holiday rush. at least nine deaths blamed on storms that produced everything from tornadoes to a dangerous ice storm. half a million people without power nationwide. >> by late last night, more than 700 flights had been cancelled. another 11,000 delayed. just in time for the christmas holiday. what do we have in store for today. >> today is mostly just rain. heavy rain at that across the southeast. but this whole storm system we saw everything with it and we had our fair share of wild weather this weekend. >> reporter: look out. holiday shoppers jump for cover as sheets of ice fall from the roof of an outlet mall. no one was hurt. fallen wires were the danger further north, an ice storm downed tree lines from the upper midwest to new england. 300,000 lost power in michigan alone. crews have been working in the bitter cold, temperatures in the teens to get the power back on. >> they bring in extra crews
from out of state. it's an effort to get them lined up where to go and what to do. >> reporter: five people drowned along washed out roads in kentucky while drivers in indiana abandoned their cars to rising waters. in hughes, arkansas they're picking up the pieces after a tornado touched down saturday. one person was killed and four were hurt. heavy winds caused gridlock at airports. departure boards lit up with delays and cancelled flights. 700 flights cancelled in all frustrating early holiday travelers. it's looking like christmas in sheboygan, wisconsin. the city got half a foot of snow. >> it's made it a nice setting for a white christmas. >> reporter: it was a completely different story along the east coast, record warm temperatures sunday in new york, philadelphia, and delaware. not exactly what skaters had in mind when they flocked to the rink at rockefeller center. >> i knew it was going to be warm but i didn't know it was going to be that watery. >> reporter: skating in short
sleeves days before christmas. >> i wish it was a little colder. >> still warm and rainy across rockefeller center but you can see across parts of maine and new england, we have ice. that's the biggest concern this morning. the potential to a quarter inch to half an inch of ice. but elsewhere, heavy rain, perhaps a couple of inches of rain but then as we go into the holiday we're looking for things to clear out. in fact, tuesday, christmas day itself, looks a whole lot better. >> dylan, thanks. the burst of summer leading us back to reality. thanks. today is an important deadline for president obama's health care law. meantime he is on vacation in hawaii. last night the first family took a little time to enjoy a college basketball game coached by the first lady's brother craig robinson. nbc's white house correspondent peter alexander is traveling with the president. good morning. >> reporter: good morning to
you. here we like to say aloha. they say the website can handle any last minute rush of consumers but there's a deep concern, especially among health care advocates that the word may still not be getting out to the people that need the coverage the most. after a tortured roll out, today's the first real deadline. the last day to enroll for health care beginning january 1st. >> how many people sign up by december 23rd will be the first true test of how well the law is working and in particular how well healthcare.gov, the federal website is now functioning. >> reporter: on social media, a final push. this holiday inspired tweet from the washington d.c. exchange. instead of socks or an ugly sweater, how about health insurance for christmas. and as anticipated, a last minute spike in demand. when we called this weekend, a nearly two hour wait. >> your estimated time is 105 minutes. >> reporter: the president said more than 1 million americans already enrolled but that's far shy of the 3 million plus the
administration hoped to have signed up by this point. but experts say who enrolls is more important than how many.w . emphasizing the need to get enough young healthy people to balance the costs for older and sicker americans. a series of late changes have complicated the process including the administrations latest move allowing more flexibility for the millions that got cancellation letters. some democrats have repeated their calls for a one-year delay warning obamacare could collapse if the problems continue. >> if it's so much more expensive than what we anticipated and the coverage isn't as good as we had, you have a complete meltdown at that time. >> reporter: still uncertain is how many americans will pay their premiums before the end of this month. they need to do that for their coverage to begin. the white house has encouraged insurers to give a short grace period and most insurers have agreed to that. >> all right. peter alexander among the palm trees for us this morning.
thanks. new fall out from the massive data breach at target. there's growing calls for a government investigation and according to the "wall street journal" sales at the retail giant dipped slightly over the weekend. nbc's kerry sanders is at a store in florida live this morning. what's the latest there? >> target is now in full damage control as many of the customers are angry, frustrated, and understandably worried. >> reporter: with two days to go before christmas, the giant data breach at target could not have come at a worse time. and shoppers are worried it's a trend. >> i think i'll start using cash. >> reporter: making matters worse for some rushing to complete their holiday purchases, jp morgan chase is putting a daily cash limit of $100 and spending limit of $300 on about 2 million cards that could be susceptible to fraud.
on sunday, the new york senator chuck schumer called for a full investigation by the consumer financial protection bureau. >> by revealing the information, it will enable other stores to learn from this experience. >> reporter: target is offering discounts and apologies and promising customers zero liability for any charges that you didn't make. plus free credit monitoring to everyone impacted. but some customers are still angry. one writing on facebook, no more shopping at target for me. done. others say target should not be blamed. >> you can't just say you're going to be scared to shop at target because this could happen anywhere. >> reporter: many security experts agree that it's unfair to blame the retailer. >> target has spent a lot of money on payment card security and they were compliant with all the latest security standards. >> reporter: but experts say those standards are antiquated,
the u.s. relies on easy to copy magnetic strips to hold account information rather than more secure digital chips used in most other countries. so far, no one has detailed exactly how this happened. >> chief suspects would be sophisticated organized criminals that have studied target or insiders with privileged access that know exactly where to go. >> reporter: security experts are warning this morning that if you get an official looking e-mail from your bank, don't follow any links on that e-mail and then start providing personal information because it may be a so-called phishing scam where somebody is trying to steal your identity. savannah. >> unfortunately a lot of people oking to seize this opportunity. kerry sanders, thank you. >> natalie is here with breaking news in a case we have been following a couple of years now. >> good morning. two russian punk band members jailed over a protest in moscow were released from prison early under an amnesty deal. jim maceda talked to one of the band members earlier. he is in russia with the latest.
>> reporter: that's right. maria alyokhina was released from a prison much closer to moscow than we are here in siberia where her fellow member was released just this evening. both are mothers of young children. maria told reporters she was feeling physically and mentally okay as she left prison with her lawyer. she now wants to pursue a human rights career and lost no time today meeting with a local chapter of the committee against torture adding that she's not afraid to do anything anymore. meanwhile, nadezhda told me in that interview she is joining maria in a human rights career as well. she thought that the pardon that freed her was an act of weakness on the part of president putin because it came with a few months to go in her jail term. she can't wait to go home and bond with family and friends and all of those that got her through what she called a
nightmare. jim maceda, thank you. some passengers willi be lae getting to their destination. the flight was headed to atlanta. no confirmation it was weather-related, but bad weather has hampered travel in and around the area over the weekend. lots of concern, but fortunately no injuries. and frightening moments for passengers in south africa. you see the wing of the british airlines jetliner that into the building of the airport in johannesburg. all 182 passengers got off safely. investigation is underway. former basketball star dennis rodman did not meet with kim jong-un. he arrived in beijing today

right knee there. no problems what so ever. she is close. she is in touch here in this one. >> but about halfway through her run she lost herbal. >> oh, ouch. >> and there you saw it, the knee. no stability what so ever. >> vonn skied out after missing a gate. hunched over in pain but still standing and then skied to the finish. >> i was going fast and i hit a compression and my right knee just didn't hold up. it gave out and i tried to pressure again and it gave out again. >> with less than o two months until the olympics it's a painful set back. >> well, you know, it's -- yes, i am. i guess i am suffering a little bit. >> suffering but still olympic bound. >> she was very close to the fastest time before going out so the answer is yes, she can compete for a medal. >> vonn has not ruled out further competition.

we're going to talk to ryan in a moment. first the back story. for ryan o'neal this andy warhol is as personal as valuable. an iconic image of his long time love, the late farrah fawcett. but the silk screen has been hanging in limbo while a jury decided whether it belonged to o'neal. he removed it from faucet's home in 2009. we have been watching the case. >> it was his idea to get paintings made. he knew andy warhol. they were handed one to him and one to her. >> fawcett's alma mater, the university of texas claimed the actress had given both warhols to the school in her will. late last week the jury ruled the school could get one and he gets the other. >> it's a long trial and we're extremely pleased that the jury did the right thing. >> the trial but the turbulent relationship under the microscope but friends of
fawcett's, including jacqueline smith, stood by ryan o'neal. >> i know my friend and i love my friend and i need to support ryan because that's where her heart would be. >> a surgical procedure prevented him from being in court to hear the jury's 9-3 decision in his favor but fawcett's two sons were there. they expressed relief. >> hopefully your mom can rest in peace. >> exactly. i know she had something to do with this up there. >> well, ryan o'neal is with us exclusively along with his attorney. martin singer. good morning to both of you. >> good morning. >> ryan, you were having surgery the day the verdict was read. can you take me back, though, to the moment you found out. i know you got a call from your son. what was your reaction when you found out this portrait will stay with you and your family. >> my son patrick called me from the courthouse. he texted me. i was lying on an operating table. there was blood running down the side of my face and then there were tears running down the side
of my face, mixing with the blood. it was a pretty amazing moment for me. >> well, you testified very emotionally in this case. you said there were times you even talk to this portrait. it does seem it's more than an object to you. >> well, i talked to her this morning about doing your show. she said i could do it. >> you asked her permission? >> yeah. >> it's that real to you, is it? this is the way you're keeping her memory alive? >> it seems to have developed over the years. i had her in my home for 18 years, the painting. but when she died, both paintings were in her home so the university of texas felt that they belonged to the university and i had said, no, no. one is mine and that's why we went to court. and they brought a big set of
guns here to fight me. but i had martin singer who is the finest litigator in the country on my side and we prevailed. >> ryan, let me ask you because i have been following the case and reading about the case and one of the questions i had was how it is that farrah didn't make it more explicit that she wanted you to have the portrait. she had a will. she left you out of the will. there was testimony in the trial that she asked friends to put post-it notes on things they wanted to keep. why didn't she make it clear she wanted you to have that portrait? >> well, because the will that -- the living trust went into action when she died she had not completed it. she had done one pass at it. it wasn't -- and she didn't have to say anything about the portrait being mine because it was mine, you see? from the day we got them. one was mine and one was hers. she wouldn't have mentioned that
anyway. this was a long shot for texas to do this, i felt. they didn't really have a case. >> and what motivated the university in your mind? >> oh, i have enemies and one of them sent 90 e-mails to the regents there and said i stole it. and that it was worth $30 million and i stole it and they should come and get it and they finally decided they should come and get it. >> nobody knows what this portrait is worth. it probably is in the multimillions of dollars. put you said this portrait is strictly sentimental value to you. a lot of people look at the value of this and start to do the math. are you saying you'll never sell this portrait? but keep it in your family forever. >> it will never be sold. it will go on to her son redmond and his children. and his children, like that. it was always invaluable to us.
she was a wonderful woman. and this is what was left. that's all that was left. >> this trial dredged up a lot of unpleasant memories. some of the moments from your relationship all came into the trial and were part of the testimony. when you think about that and having to go through that, was it worth it to dredge all of that up? >> it was worth it, yes. i know that she would have said fight for me. fight for this painting. she would have told me that. and redmond and i discussed it and he said let's go get it. so we had martin here for help because it looked like it was going to be a tough case. and it turned out it wasn't. >> finally, to ask you personally, you mentioned your skin cancer surgery last week. you battled leukemia and prostate cancer. tell us how you're doing this morning. >> i'm doing fine.

jp morgan chase is halting cash withdrawals at $100 a day along with a $300 spending limit. these are for those exposed to the data hacking. a space walk for today was postponed until tomorrow because of a problem with the space suit. the american astronaut accidentally turned on a water switch during saturday's space walk compromising his suit. he will need an extra day to get a spare space suit ready to go. he and fellow astronaut michael hopkins are expected to complete the repair on a leaking cooling line on board the international space station. now to a touching story, an iowa man has gotten a very special christmas gift from his wife two years after she died of cancer. mike tells us about a testament to the lasting power of love. >> reporter: all he knew was that he had been singled out as part of a popular decades old

is that what attracted you to it? >> absolutely. it's like an epic story. it's big. it's big ideas. honor, sacrifice, revenge, impossible love. but it's also very intimate. so that's probably what i really liked about it was the scale and then the human intimacy in the story. >> i think there is a little bit of something for everyone. there's the love and these big themes that are dramatic but it has a lot of really cool samurai sword fighting. >> yea, there's samurai sword fighting and ogres and creatures. it's great. >> you've done a lot of martial arts in films. but what did you have to do to learn how to do this? >> i had to learn to use the japanese long sword which i had never used. i love movie fighting and how emotional it can be. the struggle of it. the contact. the beauty. the physicalness of it.
so that was a really fun part of the show. >> can i ask a dumb question? are you doing that with real swords? >> yeah, you use wood. but eventually you have to go to steel and that's when you have to control the heart rate. you want to be a little more focused because if you miss it can go really wrong. >> well, it's really exciting to watch and i was thinking about you because honestly we don't see you that often. you're choosey about your projects. is that on purpose? is that by stedesign? >> yeah. you want to find the right project. yeah. i can just say that. >> has there ever been one you said no to and you thought, i let that one pass me by. >> the heartache and regret? yes but i can't talk about it. it's too painful. >> i can bring a couch out. >> do we have time for that.

we teamed with walmart to brighten the holiday season for special people. craig melvin is here with more. >> good morning, guys. the devastating imagines from the colorado flood this september are among the most heart wrenching of the year but we want to bring you more imagines from the flood zone. an incredible group of people going above and beyond to help one of their own. >> reporter: there are few things more peaceful than the moments after a fresh snow fall. john lived here for 25 years. it's moments like these he lives for but there's also moments he almost didn't live to see. september brought heavy rains to colorado. towns were flooded. roads washed away. landslides, homes destroyed. lives lost. it was a devastation many had never seen but john knew it too well. that's because john is a rescue worker. for 43 years he's been part of rescue teams around the country.
some say it's remarkable how often this father of two has been at the right place at the right time. >> it's whether you as an individual choose to get involved. and i just choose to get involved. >> reporter: but what happened to john in the early morning hours of september 16th was not a choice he would have ever made. >> you know, i prepared for emergencies of every scope for my entire life. i never could have pictured a landslide here. >> reporter: that evening as the soaking rains continued, john went into his backyard to inspect the hillside behind his home and noticed water gathering. >> i was trying to process what was happening. the ground started to rumble. before i turned around i knew what it was and saw a 20 foot deep wall of black. and you could see 80 foot long trees poking out of it and bolders the size of cars. >> reporter: john was swept away in a giant landslide of debris through his home and down the mountain.
>> i was panicked. to meet your end and know it's coming. >> reporter: the flood waters were below him, broken, battered and barely conscious. john remembered his police radio. >> does anybody copy? my name is john. i live in left hand canyon. i'm on a tree in the river. >> reporter: and one last barely radio audio recording. >> this will be my last transition. will you tell my children i love them. >> reporter: within moments his tree snapped but he survived. his home and belongings did not. buried under several feet of mud. john needed help. and then the help literally walked into his life. >> i heard a racquet coming up the canyon. they were jovial. they were healthy people marching up the canyon. >> reporter: the mud slingers are a group of volunteers organized through word of mouth
with a singular task. bring help to whomever, where ever, and how ever. >> we didn't know what we were doing at all. none of us do this for a living but i didn't stop to worry about the how. none of us did. we figured this out as we went. >> reporter: they gave him something he never thought he would find again, hope. >> on this way we wanted to give something back to the mud slingers too. >> big hand first of all. and tis the season to recognize extraordinary groups doing extraordinary seasons. >> we are giving you $10,000 in walmart gift cards to help you continue helping others. >> wow. >> reporter: but what john didn't know is we had a surprise for him too. >> you're an amazing guy. you have spent the better part of your life doing the same thing as these guys so we wanted to help you get back into the business of helping others as well. >> pull back the curtain.

>> i think it's a tie. i really couldn't come up with one. i think gravity, the amazing movie with sandra bullock. she is lost in space. this succeeded on every level. it was a technical achievement. just a game changer in the way the director got them to float in space. an artistic success and it's a nail biter of a thriller. it's really awesome. >> the other one is? >> the other one is "12 years a slave." it's a game changer. the bar has been raised. >> a couple of movies we'll be hearing a lot about an award season here. >> the worst movie of the year, what is it? >> the counselor. now you may not have heard of this film which is surprising because it was directed by ridley scott. it starred brad pitt, penelope cruz. >> what happened here? >> it was completely nonsensical. you couldn't follow it even for a second and it was as if it was
put together by a dirty minded 14-year-old boy who was drunk. it was really, really staggering and cameron diaz makes love to the windshield of a car. >> they're going to put your characterization on the tv box. >> let's talk about best tv show. breaking bad. >> breaking bad. the greatest finale in the history of television. not only did they fulfill the promise of we're going to watch him turn into scarface which is what vince gilligan wanted to do but they succeeded so beautifully and the pay off was so great i. was so great that as much as you loved the show, by the end of it you didn't want anymore because you saw it end exactly the way it should. >> pretty extraordinary. >> i'm on worst duty. what was the worst show of the year? >> the worst show, i hate to say it because we kind of like him,
what would ryan lochte do? it didn't have any redeeming value. the show just set out to make you feel like, wow, that guy is stupid. that's sort of the moral to every episode. wow, he's stupid and i don't think that he is, he is clearly a fantastic athlete not shown in his best light in this show. >> short lived show. >> it was. >> best music of the year. >> greatest moment in music was beyonce. toward the end of the year, just last week. dropped this album. no advanced buzz, no advanced publicity. only one or two stars on the planet has the power to do that. immediately a million downloads. the songs are rich. they're beautiful. they're very edgy. you're not going to hear them in church. but they are really -- it really is an artistic achievement this album and she did all of the videos with it as well. the videos are gorgeous. really an amazing achievement.

>> ratings gold. fantastic. >> we have a remarkable christmas story to tell you about. a little back story and then we'll show you. a woman died more than two years ago. died of cancer and she has given her husband, his new fiancee and that family a surprise christmas gift. she passed away in september of 2011 after a battle with ovarian cancer. she left behind four boys. a month before she died brenda wrote a letter to a friend who gave it to an iowa radio station instructing the friend to wait to mail it until her husband david had fallen in love again. so the station star 102.5 invited david who did get engaged into the studio last week. he had no idea what was coming. the radio station shared a letter with him. >> well, david, we told you we got a very special christmas wish and i have to tell you that since i found out about this i thought a lot about what i would do if i were in your position and i really don't know the
answer to that. but we want to share it with you. >> she was very strong. accepted what happened to her. and since she has been gone, she has shown a lot of signs that she is still here. >> hello. my name is brenda. when you are in receipt of this letter i will have already lost my battle to ovarian cancer. >> we want to grant brenda's wish. we are going to send you and your family to disneyworld. >> oh my god. >> so unbelievable. now brenda asked for three wishes. first was for her husband's new partner to get a day of pampering. so taking care of his new partner. amazing that she would do that. second, the magical trip to disneyworld for the whole family and third a night out for her cancer doctors at mercy medical
center where she was treated for all of those years for ovarian cancer. that's what the holidays are about. that's amazing. >> how about her in her final hours thinking of everyone but herself. she apologized for having to type the letter but her hands were getting too shaky and she couldn't write it. but she was thinking about a fiancee that wasn't there yet and all the doctors at the hospital. >> and now they're going to be a family of six kids. >> yeah. >> so great that they can share in the love. >> yeah. >> and continue the family on. >> beautiful. beautiful story. >> well, here is an unusual proposal that we saw over the weekend. a juno woman had an unexpected christmas gift delivered while she sat on santa's knee in the north pole in alaska. >> in alaska north pole. >> yeah vmt take a look. >> what do you want for christmas? >> a new pair of running shoes? >> how about a wedding. >> oh, that would be nice too.

good monday morning to you. it's 9:56. i'm peggy bunker. the family of a 13-year-old oakland girl being kept on life support will hold a march this morning. jahi mcmath had tonsil surgery at children's hospital oakland two weeks ago but was declared brain dead days later. today a judge is expected to appoint an independent doctor to evaluate the girl's condition. outside, a group of faith healers led a rally and sent a letter to the d.a.'s office demanding for a formal investigation of the hospital. they're also accusing doctors and administrations of being insensitive to the family. no, no.
it represents a lack of sensitivity. >> a hospital spokesperson denies those words were ever spoken but said the doctors did make it clear that in their opinion jahi is dead and there's no chance her brain will, quote, restart. investigators are also looking for the person who tossed a severely injured 10-week-old puppy into the trash. the dog was found on a conveyor belt at the san francisco dump on friday. the city's animal care and control took the tiny poodle in and nicknamed her gem. she's expected to survive. probably a long line of people waiting to adopt her. let's get a look at the forecast. anthony slaughter is here with that. >> we're looking at clear skies across the bay area. those clear skies will continue all day long. no fog right now, but the haze will start to build. we have a spare the air alert in effect for today. definitely ma have to head outside and you have any respiratory ailments you take it easy and limit your time outdoors. otherwise, temperatures back from 65 degrees in san francisco to 70 in the north bay.

the bay bridge. police have not released any information about the victim other than this. he's 27 years old and in critical condition and is being uncooperative with authorities. no arrests have been made. there's no word on who the suspect might be. and it is the last regular-season game ever at candlestick park. for the past 53 years, this has been the home for many sporting events and concerts. kick-off between the 49ers and atlanta falcons is scheduled to begin at 5:30. big day there for folks heading out for the game. >> temperatures will be in the low 60s by the time we get to 5:00. that's really about 7 degrees above where we should be for this time of year. elsewhere, we're looking at mild conditions. a little cool right now. we'll eventually warm very quickly from about 65 degrees in san francisco to 70 in the north bay. even in the south bay, expecting to see record warmth in san jose. if we get to 68, that would break a record from 1901 of 67 degrees. very interesting day shaping up
