(pam) tonight, we are just eleven hours away from a verdict in the sierra lamar murder trial. hello -- i'm pam moore.(steve) and i'm steve aveson. the jury reached a decision today.... deliberating for less than two days after the 13 week trial. 15-year-old sierra lamar vanished back in 2012. the morgan hill cheerleader was last seen on her way to school.... her body has never been found.(pam) despite that -- prosecutors say, d-n-a evidence proves, she was killed by this man -- antolin garcia torres. his defense attorneys have argued -- sierra lamar is not dead -- just missing.(steve)

wasn't found the jury could possibly find defendant antolin garcia torres innocent of murder.steven clark, legal analyst and former prosecutor "and that could explain why this jury came back quickly if they don't believe the prosecution was able to prove that sierra lamar is dead then they really wouldn't reach a verdict on a homicide." the defense however has pointed to dna evidence found on garcia torres 's property like a rope in his car. "what they were able to show with the forensic evidence and the defendant's own statement is that he had the opportunity to commit this crime and there was never a definite explanation for that dna transfer."and although 11 hours of deliberation may sound like a long time to the average person - the analyst says that is pretty quick for a decision in a trial that started back in january."there was competing evidence on virtually every aspect in the case. from the forensic evidence to the defendant's statements to the issues of sierra lamar being a runaway. i'm surprised the jury was able to condense that and come to a verdict so quickly." if garcia torres is found not

"had i known that my daughter was beat up like that, i would've been here quick and in a hurry."the sixth grader did tell her mother what happened, but when the video got posted on youtube she kept that to herself."people won't stop talking about it. who? everyone at school? everyone in my class."simms didn't know the video existed until sunday.she says her daughter"is fearful, scared to come to school, she wants me with her."a teacher at solano middle school told me she too had seen it.she called it 'assault,' and said she already had to discipline other students for having it or passing it around.the teacher also told me the attacker had been suspended for multiple daysbut áshe feels it wasn't enough.now simms is trying to bring the ávideo to the attention of the school and the district."i don't want her to be one of those that's trying to commit suicide."by law, the district has 15 days to acknowledge receipt of the complaint form simms is filling outand another 60 days to investigate it.in vallejo, spencer blake,

(steve) we are learning gruesome details about the murder of a castro valley woman... found dead inside her home. the alameda county sheriff's office say this man on your screen... luckie dacaney recently confessed to the brutal murder of andrea st. john police found the 59-year-old's burned body inside her castro valley home on grove... way back in december. investigators

say in addition to confessing to killing andrea st. john...video evidence also helped confirm the suspect's identity. "we were able to look at some video from the neighborhood and it looked like he was just walking around and just randomly picked this residence. we matched the video with a stolen vehicle that was also recovered" st. john... was a widow, mother and grandmother. the marin county county coronor.. accused of sexually assaulting a young girl, made his first court apperance today. this case dates back to 2008. that is when prosecutors allege ... darrel alan harris started sexually assaulting a girl... and then later again, when she was older. harris was arrested recently in eureka... and brought back to marin county. he is now in jail on 750- thousand dollars bail. harris' attorney and family believe the 46-year-old part- time photgrapher... is innocent. "i have not seen any reports, but i have spoken to a lot of people in the system . mr. harris is well known at the civic center. the unanimous reaction is shock and no one believes this to be true. harris did not enter a plea today... but will be back in court next week. (steve) we are learning more about two people killed in a plane crash near lake berryessa this morning... both are employees of icon aircraft operated out of vacaville. 55-year-old jon karkow was the pilot -- .and 41-year-old cagri sever was the passenger .. the crash happened just after 9-am between pleasure cove marina and markley cove resort. here is a map showing the area....the crash site was not accessible by vehicle... emergency responders got to the area by boat. no word yet why the single- engine icon a-5 plane crashed. drivers might not like... there is a proposal to turn highway- 37... into a toll road. kron4's charles clifford breaks down the potential plan -- and has reaction from commuters. well, 40 thousands cars use highway 37 every day. it connects marin, sonoma, napa and solano counties. but the traffic backups and frequent flooding have become a problem here. recent estimates have suggested it could take billions of dollars to fix thos issues. at this point, charging commuters a toll to address those problems is just an idea but one that is being seriously considered.for the past few years, a committee of elected officials from across the north bay has been working on finding ways to reduce congestion on highway 37 and address the flooding problems. under normal circumstances, it

could take caltrans years or decades to secure the necessary funding and fix the roadway but the committee says that charging tolls could be a way to speed up the process. maybe getting the work done in less than a decade.sotwe are at the beginning of this processmarin county supervisor damon connolly sits on the committee. he says that so far there are no specifics on how much the tolls would be or how that money would be collected.sotwhat we are seeing is some sort of public private partnership potentially and tolling could be a part of it.monday afternoon, i asked several people in novato what they thought of the idea of paying a toll on 37. amanda drives that way almost every day. she would be ok with a toll as long as the highway gets an upgrade.sotsure, if they ad another lane.sotvic barlogio runs a business in marin. he worries that paying tolls could impact his company's bottom line.sotpersonally, it would be an excessive expense for me because we use that road frequently.at this point, the idea of charging commuters a toll is just that. . an idea. connolly says that if it happens at all, tolling on highway 37 is still years away. in marin county, charles clifford kron 4 news. parents of a man who along with his fancee was murdered nearly 13 years ago -- got their first step towards closure.(pam) jason allen and lindsay cutshall were murdered on a beach in jenner.. back in 2004. for years, there were nothing but dead ends in the cold case investigation. (steve) then on friday, the sonoma county sheriff's office said the killer was in custody. reporter lynsey mukomel sat down with jason's parents.

(steve) the suspect in the case was already in custody -- accused of killing his brother. police say they used that opportunity to talk to him again about the killing of the couple. and he allegedly told them information only the killer would know. (pam) the valero oil refinery in benicia ... is being fined for violating regional air pollution rules.... following the flaring incident on friday. the bay area air quality management district says, it has issued four violations. one for causing a public nuisance, and three for releasing excessive smoke. it all started with a power outage at the refinery on friday morning that led to flaring... which released massive plumes of thick, black smoke into the air, prompting a shelter in place and an evacuation in the area. there will be continued flaring at the valero refinery this week while crews work to restore operations at the facility. there is no word on how much longer the flaring will continue.
