for another day, ken. we'll have more post game coming up later. >> murphy is a good guy. thank you dennis. we're following breaking news not far from at&t park. police have shot and killed a man. it started when police came across a group of men trying to break into a car. kate. >>reporter: liz, that's right and investigators will be monitoring surveillance video in the area, but asking anyone here who might have take not any cell phone video to please turn it into police. let me tell you what we know so far. officers were here doing what police call suppression because of the amount of people and the cars in the area. one officer noticed a car with three people inside and he started to follow it at third and bryant and the suspects got out of their car and officers washed them burglarize a mercedes suv. >> they were going in no particular area and circling the neighborhood which is a common

behavior for folks looking for an opportunity engage in perhaps criminal conduct. >> the suspects got back in their car and the officer moved in to arrest them and that's when the driver saw the officer and pointed a hand gun at him. and the officer told him to put it down and he didn't listen and the officer shot him. the passenger in the backseat was hit and the third person in the car ran away, but officers caught up to him. you're getting a live look and roads are blocked up in this area and the driver and the passenger were taken to san francisco general and the drive are did not make it and we just learned that the passenger have non threatening injury and the police will be ready to interview that passenger when he recovers. we have breaking news out of yosemite. a plane crashed and

burst into flames near highway 140. the air tanker was fogging what's called the dog right fire. andrea is standing near the crash site. >>reporter: here watched in horror as the plane crashed trying to put out that fire. an hour ago, we learned that emergency crews finally reached the crash site and the only person onboard that plane tonight is dead. >> series of picture after the wreckage -- the crash site is near a 2500 foot cliff. witnesses said the plane looked like it went out of control, and came straight down. >> we immediately dispatched out emergency personnel onto a location where we had last contact with that aircraft.

the year where the aircraft was last seen is difficult to to make access to. >> the fire has burned 150 acres and homes have been evacuated and so far no homes were damaged. the one killed in the crash -- they have asked that his name is withheld until his family is notified. >> that tanker -- that crash looked just leak this one. this is s2 tracker, cal fire has 26 of those air planes and the oldest is 60 years old. >> the last time an air tanker crashed was in 1992. that's a picture. it was an ac 130 as a pilot was trying to pull up and

the plane went plummeting into the ground. three pilots were killed. we got an e-mail from viewers about a site in martinez. chris ramirez went to check it out. kristin. >>reporter: lots of e-mail s s asking what is going on in the refinery. if you you look over my shoulder, you can see the lights and those are flaming. it appears to be what refinery is called flaring and that's a way to burn off excessive gas when they have to shut off gas from a refinery. we do have reports that there is a planned maintenance shut down coming up for this refinery which makes sense. we did check in with the county fire tonight and they have good news.

say considering the number of people getting in and out of the stadium, they think that they have done a good job. tonight police believe the same two guys could be behind thefts at several warehouses last weekend making off about millions of dollars worth of electronics. surveillance video shows the men in action off off good road and fremont and the owner says the crooks got away with $150,000 of i-pads and camera. they hit that place twice in one night. look at this surveillance video we got from a viewer. a man sneaking into a warehouse in berlin game and it looks like the robber in fremont. a reward is offered for their capture. we're getting a look at

distracting driving. >> call john dough's home. >> researchers were asking about the voice only command system caused drivers to get distracted and the answer is yes. one driver in a simulator gets so distracted, she rear ends a car in front, but the biggest problem is not the driver. the study concludes that errors made by the system causes distractions. this driver asked siri to call a restaurant. in the driver's frustration, she misses a prompt that measures her attention to the road. >> you'll be paying attention to that and not paying attention to traffic lights and other cars. >> some users say they had a

unbelievable story. a san jose home goes up in flames and a man escapes and realizes his dogs are still side. >> he has to make a decision and mark kelly tells us what happens. >> i hear "fire, fire." >> she says three people escaped and watched as the home burned down, but one problem, their poodles were trapped inside and this video captures this man risk his life to save the dogs. >> he's calling the dogs and they didn't want to come out. >> come here.
