( james ) happening now... police in mountain view are looking for this 11-year-old girl. her name is diana flores-leiva. she was last seen yesterday morning at the intersection of el camino real and bay street. she is 5 feet - 5 inches tall with brown eyes. police say she was wearing a green sweatshirt with the word "pink" on it... blue jeans and black shoes. she was also carrying a black back pack. ( james ) happening today... a man who has spent almost a quarter century on death row... is set to be released. this after the state supreme court ruled the evidence to convict him was false. kron 4 's dan kerman has the story. 68 year old vicente benevides has spent 24 years on death row at san quentin and thursday he is expected to walk out the gates of the

prison, a free man.sot michael hersek / habeas corpus resource center 10-18of course we are elated for mr benevides, we think that was the right decision, we think that was the only decisionhis freedom comes after the state supreme court ruled his 1993 conviction for the sexual assault and murder of his girlfriend's 21 month old daughter was based on false evidence. soteveryone agrees now there was no sexual assault michael hersek is with the habeas corpus resource center which represented benevides. he says when medical experts re-reviewed all the evidence, from all the hospitals the child was taken to, they concluded injuries originally attributed to sexual assault, were due to medical procedures used to try and save her life. sotthis is another example of another significant error made at the trial that could have resulted in the execution of an innocent man.now the district attorney in kern county has chosen not to retry beenvides meaning his life on death row will come to end, but not the one most were expecting.standup dan kerman/san quentin 119-129the hearing to release benevides is now scheduled for sometime thursday afternoon, he could walk of the prison anytime after that hearing is complete. outside san quentin, dan kerman kron 4 news.news.

( james )east bay police are searching for a man wanted in a murder. richmond police say vernon dowell is the suspect in a deadly shooting last thursday. he is now wanted on a one million dollar warrant. police say the learned the victim got in an argument with the suspect before the shooting. but the reason why is not known. ( james )a northern california man is dead this morning after a skiing accident tuesday afternoon. placer county officials say jeffrey pearl- stein of kings beach at lake tahoe... lost control and crashed while skiing at alpine meadows ski resort. first

responders tried to resuscitate pearlstein but he died at the scene. authorities say pearlstein was wearing a helmet at the time of the incident. the investigation is on going. ( james )an east bay cafe was robbed at gunpoint saturday night. it's the second time in recent months the rawr coffee bar in oakland has been hit.that night a man came in and threatened employees... before getting away with cash. last month ...someone smashed the window of a cat shelter next door... sending the animals running as the burglar walked past to the cafe. that time the thief did not get away with anything. the coffee cafe is attached to the cat town shelter. and the cat town shelter partners with the rawr coffee bar to let patrons play with kittens while having coffee. ( james ) a northern california prosecutor says it may be more than a year before her office decides if two police officers broke the law when they fatally shot 22- year-old stephon clark.a sacramento county district

attorney says that her office doesn't have the sacramento police report into last month's death of clark. she also says she doesn't have the official autopsy after a renowned pathologist hired by the family found that clark was shot seven times from behind. schubert says it may be months before she gets those reports, and months more before she decides if the officers committed a crime. ( james )a man is recovering this morning after being punched in the face. it happened after he offered to buy beer for the person standing in line with him at a convience store. this is surveillance video of the suspect. he's accused of punching the victim... and causing him to lose consciousness. sacramento county sheriffús say the victim was unconscious for about 8 minutes. deputies say the suspect also took money from the victim's wallet and left with another man. ( james )new details in the investigation of a southwest airline plane and it's exploded engine that killed a woman tuesday. philadelphia's medical examiner says jennifer riordan was killed when she was

partially blown out of the plane. the airline says she died of blunt impact trauma to her head, neck and torso. meanwhile a federal investigator says a crack on the interior of the jet engine is what led to the failure that shot debris at the plane. one of the 24 blades in the engine fractured from metal fatigue. the n-t-s-b chairman says he is very concerned about the failure. ( james )the pilot who landed the flight after the mid-air explosion... is being hailed as a hero. one passenger says she displayed "nerves of steel!" the two pilots... captain tammie jo shults... who was a fighter pilot in the navy... and first officer darren ellisor... issued a statement through the airline saying that... they appreciate the outpouring of support they've received from the public and their co-workers as they "reflect on one family's profound loss." and adding that their "hearts are heavy." airport conducted emergency preparedness drills wednesday. the drills involved a simulated aircraft crash on the tarmac. it was coordinated with local state and federal agencies to practice response time and train together. santa rosa fire, cal fire, and the red cross all participated, among others. emergency personnel responded as they would in a real emergency -- including the use of sirens and firefighting equipment. volunteers were called on to act as victims. ( james )drivers in the north bay will soon get a bit of relief. on friday-- a new lane will open on the richmond-san rafael bridge. the shoulder in the eastbound direction will become a third traffic lane during peak traffic. the third lane will be open from 2:00 p-m until 7:00 p-m seven days a week. ( james )the santa cruz county sheriff's office held a community meeting last night after seeing an increase in gun violence. officials are discussing whether they'll add temporary license plate readers near soquel drive.

the department is working to find ways to prevent future violence while also generating investigative leads. while there are only talks about adding the readers... the department wants to hear the public's concern before they proceed with any plans. ( james )happening tomorrow... californians amoung many other states where pot is legal... will be celebrating 4-20. here in the bay area people are making big preparations for the unofficial holiday. this will be the first time adults can legally buy pot for lesiure. more than 15-thousand-people are expected to pour into golden gate park on friday. city officials are asking attendees to enjoy the day... and to be respectful of city parks. the problem -- is not a solution. they want to stabilize one side of the building to let the other side sink until it levels off. but as kron4's michelle kingston explains.. this plan could be more expensive than it was to build the actual tower ... and it could take áyears... before they know if it even works! (mk)attorney eric buescher, represents 85 millennium tower condo owners"it's sort of astonishing that this could occur."a luxury tower that was supposed to be the best of the best ... is sinking.and not just a little ... but a lot! and now a proposal to fix the problem is worrying some of the owners buescher"it is designed to prevent the building from sinking any further than it already has and may in 5, 6 or 7 years from now mean that the building tilts less than it does today but this is something thats never been done before on a building of this size and magnitude."the proposal -- which could cost more than what it cost to build the tower itself -- calls for piles to be drilled into the bedrock to stabilize

one side of the building and let the other continue to sink until it all straightens out. the problem is ... the tower has already sunk 17 inches ... and as you can see with this marble rolling on the floor ... it's tilting 14 inches to the west and 6 inches to the north and that movement hasn't stopped.so what's to say this proposal will even work? buescher"if they start work tomorrow we won't know for several years what the outcome is and whether or not that will be something that will protect the building."michelle kingston, @mkingstonnews"we're told contractors are already working with the city to get permits for this proposal.if it pans out, it could take 2 to 5 years to complete.as far the lawsuits filed by the condo owners, their trial is scheduled for next year.we contacted the attorney representing the homeowners association, but never heard back.in san francisco, michelle kingston, kron 4 news."

( james )an east bay student got the surprise of her life wednesday.. when she became one of just 20 students in the country to receive a special scholarship. samone anderson is a senior at kennedy high school in richmond. she received a scholarship wednesday morning for 20-thousand dollars to any school of her choice from footlocker. her teachers say she works very hard - with a 4-point-two g-p-a, four a-p classes, plays basketball and softball- and deserves every penny. the school surprise the girl during a surprise pep

rally. ( james ) samone wasn't told beforehand what the pep rally announcement would be. she plans on attending u-c-l-a next school year. ( james )it would be 30 times more powerful than 20-14's napa earthquake... and cause ten times more damage than loma prieta in 19-89. that's according to a new report that imagines an even bigger quake -- or "a direct hit" on the hayward fault in the east bay. kron four's rob fladeboe explains. ( james ) in the east bay... a multi-vehicile accident kills one driver and seriously injures others. it happened on a road leading to the oakland airport. kron 4's haaziq madyun spoke to investigators about what may have caused it. an illegal u-turn...prelimary cause for a four-vehicle collision killing a woman behind the wheel and injuring three other driverssotit happened wednesday around 10:27 am here on doolitle drive near langley street in oakland. this stretch of highway is commonly used by commuters traveling to and from the city of alameda and the oakland airport. deputies with the alameda county sheriff's office were first on the scene, followed by first responders from oakland fire who had to use hydraulic

( james )the state of california and the trump adminstration... have come to an agreement to send national guard troops to the u-s mexico border. wednesday governor brown announced 400 national guard members will be mobilized to fight against gun and drug smugglers and human trafficking. this comes after a request from president trump. governor brown says the california national guard will not enforce immigration laws or participate in the construction of any new border barrier. ( james )san diego is the latest city to say to no to california's sanctuary state law. the vote is sparking passionate debate on both sides of the issue. the board of supervisors heard public testimony before voting to back president trump's lawsuit against california. in the end... one supervisor pointed to a stack of 800 emails fron san diegans who favored the lawsuit. versus just a few dozen in favor of sanctuary cities.

just not this resident were tickled pink when they are caught speeding they either were pulled over or flagged down this driver was in the process of passing another driver hi officer butler with the los altos police department we are here on a joint task force they driver claimed she knew there was zero tolerance enforcement going on.we're coming into a school zone here and it's a posted 40 and you at 53 coming into it ... they also looked at drivers not stopping for school buses with the red lights activated did you see the school bus lights come on (no) you didn't see it we were behind you when you went around it do you know what you re suppose to do when they come on (stop) and you didn't why i didn't pay attention.. not paying attention to school buses can set you back in the range of 700 dollars and a point on your record officers also focused for another important issue, pedestrian safety .which was slightly missed by this driver i'm asking the police officers if they could stop having people cross the street in front of cars because earlier when i was driving a whole group of cars like 10 people and a old man like maybe 60 years probably not too old just

hand.late last year jaden heard about a man in romania who had lost his right arm below the elbow. the mans family had posted a request online hoping to find someone to build them a prostetic arm. looking for a challenge, jaden reached out to the family.sot he sent me the dimensions for the hand and i started figuring out how i was going to build it for him.ramos downloaded a blueprint for a generic prosthetic arm off the internet and began tweaking the design with 3d modeling software. soti would edit the base model so it would fit the man hand.the arm had to be the right size and strong enough to endure the wear and tear of daily use. the hand also needed to open and close for grasping objects. after 3 months of tinkering, this was the finished product. it features bendable joints with rubber bands and springs acting as tendons. jaden boxed it up and shipped it off to romania.sotand a couple weeks later he sent me pictures and videos of his dad using it.the man could grab a pot with the arm, drink a coke, sweep the floor. . .

( darya ) milpitas police need help in identifying this driver. police say he left the scene of an accident... after refusing to give out insurance information. the crash happened earlier this month... in a shopping center on west calaveras boulevard. the other driver involved was not hurt. the man's car is described as a white toyota tundra with gray primer on the tailgate with "piercey toyota" paper plates. ( james ) happening today... a man who has spent almost 25-years on death row is set to be released.

we first told you about vicente figueroa's upcomning release yesterday morning. now we know a hearing is set for this afternoon. figueroa could leave san quentin anytime after that hearing. he was convicted in 19-93 of raping and killing his girlfriend's one-year-old daughter. the state supreme court threw out his conviction in march.... saying the medical evidence was proven false. ( darya ) police in the north bay have arrested a man... after they say he was found carrying ilegal guns and drugs in larkfield. police found 10 hand guns at the home of jacob kornblue. this is a picture of the guns that were seized. they also found cocaine in his pocket. he is now being held on 100-thousand dollars bail ( darya ) police in the east bay arrest a man who led them on a high speed chase in alameda county. and the passenger in the front seat was this little guy. it is a baby pitt bull. police say the chase reached speeds

of 100 miles per hour on interstate 880 in hayward. he was eventually caught in oakland. it is not clear if he was the owner of the puppy. the baby pit bull is at a shelter. if it is not picked up by its owner it will eventually be put up for adoption. ( darya ) a new proposal is in the works to fix the sinking and leaning millennium tower in san francisco. but the fix could cost more than the tower itself. the proposal calls for stabilizing one side of the building with piles being drilled into the bedrock... while the other side continues to sink until it all straightens out. the problem is the tower has already sunk 17 inches. contractors are already contractors are

( james ) california and the trump adminstration have reached an agreement on sending national guard troops to the u-s mexico border. governor brown says 400 troops will be mobilized. they'll focus on fighting gangs and human traffickers. this

comes a week after a request from president trump. governor brown says the national guard will ánot enforce immigration laws or take part in the construction of the border wall. yeah, well new prostethic arms can be very expensive but this young man made a functioning arm in his bedroom and he wants to make more.nats 15-year-old jaden ramos started tinkering with 3d printers when he was in 6th grade.soti like that you can design something and in a few hours hold it in your physical hand.late last year jaden heard about a man in romania who had lost his right arm below the elbow. the mans family had posted a request online hoping to find someone to build them a prostetic arm. looking for a challenge, jaden reached out to the family.sot he sent me the dimensions for the hand and i started figuring out how i was going to build it for him.ramos downloaded a blueprint for a generic prosthetic arm off the internet and began tweaking the design with 3d modeling software. soti would edit the base model so it would fit the man hand.the arm had to be the right size and strong enough to endure the wear and tear of daily use. the hand also needed to open and close for grasping objects. after 3 months of tinkering, this was the finished product. it features bendable joints with rubber bands and springs acting as tendons. jaden boxed it up and shipped it off to romania.sotand a couple weeks later he sent me

( darya ) this morning we're learning that a shooting threat was made against youtube... after a woman opened fire on the company's headquarters. san bruno police say that it was an online threat... and it warned of other shootings. investigators were able to track down the source. they say it was made by someone under 18 -- and was ánot a credible threat. no word yet on whether criminal charges will be filed. ( darya ) an east bay cafe says two employees were robbed at gunpoint. the cat town shelter partners with the rawr coffee bar to let patrons play with kittens while having

coffee. the coffee bar says they were robbed saturday night by a man who came in and threatened employees... before getting away with cash. the cafe's owner says customers didn't even notice the thief. last month... someone smashed the window of the cat shelter.. sending the animals running as the burglar walked into the cafe. that time the thief didn't get away with anything. ( james ) representative jackie speier has introduced legislation to combat robocalls. the bill directs the federal communications commission to require phone companies provide free technology to block robocalls. speier said the national do not call registery has failed to protect customers from scammers. the act would require telcom companies to verify the accuracy of the caller i-d information. ( james ) crews with the san francisco department of public works began confiscating dockless scooters. stating it was for a flagrant disregard for the rules. yesterday

afternoon 24 scooters were seized after public works received complaints from residents saying the scooters were obstructing sidewalks. the confiscations come on the heels of the board of supervisors vote to require scooter share programs seek permits for their scooters. unpermitted scooters would be subject to confiscation but the ordinance would take about a week to go into effect. ( darya ) a sacramento prosecutor says it may be more than a year before her office decides if two police officers broke the law when they fatally shot an unarmed black man. a sacramento county district attorney says that her office doesn't have the police report into last month's death of stephon clark. she also says she doesn't have the official autopsy. it may be months before the d-a's office gets those reports... and months more before they decide if the officers committed a crime. ( james ) today marks the 23rd anniversary of the deadliest act of domestic terrorism in u-s history-- the oklahoma city bombing. ex-army soldier timothy mcveigh parked a rental truck in front of the alfred p- murrah federal building in oklahoma city. a powerful bomb made of diesel fuel, fertilizer and other chemicals was inside that truck. the explosion killed 168-people and injured hundreds more. less than two-hours after the bombing... an officer pulled mcveigh over for speeding. he was carrying a concealed weapon and arrested. a remembrance ceremony in oklahoma is set to begin in about an hour. eight baby ducklings are recovering after being rescued from a storm drain in san mateo. the peninsula humane society says the baby ducks were found trapped in mud at the bottom of a concrete drainage ditch... right off of highway 101 on the poplar avenue exit. a driver found the ducklings and called the humane society. the ducklings will be released back into the wild once they are older and self-sufficient. ( darya ) in the east bay... police are looking for a man wanted for murder. richmond police say vernon dowell shot a man to death last thursday. he is now wanted on a one million dollar warrant. police say the victim and dowell got into an argument before the shooting. dowell is armed and dangerous and should not be approached. ( darya ) milpitas police need help in identifying this driver. police say he left the scene of an accident... after refusing to give out insurance information. the crash happened earlier this month... in a shopping center on west calaveras boulevard. the other driver involved was not hurt. the man's car is described as a white toyota tundra with gray primer on the tailgate toyota" paper plates. ( darya ) police in the north bay have arrested a man... after they say he was

found carrying ilegal guns and drugs in larkfield. police found 10 hand guns at the home of jacob kornblue. this is a picture of the guns that were seized. they also found cocaine in his pocket. he is now being held on 100-thousand dollars bail ( james ) police in the east bay arrest a man who led them on a high speed chase in alameda county. and the passenger in the front seat was this little guy. it is a baby pitt bull. police say the chase reached speeds of 100 miles per hour on interstate 880 in hayward. he was eventually caught in oakland. it is not clear if he was the owner of the puppy. the baby pit bull is at a shelter. if it is not picked up by its owner it will eventually be put up for adoption. ( james ) a new proposal is in the works to fix the sinking and leaning millennium tower in san francisco. but the fix could cost more than the tower itself. the proposal calls for stabilizing one side of the building with piles being drilled into the bedrock... while the other

side continues to sink until it all straightens out. the problem is the tower has already sunk 17 inches. contractors are already working with the city to get permits for this proposal. if it pans out... it could take 2 to 5 years to complete. ( james ) happening today... two homeless encampments in santa rosa must be cleared out by today. but people living at the camp are asking for more time. they want alternate housing and access to social services. two camps near a "dollar tree" store have been home to more than 100 people for about 2 years. the county's development commission wants to clear the land -- which it owns -- and develop an apartment complex. ( darya ) californians hold some contradictory views on issues like deportation. that's according to a new study by u-c berkeley. two thirds of californians oppose president trump's border wall. 64 percent think the state should limit cooperation with federal immigration officials.

but 59 percent say increasing deporations is important. that seems at odds with the fact that 79 percent support a pathway to citizenship for dreamers. and while 70 percent of californias say immigrants strengthen the country -- nearly half support the so called "muslim ban." ( james ) a delta airlines jet made an emergency landing in atlanta after one of its engines caught on fire. the air-bus left atlanta last night... bound for heathrow airport in london. but it returned to the airport when the crew reported an engine problem. fire crews met the aircraft on the runway and extinguished flames on an engine. the plane was then towed into a gate and all the passengers got off safely. delta put passengers on another flight to london. no one was hurt... and the f-a-a is investigating. ( james ) the sonoma county airport is ready for an emergency. the airport took part in drills... involving a simulated aircraft crash on the tarmac. it was coordinated with local... state and federal agencies. emergency personnel responded as they would in a real emergency -- including the use of sirens and firefighting equipment. volunteers were called on to act as victims. francisco with more on this story.lydia? crews with the san francisco department of public works began confiscating dockless scooters. stating it was for a flagrant disregard for the rules. yesterday afternoon 24 scooters were seized after public works received complaints from residents saying the scooters were obstructing sidewalks. the confiscations come on the heels of the board of supervisors vote to require scooter share programs seek permits for their scooters. unpermitted scooters would be subject to confiscation but the ordinance would take about a week to go into effect.

we are elated for mr benevides, we think that was the right decision, we think that was the only decisionhis freedom comes after the state supreme court ruled his 1993 conviction for the sexual assault and murder of his girlfriend's 21 month old daughter was based on false evidence. soteveryone agrees now there was no sexual assault michael hersek is with the habeas corpus resource center which represented benevides. he says when medical experts re-reviewed all the evidence, from all the hospitals the child was taken to, they concluded injuries originally attributed to sexual assault, were due to medical procedures used to try and save her life. sotthis is another example of another significant error made at the trial that could have resulted in the execution of an innocent man.now the district attorney in kern county has chosen not to retry beenvides meaning his life on death row will come to end, but not the one most were expecting.standup dan kerman/san quentin 119-129the hearing to release benevides is now scheduled for sometime thursday afternoon, he could walk of the prison anytime after that hearing is complete. outside san quentin, dan kerman kron 4 news.

( james ) a sacramento prosecutor says it may be more than a year before her office decides if two police officers broke the law when they fatally shot an unarmed black man. a sacramento county
