street on-ramp. there was a three-car crash blocking the on-ramp in the last 15 minutes. chp just got out there and cleared it. so you're good to go northbound 880 towards downtown oakland. and our bridges, very light traffic right now across the golden gate bridge. just did the lane change, as well. so looking good overall for this start to this tuesday morning. back to you. >> thank you. we have breaking news on the peninsula. firefighters are battling a warehouse fire. the fire broke out just before 3:00 this morning and has now gone to three alarms. this is on corey road, an industrial area of san carlos. it is a 15,000-square-foot warehouse. so far no word on how it started or any damage estimates. we'll follow this throughout the morning. also some breaking news in oakland. police investigating three more shootings, two of them involving police officers. police shot and killed a suspect on the trask street

about 9:30 last night. no word yet on why the suspect was shot. then earlier, a man opened fire on officers on sycamore street. no officers were injured. that suspect was later caught. and a man was shot to death on 81st avenue about 6:30 last night. no suspects in that case. the man accused of killing a bay area woman in her apartment faces a judge this morning. let's go to sharon chin in san francisco, with why prosecutors are calling this suspect a true predator. sharon, good morning. reporter: good morning, sydnie. the suspect is in the county jail. he has been in the psychiatric ward and he is due to be arraigned in san francisco in the courts this morning. the suspect, gary scott holland, was charged yesterday with murder, burglary, robbery and attempted rape. prosecutors say the 43-year-old man was on parole for a 1999 attempted murder conviction in fresno when he allegedly posed as a utility worker to get inside a woman's apartment last

month. police say he claimed he was checking on a gas leak when 46- year-old kathleen horan opened the door to her russian hill apartment. officers say she was robbed and killed. district attorney kamala harris says holland preyed on people's fears of gas leaks after the san bruno explosion. >> this defendant was a true predator and put himself out in a position of trust to this victim so she opened that door. any one of us might have done what she did that day. and in the end, what we know is that this predator is going to pay the price for his crime. >> reporter: holland has been in trouble before. he was in prison for 13 years for attempted murder and burglary in 1999. police said he had attacked his stepmother with a knife in fresno. he was paroled to san francisco to be far away from the victim. authorities say he was a high risk offender who completed a substance abuse program and was seen regularly by his parole

officer without violations. he is scheduled to be arraigned here this morning at 9:00 at st. francis superior court. >> thank you, sharon chin. a legal setback for republican david harmer who is challenging democratic congressman jerry mcnerney in the 11th district. the latest count shows harmer trailing by just 624 votes but yesterday, a superior court judge rejected harmer's request for a temporary restraining order on the counting of mail- in votes in contra costa county. harmer has expressed concern about how signatures were verified. and in the race for state attorney general, the latest numbers show republican steve cooley keeping a razor-thin lead. the los angeles county district attorney is facing democrat kamala harris, the d.a. in san francisco. the ballot counting continues statewide. well, it could be a while before the people of oakland know who won the city's mayoral race. that didn't stop city council

member jean quan from holding her already planned victory party last flight. she currently leads former state senator don perata by about 800 votes. but the ballot counting process has been complicated by oakland's new ranked choice voting system and instant runoff. with ballots still being counted, quan admits the race could still go either way. >> obviously, we were hoping tonight would be a celebration. but we'll have to wait maybe until wednesday or friday before we get the final count. but we're still very optimistic. >> initial counts showed perata ahead but quan took the lead when the county ran the ranked choice calculations which take second and third choice votes into account. now, perata's campaign sent cbs 5 this statement yesterday evening:

o ning.. and has you're looking at live pictures of a warehouse fire in san carlos breaking out just before 3 a.m. this morning. we have been told it's gone to three alarms. this is on quarry road which is an industrial area of san carlos between 101 and el camino real. this is a 15,000-square-foot warehouse. we're hearing that there may be musical instruments inside. right now, no word on damage at that warehouse fire in san carlos. the oakland city council is expected to take a final vote on a plan to allow four warehouse-sized marijuana farms. that's despite last week's election when california voters rejected proposition 19. the measure would have legalized recreational use of pot under state law. the facilities considered in oakland would process marijuana for medical use which is legal in california but not under federal law. >> the law is the law and if

you get caught with thousands of plants by the federal government, regardless of how bankrupt their position is, you're still going to go to prison for at least 10 years. >> the city's interest in the pot business is all about money. the big farms would pay $211,000 a year for fees and for every thousand pounds, they would pay $50 in taxes. governor schwarzenegger says no one cares if you smoke a joint, he told jay leno last night. he was defending alaw he signed five weeks ago that makes the punishment for possession a small amount of pot the same as a traffic ticket but the governor told leno he thinks prop 19 would have gone too far. it's been around for nearly a century. but this week, the presidio fire department will be history. the fire station shutting its doors tomorrow. the san francisco fire department is taking over the fire station on the presidio

freeway towards the bay bridge and the macarthur maze. on the lower deck. bay bridge on the decline section, still a little bit of roadwork until 6 a.m. various lanes could be blocked. but again, no delay heading into oakland. and westbound 80 looks great all the way into san francisco. on the nimitz freeway we had an early-morning problem. the davis street on-ramp was closed for a while after a three-car crash. chp was able to clear that accident in san leandro very quickly and northbound 880 great all the way up towards downtown oakland if you are coming up from hayward. san mateo bridge westbound 92 we have a live camera just past the toll plaza. the right side of your screen is the westbound commute direction. right now clocking in around 13 minutes to take you toward foster city and the peninsula. and eastbound traffic looks great off the high-rise. here's some of our more popular routes for this time of the morning for the east bay. westbound 580 in the clear right now. 14 minutes from the altamont pass to the dublin interchange. much better than yesterday after we had that accident approaching the dublin interchange. and nimitz freeway again 15

one of neil young's prized possessions may have gone up in smoke. holly quan reports from the location. >> reporter: good morning. this is a three-alarm fire that broke out just before 3:00. there were huge flames and smoke that came from this single story metal warehouse on corey road between harbor and industrial about a quarter block down from the elevated train tracks in san carlos. the fire is out, they have overhauled it. there was some smoldering things inside but the fire marshal did tell me that when he was inside, he did see some musical instruments and later confirmed that some of these things do belong to bay area music legend neil young. we are still waiting for information with regard to what other things may have been inside. we hear from some of the people around here that there was a warehouse that was stacked full of belongings. we don't know if it was just his or other people as well but it was a private warehouse storage facility. still waiting to get details on

what else is inside. >> holly, has it spread to other buildings? >> reporter: it looks from the street here the -- warehouse is setback from the street? it looks like it's just that one warehouse, lot fire marshal did say there -- although the fire marshal did say there were some other adjacent buildings involved, although it is primarily one warehouse building. you can't really see from here whether damage spread to the other buildings but he said it's primarily just that one. >> a lot of instruments in there or do we know? >> reporter: i did ask him. he didn't give me any details on, you know, how many or what. it's a very large warehouse, from what i understand it's a private warehouse which may have, you know, other people's stuff in there so we are waiting to hear back from the fire marshal who is going inside with details. we'll have more later on. >> thank you, holly quan live in san carlos. a free health clinic opening in san francisco today. you can find clinic by the bay on mission street. now, it will be staffed mainly

by retired doctors, nurses and physician therapists. this clinic will offer services to uninsured residents in the excelsior and outer mission neighborhoods and parts of daly city. how clean is your local restaurant in there is a shortage of health inspectors so restaurants aren't getting examined as on as they should be. there are norm -- as often as they should be. there are normally 23 inspectors but there are only 19 now. the head of the health commission wants more help but there is a hiring freeze. >> have you ever had food-borne illness? i know i have and it's not fun. you get very sick for a short period of time. and it's hard to pin down exactly what caused it. >> the head of the health commission also wants restaurants to post health inspection score cards for customers to see. 5:22. how old is too old to drive? the new trend on the road and why some fear it's putting our safety at risk.

at midnight. the wait is over or the next chapter of call of duty a videogame that hit store shelves this midnight. thousands of people across the bay area lined up to be the first to get their hands on that new game. call of duty black ops expected to blow the doors off the videogame industry this year. >> they are clearly fans of the franchise. it's clearly struck a cord with them. they wanted to be involved in some way. that speaks to the over arching you know appeal of the game. >> so if anyone asks you at the water cooler today what it's about it is set in russia and vietnam and features cameos from kobe bryant and jimmy kimmel. it's rated mature for blood, gore, violence and language. 5:26. are you frustrated with muni? today the agency plans to address problems including constant service delays. the agency blames defective

software, mechanical problems and equipment failure. muni says it's currently working on repairs and service should improve this month. and concerns about aging drivers are growing as baby boomers get older. soon, more than one in five licensed drivers will be 65 or older. that's according to the national transportation safety board. the board says older drivers are likely to have medical conditions that can affect their driving. experts say keeping those drivers safe is going to be a challenge. >> have you had any experience with that, not being on older driver -- [ laughter ] >> i am getting older. >> , you know, i think they are just a little more cautious but, you know, if you're on a freeway and going a little bit slower -- >> have to watch out for them. >> i don't think it's just older drivers. using the turn signal is important. everybody should do that. our question of the day to you, though, should be there an age limit for older drivers? >> i didn't want to give an age limit. send your comments to mornings@cbs5.com. or you can post your answers on

industrial area. so far, no word on how that warehouse fire may have started. 5:31. she answered a knock on her door and was apparently killed for it. sharon chin is in san francisco where the man charged with killing a russian hill woman faces a judge this morning. sharon? >> reporter: good morning. the suspect is in county jail this morning and is expected to be arraigned this morning at san francisco superior court. gary scott holland faces charges of murder, burglary, robbery and attempted rape. prosecutors say the 43-year-old man allegedly posed as a utility worker to get inside a woman's apartment last month. he was on parole for a 1999 attempted murder conviction in fresno. police say he claimed he was checking on a gas leak when 46- year-old kathleen horan opened the door to her russian hill apartment. officers say she was robbed and killed, and he was arrested at a park a week later. district attorney kamala harris says holland prayed on people's

san francisco. we are also following some breaking news in oakland. police are investigating three more shootings, two of them involving police officers. police shot and killed a suspect on trask street about 9:30 last night. no word yet on why the suspect was shot. earlier a man opened fire on officers on sycamore street. no officers were hurt. and the suspect was caught later. a man was shot to death on 81st avenue about 6:30 last night. there are no suspects. police in the bay area have made dozens of arrests in a week-long sex trafficking sting. local law enforcement and the fbi working together to crack down on child sex trafficking. in the past week, they made 72 arrests and rescued children. 161 arrests in made across the u.s. the pg&e rep in charge of the smart meter program has

admitted he used a false name to join an online group critical of the program. the "mercury news" reports that he also secretly monitored other online forums critical of pg&e, which he admitted. he tried to join a google group for people concerned about electromagnetic radiation the moderator noticed that the email from someone named ralph came from the pg&e address. students and parents, get ready the uc and cal state university system want to raise tuition again. the uc by 8%, csu by 15% next fall. both schools are moving toward officially calling all that money tuition instead of fees. the insistence on calling it fees has been a joke on campuses for years. 5:35. let's get another check of traffic and weather. we are going to start with tracy because there could be rain in the forecast. >> good morning.

preference for senator perata for oakland's next mayor will hold true once every ballot is certified and counted." initial counts show perata ahead. there are no plans for a special election to replace mayor newson. he was elected lieutenant governor last week and according to san francisco's city charter, the board of supervisors will select a mayor. the next scheduled mayoral election in san francisco is next november. 5:39. an autopsy is planned to learn why a former san francisco police chief died. 60-year-old alex fagan collapsed yesterday after walking his dog in england. the "chronicle" records fagan was in london to visit his girlfriend. fagan became police chief in 2003 after he was cleared of wrongdoing in a fight involving a group of off-duty officers that included his son. fagan retired in 2004.

a quick visit to one of president obama's former homelands. the president and mrs. obama are in indonesia the second stop on his 10-day four-nation trip to asia. the president talked about the difficult times they are having in indonesia. >> first, the recent earthquake and tsunami. and now the volcanic eruptions. our thoughts and prayers are with those who have lost their loved ones or their homes. >> later this week, president obama will attend a g20 economic summit in south korea. first lady michelle obama will return home after the visit to indonesia. former president george w. bush's memoir goes on sale today. people have been in line for hours at a dallas bookstore where mr. bush will sign copies of the book this morning . it's called decision points. in it the former president lays out 14 separate decisions he made while in the white house. 5:40.

good morning. los altos hills. i don't normally mention debris because it's picked up quickly but a dead deer is blocking the right lane on a blind curve so this is northbound 280 approaching el monte road. another car presumably the car that hit the deer is also off to the shoulder. no slowing, but 101 is also moving fine through that area. all along the peninsula fine towards san francisco.

north- and southbound traffic moving great plenty of space between cars in and out of san francisco. 280 looks good except for that deer in lanes in the los altos hills. bay bridge no problems on any of your approaches. still seeing top speeds no delays through the caldecott tunnel on westbound 4. bay bridge no metering lights. they may be turned on in an hour or so. no delay right now. there is a little roadwork on the lower deck on the decline section of the bridge until 6 a.m. various lanes could b blocked, but light traffic no problems. silicon valley looks great. no big hot spots so far this morning. westbound 237 drive time for that stretch right now 6 minutes on westbound 237 from milpitas towards 101. golden gate bridge they did the lane change around 5:00 this morning now 4 lanes of traffic open heading into san francisco into southbound 101 and the whole stretch of your marin county drive light.

commute is rolling along. >> it's rolling along quite nicely, actually. we have seen no major problems. there have been no hot spots since we got on the air at 5:00 which has been a nice change. it's been a busy week as far as the commute goes. it started last week and yesterday, it was a rough ride especially on westbound 580 out of the altamont pass. nothing like that this morning. here's a check of our marin county ride. this is traffic on northbound 101 near 580. our camera just froze. the caltrans camera. it's hit or miss but you can see that traffic is light along the stretch of north- and southbound 101. in fact, it moves well all the way through the waldo grade if you are heading towards the golden gate bridge. no problems across the span. no problems on any of our bridges. that was the golden gate. let's take a check of the san mateo bridge. right now, it is starting to get busy. it's definitely busier this is traffic shot than a half hour ago when we first showed it. this is westbound 92 the commute direction but still steady around 14 or 15 minutes in the westbound lanes to take you towards the peninsula. eastbound traffic against the commute looks good.

in the south bay we are still moving fine on all our major freeways through the area a little bit of slow traffic now on northbound 101 coming into san jose. you will also notice that sharks symbol. sharks take on anaheim at hp pavilion at 7:30 tonight. so may find delays there. downtown northbound 280 looks great. mass transit is still on time for bart, ace, muni, cal-tran, you name it, mass transit is on schedule. that's your traffic. here's tracy with your forecast. hey, thanks, elizabeth. so here we are, tuesday morning, and we got a pretty decent day expected. boy, isn't that a nice shot? looking out toward the bay bridge. not a whole lot of clouds here in the bay area. and look at that. doesn't that look nice? temperatures are pretty chilly inland this morning. we had a frost advisory that's been cancelled so no longer expecting freezing conditions inland like the valleys or the mountains. here's a look at what's going
