.5 million. >> nothing will replace jennifer in their lives. no amount of money can replace that. >> reporter: there is still an ongoing federal lawsuit against the private medical provider for the jail. county officials say her death prompted chans jail evaluates inmates. now an update on lingering software issues that could have shut down the new way line from union station to dia. the government is giving rtd an extension so service will not stop on saturday. as feared. stan bush talked with rtd officials. good news nor now huh? >> reporter: absolutely jim. rtd avoided a shut down despite a rocky start-up to this system. this system has received a ton

critical component to commuting every day. federal administrators want rtd's new commuter line to keep running giving the railroads three months to fix issues that could have shut the lines down. crossings on the a and b lines have been manned by crossing guards because equipment has repeatedly failed. the fra now requiring updates twice a week to ensure the corrections are on schedule. >> this is the first time ever that this type of system has been built in the history the country. and so, it is all starting from scratch. and we are all learning as we go. >> reporter: the line to the airport has suffered from a series of very public hiccups. first, when a train stopped suddenly on an elevated bridge. a week later, a lightning struck shut down services as well. and buses would have to fill in the gaps in service immediately. shaking confidence in the system. but despite the bad optics. 20,000 passengers a week are riding the lines.

both were killed in their patrol cars. 15 rounds were fired at officer martin who had only been on the force a year. >> ambush. it was nothing less than a slaughter. these officers had no idea what was about to comb. >> investigators are still trying to pinpoint green's motive. he has a history of harassment including two weeks ago when he waved a confederate flag at a high school football game. now, the latest on the sex assault case against bill cosby. today, his lawyers argued that blind to defend himself saying that cosby cannot identify his accusers in photographs or help in his defense. the judge has not ruled on this request and more hearings are scheduled next month. the trial is expected to start next summer. there is a worrisome spike in a polio like illness in several children in washington state similar to an outbreak we saw here a few years ago. two children have a condition

one of them died over the weekend. colorado treated 12 patients with afm in 2014. they noticed the cases coincided with an outbreak of a respiratory illness caused by the intero virus d68. >> it is a rare condition, but something we need to take seriously in the research communities. >> there are many viruses that can kasai fm. the centers for disease co kids wash their hands often and make sure those vaccines are up to date. well, you certainly wouldn't get a grocery clerk prescribe the drugs for you would you? >> a cbs4 investigation found out that is what is happening. brian maass has the story. >> reporter: these are supposed to come to you by your doctor or a pharmacist. but we found grocery store clerks prescribing drugs for

it is a grocery store on denver's west side. selling everything from tortillas to meats. and, that's not all. when our undercover producer asked for something for back pain, the clerk told her the antibiotic. but that is a prescription medication supposed to be dispensed by a pharmacist or a doctor. so, we went back again. and it happened again. this time, the clerk seg prescription antibiotic. and, just a couple of miles away. at another neighborhood grocery store, we found the same thing. they sold us children's amoxxicillin. that drug can cause life threatening reactions. >> it can hurt a person. taking the wrong drug the right way or the right drug the wrong way. >> reporter: they are concerned with what we found calling it a

out prescription antibiotics without guidance. >> it should not be used in children. it can produce discolor ration in the teeth. there is no guarantee it has the amount of drug in it it says. >> reporter: and we found this has happened before. this year, investigators found this growly grocery store selling prescription drugs without a license. the state issued a cease and desist order in july. and state investigators found both of these fort collins stores illegally dispensing prip and issued cease and desist orders. >> then in mexico, that is sort of the cultural norm. >> reporter: dr. tillman farley oversees clinics across the area that serve the latino community. he says buying an antibiotic without a prescription is common in mexico. >> when folks come up here, they don't drop their culture background at the border. >> reporter: there are plenty of low cost options that are safer. >> it is best to go to a full

provider for your healthcare needs. not the grocery store. >> reporter: we went back to the first store we visited where the owner said he didn't know what he was doing was illegal. >> of course, if it is something illegal, i will not do it anymore, you know. >> reporter: and we had all the medications tested. they were indeed prescription medications. we spoke to the owner of the second store we visited in denver. she said what happened there was a mistake. but some medication is being sold under the counter in arrived today. but might not be around long ed. >> it won't. doppler 4,000, tuesday at 10:00, you see the snow we had along the front range all the way down to telluride. that died down. then, a little shower activity through denver. some folks saw a sprinkle. now, everything has calmed down. chicago, look at the tornadoes they had. a little line going through the southern part of the state with strong hail. and, this is the line that is moving toward cleveland. that is what caused the pull of

you can see the cooler air moving on down. all the cool air we had is spilling into our area. 62 in denver. ahead of that, still very warm with 80s and 90s . around our home state, 30 degrees cooler in meeker. 12 in craig. 15 in trinidad. seven out at dia. so yes, it did feel cooler today. let's go to lauren whitney in the colorado weather center and all the numbers prove that. >> it won't last too long. but the warmup is not going to a daily record high tied for monday. 70 yesterday, 62 today. upper 60s thursday and again on friday. as we look at what is happening for our futurecast here, we have this upper level low that is just over parts of arizona now. that is going to hang out there for a day or so. then it is going to move up to the great basin friday. ahead of that, we look at a little more cloud cover across the front range area.

some of that can be very heavy. as we head toward denver, maybe a few sprinkles and showers saturday. most of that will be on the eastern plains. if you get some front range mountain snow. most of it will stay down to the south. but we need the moisture. >> we do. and today's highs, just 62 degrees. has not been that warm since october 19 when it was 69 degrees. both locations 42 and 45 is where we started out. should be at 58 and two degrees below freezing. every 51 in bailey. 55, 58 in evergreen. frank down, 59. 61 centennial. everybody on the cool side to near normal. 49 and 45. right now, we have a steady barometer. and dustin scaaffer says they have some natural snow going and the snow guns look at this shot with the elk. the fog in the valley.
