holiday rush. at least nine deaths blamed on storms that produced everything from tornadoes to a dangerous ice storm. half a million people without power nationwide. >> by late last night, more than 700 flights had been cancelled. another 11,000 delayed. just in time for the christmas holiday. what do we have in store for today. >> today is mostly just rain. heavy rain at that across the southeast. but this whole storm system we saw everything with it and we had our fair share of wild weather this weekend. >> reporter: look out. holiday shoppers jump for cover as sheets of ice fall from the roof of an outlet mall. no one was hurt. fallen wires were the danger further north, an ice storm downed tree lines from the upper midwest to new england. 300,000 lost power in michigan alone. crews have been working in the bitter cold, temperatures in the teens to get the power back on. >> they bring in extra crews

from out of state. it's an effort to get them lined up where to go and what to do. >> reporter: five people drowned along washed out roads in kentucky while drivers in indiana abandoned their cars to rising waters. in hughes, arkansas they're picking up the pieces after a tornado touched down saturday. one person was killed and four were hurt. heavy winds caused gridlock at airports. departure boards lit up with delays and cancelled flights. 700 flights cancelled in all frustrating early holiday travelers. it's looking like christmas in sheboygan, wisconsin. the city got half a foot of snow. >> it's made it a nice setting for a white christmas. >> reporter: it was a completely different story along the east coast, record warm temperatures sunday in new york, philadelphia, and delaware. not exactly what skaters had in mind when they flocked to the rink at rockefeller center. >> i knew it was going to be warm but i didn't know it was going to be that watery. >> reporter: skating in short

sleeves days before christmas. >> i wish it was a little colder. >> still warm and rainy across rockefeller center but you can see across parts of maine and new england, we have ice. that's the biggest concern this morning. the potential to a quarter inch to half an inch of ice. but elsewhere, heavy rain, perhaps a couple of inches of rain but then as we go into the holiday we're looking for things to clear out. in fact, tuesday, christmas day itself, looks a whole lot better. >> dylan, thanks. the burst of summer leading us back to reality. thanks. today is an important deadline for president obama's health care law. meantime he is on vacation in hawaii. last night the first family took a little time to enjoy a college basketball game coached by the first lady's brother craig robinson. nbc's white house correspondent peter alexander is traveling with the president. good morning. >> reporter: good morning to

you. here we like to say aloha. they say the website can handle any last minute rush of consumers but there's a deep concern, especially among health care advocates that the word may still not be getting out to the people that need the coverage the most. after a tortured roll out, today's the first real deadline. the last day to enroll for health care beginning january 1st. >> how many people sign up by december 23rd will be the first true test of how well the law is working and in particular how well healthcare.gov, the federal website is now functioning. >> reporter: on social media, a final push. this holiday inspired tweet from the washington d.c. exchange. instead of socks or an ugly sweater, how about health insurance for christmas. and as anticipated, a last minute spike in demand. when we called this weekend, a nearly two hour wait. >> your estimated time is 105 minutes. >> reporter: the president said more than 1 million americans already enrolled but that's far shy of the 3 million plus the

administration hoped to have signed up by this point. but experts say who enrolls is more important than how many.w . emphasizing the need to get enough young healthy people to balance the costs for older and sicker americans. a series of late changes have complicated the process including the administrations latest move allowing more flexibility for the millions that got cancellation letters. some democrats have repeated their calls for a one-year delay warning obamacare could collapse if the problems continue. >> if it's so much more expensive than what we anticipated and the coverage isn't as good as we had, you have a complete meltdown at that time. >> reporter: still uncertain is how many americans will pay their premiums before the end of this month. they need to do that for their coverage to begin. the white house has encouraged insurers to give a short grace period and most insurers have agreed to that. >> all right. peter alexander among the palm trees for us this morning.

thanks. new fall out from the massive data breach at target. there's growing calls for a government investigation and according to the "wall street journal" sales at the retail giant dipped slightly over the weekend. nbc's kerry sanders is at a store in florida live this morning. what's the latest there? >> target is now in full damage control as many of the customers are angry, frustrated, and understandably worried. >> reporter: with two days to go before christmas, the giant data breach at target could not have come at a worse time. and shoppers are worried it's a trend. >> i think i'll start using cash. >> reporter: making matters worse for some rushing to complete their holiday purchases, jp morgan chase is putting a daily cash limit of $100 and spending limit of $300 on about 2 million cards that could be susceptible to fraud.

on sunday, the new york senator chuck schumer called for a full investigation by the consumer financial protection bureau. >> by revealing the information, it will enable other stores to learn from this experience. >> reporter: target is offering discounts and apologies and promising customers zero liability for any charges that you didn't make. plus free credit monitoring to everyone impacted. but some customers are still angry. one writing on facebook, no more shopping at target for me. done. others say target should not be blamed. >> you can't just say you're going to be scared to shop at target because this could happen anywhere. >> reporter: many security experts agree that it's unfair to blame the retailer. >> target has spent a lot of money on payment card security and they were compliant with all the latest security standards. >> reporter: but experts say those standards are antiquated,

the u.s. relies on easy to copy magnetic strips to hold account information rather than more secure digital chips used in most other countries. so far, no one has detailed exactly how this happened. >> chief suspects would be sophisticated organized criminals that have studied target or insiders with privileged access that know exactly where to go. >> reporter: security experts are warning this morning that if you get an official looking e-mail from your bank, don't follow any links on that e-mail and then start providing personal information because it may be a so-called phishing scam where somebody is trying to steal your identity. savannah. >> unfortunately a lot of people oking to seize this opportunity. kerry sanders, thank you. >> natalie is here with breaking news in a case we have been following a couple of years now. >> good morning. two russian punk band members jailed over a protest in moscow were released from prison early under an amnesty deal. jim maceda talked to one of the band members earlier. he is in russia with the latest.

>> reporter: that's right. maria alyokhina was released from a prison much closer to moscow than we are here in siberia where her fellow member was released just this evening. both are mothers of young children. maria told reporters she was feeling physically and mentally okay as she left prison with her lawyer. she now wants to pursue a human rights career and lost no time today meeting with a local chapter of the committee against torture adding that she's not afraid to do anything anymore. meanwhile, nadezhda told me in that interview she is joining maria in a human rights career as well. she thought that the pardon that freed her was an act of weakness on the part of president putin because it came with a few months to go in her jail term. she can't wait to go home and bond with family and friends and all of those that got her through what she called a

famous brands, famously easy, famous footwear. victory is yours. very good monday morning to you. 7:26. i'm laura garcia-cannon. the family of a 13-year-old oakland girl being kept on life support will hold a march this morning. jahi mcmath had tonsil surgery at children's hospital two weeks ago but declared brain dead days later. today a judge is expected to appoint an independent doctor to evaluate the girl's condition. last night a group of faith leaders held a rally and sent a letter to the d.a.'s office demanding a formal investigation of the hospital. they are also accusing doctors and administrators being insensitive to the family. >> whether he be or she be a doctor or any position in the she's dead she's dead and i believe and we want the court to say no, no, no, it represent as

we're going to talk to ryan in a moment. first the back story. for ryan o'neal this andy warhol is as personal as valuable. an iconic image of his long time love, the late farrah fawcett. but the silk screen has been hanging in limbo while a jury decided whether it belonged to o'neal. he removed it from faucet's home in 2009. we have been watching the case. >> it was his idea to get paintings made. he knew andy warhol. they were handed one to him and one to her. >> fawcett's alma mater, the university of texas claimed the actress had given both warhols to the school in her will. late last week the jury ruled the school could get one and he gets the other. >> it's a long trial and we're extremely pleased that the jury did the right thing. >> the trial but the turbulent relationship under the microscope but friends of

fawcett's, including jacqueline smith, stood by ryan o'neal. >> i know my friend and i love my friend and i need to support ryan because that's where her heart would be. >> a surgical procedure prevented him from being in court to hear the jury's 9-3 decision in his favor but fawcett's two sons were there. they expressed relief. >> hopefully your mom can rest in peace. >> exactly. i know she had something to do with this up there. >> well, ryan o'neal is with us exclusively along with his attorney. martin singer. good morning to both of you. >> good morning. >> ryan, you were having surgery the day the verdict was read. can you take me back, though, to the moment you found out. i know you got a call from your son. what was your reaction when you found out this portrait will stay with you and your family. >> my son patrick called me from the courthouse. he texted me. i was lying on an operating table. there was blood running down the side of my face and then there were tears running down the side

of my face, mixing with the blood. it was a pretty amazing moment for me. >> well, you testified very emotionally in this case. you said there were times you even talk to this portrait. it does seem it's more than an object to you. >> well, i talked to her this morning about doing your show. she said i could do it. >> you asked her permission? >> yeah. >> it's that real to you, is it? this is the way you're keeping her memory alive? >> it seems to have developed over the years. i had her in my home for 18 years, the painting. but when she died, both paintings were in her home so the university of texas felt that they belonged to the university and i had said, no, no. one is mine and that's why we went to court. and they brought a big set of

guns here to fight me. but i had martin singer who is the finest litigator in the country on my side and we prevailed. >> ryan, let me ask you because i have been following the case and reading about the case and one of the questions i had was how it is that farrah didn't make it more explicit that she wanted you to have the portrait. she had a will. she left you out of the will. there was testimony in the trial that she asked friends to put post-it notes on things they wanted to keep. why didn't she make it clear she wanted you to have that portrait? >> well, because the will that -- the living trust went into action when she died she had not completed it. she had done one pass at it. it wasn't -- and she didn't have to say anything about the portrait being mine because it was mine, you see? from the day we got them. one was mine and one was hers. she wouldn't have mentioned that

anyway. this was a long shot for texas to do this, i felt. they didn't really have a case. >> and what motivated the university in your mind? >> oh, i have enemies and one of them sent 90 e-mails to the regents there and said i stole it. and that it was worth $30 million and i stole it and they should come and get it and they finally decided they should come and get it. >> nobody knows what this portrait is worth. it probably is in the multimillions of dollars. put you said this portrait is strictly sentimental value to you. a lot of people look at the value of this and start to do the math. are you saying you'll never sell this portrait? but keep it in your family forever. >> it will never be sold. it will go on to her son redmond and his children. and his children, like that. it was always invaluable to us.

she was a wonderful woman. and this is what was left. that's all that was left. >> this trial dredged up a lot of unpleasant memories. some of the moments from your relationship all came into the trial and were part of the testimony. when you think about that and having to go through that, was it worth it to dredge all of that up? >> it was worth it, yes. i know that she would have said fight for me. fight for this painting. she would have told me that. and redmond and i discussed it and he said let's go get it. so we had martin here for help because it looked like it was going to be a tough case. and it turned out it wasn't. >> finally, to ask you personally, you mentioned your skin cancer surgery last week. you battled leukemia and prostate cancer. tell us how you're doing this morning. >> i'm doing fine.

is that what attracted you to it? >> absolutely. it's like an epic story. it's big. it's big ideas. honor, sacrifice, revenge, impossible love. but it's also very intimate. so that's probably what i really liked about it was the scale and then the human intimacy in the story. >> i think there is a little bit of something for everyone. there's the love and these big themes that are dramatic but it has a lot of really cool samurai sword fighting. >> yea, there's samurai sword fighting and ogres and creatures. it's great. >> you've done a lot of martial arts in films. but what did you have to do to learn how to do this? >> i had to learn to use the japanese long sword which i had never used. i love movie fighting and how emotional it can be. the struggle of it. the contact. the beauty. the physicalness of it.

we teamed with walmart to brighten the holiday season for special people. craig melvin is here with more. >> good morning, guys. the devastating imagines from the colorado flood this september are among the most heart wrenching of the year but we want to bring you more imagines from the flood zone. an incredible group of people going above and beyond to help one of their own. >> reporter: there are few things more peaceful than the moments after a fresh snow fall. john lived here for 25 years. it's moments like these he lives for but there's also moments he almost didn't live to see. september brought heavy rains to colorado. towns were flooded. roads washed away. landslides, homes destroyed. lives lost. it was a devastation many had never seen but john knew it too well. that's because john is a rescue worker. for 43 years he's been part of rescue teams around the country.

some say it's remarkable how often this father of two has been at the right place at the right time. >> it's whether you as an individual choose to get involved. and i just choose to get involved. >> reporter: but what happened to john in the early morning hours of september 16th was not a choice he would have ever made. >> you know, i prepared for emergencies of every scope for my entire life. i never could have pictured a landslide here. >> reporter: that evening as the soaking rains continued, john went into his backyard to inspect the hillside behind his home and noticed water gathering. >> i was trying to process what was happening. the ground started to rumble. before i turned around i knew what it was and saw a 20 foot deep wall of black. and you could see 80 foot long trees poking out of it and bolders the size of cars. >> reporter: john was swept away in a giant landslide of debris through his home and down the mountain.

>> i was panicked. to meet your end and know it's coming. >> reporter: the flood waters were below him, broken, battered and barely conscious. john remembered his police radio. >> does anybody copy? my name is john. i live in left hand canyon. i'm on a tree in the river. >> reporter: and one last barely radio audio recording. >> this will be my last transition. will you tell my children i love them. >> reporter: within moments his tree snapped but he survived. his home and belongings did not. buried under several feet of mud. john needed help. and then the help literally walked into his life. >> i heard a racquet coming up the canyon. they were jovial. they were healthy people marching up the canyon. >> reporter: the mud slingers are a group of volunteers organized through word of mouth

>> ratings gold. fantastic. >> we have a remarkable christmas story to tell you about. a little back story and then we'll show you. a woman died more than two years ago. died of cancer and she has given her husband, his new fiancee and that family a surprise christmas gift. she passed away in september of 2011 after a battle with ovarian cancer. she left behind four boys. a month before she died brenda wrote a letter to a friend who gave it to an iowa radio station instructing the friend to wait to mail it until her husband david had fallen in love again. so the station star 102.5 invited david who did get engaged into the studio last week. he had no idea what was coming. the radio station shared a letter with him. >> well, david, we told you we got a very special christmas wish and i have to tell you that since i found out about this i thought a lot about what i would do if i were in your position and i really don't know the
