( darya ) new this morning. a gruesome discovery in san francisco. human remains are found reportedly inside a fish tank at the home of a missing person. ( james ) kron4's will tran is live in front of the home in the south of market neighborhood. will. san francisco police are investigating remains found inside a home on the 2oo block of clara street. police will only confirm that remians

were found in the home but there are reports that a headless corpse was found in a fish tank. the remians may be that of a missing man who friends reported missing in july.

( james ) happening today... daniel gross -- the modesto man who killed an east bay woman -- then left her on the side of the road will appear in court. lizette cuesta was killed back in feburary. before she died she led investigators to gross and melissa leonardo. gross pleaded guilty to charges of beating.. stabbing and killing cuesta.

leonardo pleaded ánot guilty. today's hearing will set the location of future court dates. ( james ) in the south bay... a vietnam war memorial in san jose is vandalized. 142 veterans' names are inscribed on that memorial that was dedicated five years ago... all of those veterans were from san jose. over the weekend someone spray painted writing on the corn with white paint that has been washed off but is still etched in the granite. ( james ) the san jose vietnam war memorial foundation is calling on a granite expert to try and get the paint out and restore the memorial to its original state.

( darya ) in the south bay... a 15-year-old is recovering after being shot near a school in san jose. it happened on the 900 block of walnut woods drive... that is just two blocks from robert f. kennedy elementary school. the teen is expected to be okay but the shooter is still on the loose. ( darya ) new this morning... the man convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in 1998. police arrested anthony hughes for her murder after getting a d-n-a match... 13 years later. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional rights to a fair trial. the appeals court rejected that argument.

( james ) a big story we are tracking this morning... a move from the defense team in the deadly ghost ship warehouse fire case. attorneys for one of the defendants... derek almena... filed a motion regarding the plea agreement that was thrown out. attorney tony serra says a fill-in judge did not follow the plea agreement during sentencing because there was a conflict of interest. ( james ) serra went on to say... judge cramer had verbally agreed three times to follow the plea deal prior to the hearing. serra says if he knew the judge would change his mind... he would have waited until the original judge overseeing the case had

returned to court after dealing with a personal matter. both sides will return to court next month to schedule a trial date. that will be followed by a november 2nd hearing of a motion to change venues. ( james ) new this morning... san francisco may soon be allowed to launch a pilot program that would allow people to inject heroin and other drugs under medical supervision. the goal is to curb overdose deaths. the state assembly passed the "safe injection sites" bill yesterday. it now goes to governor brown. the sites would provide sterile needles and allow people to use illegal drugs without fear of arrest. ( darya ) a search and still working in remote areas of hawaii's big island. these are pictures from the search and rescue team. fire officials say that the group has searched more than 50 square miles in the last two days. the task force was deployed to hawaii to help in the aftermath of hurricane lane... which later weakened to a tropical storm. thousands of aretha franklin fans are expected to pay their last respects to the queen of soul today and tomorrow. this is video of the casket arriving earlier this morning at the wright museum of african american history in detroit. the singer's body will lie in repose for two days franklin died last week at the age of 76 from pancreatic cancer. is desperate for housing... construction projects in san francisco are now stalled. this property on folsom street was permited to be 117 units of housing ... but now the project has stalled and the property up for sale. industry insiders say construction is just too expensive to build. there is also a shortage of construction workers that's persisted after the real estate bubble burst in the last decade. ( darya ) but the stalling of so many projects in san francsico could provide an opportunity for developers focused on affordable housing. non-profit organizations have access to funding from the city ... as well as state and federal dollars. ( james ) a federal judge is blocking a texas-based company from posting blueprints online for 3-d

printed guns. the state department reached a settlement back in july... with the gun rights organization "defense distributed." that deal would have allowed the release of those blueprints . but several states argued that deal could put untraceable guns in the hands of criminals. a district judge agreed ... and extended his previous injunction against the release of the blueprints. ( james ) new this morning... more than 25- thousand pounds of ground beef are being recalled and some of it was shipped here to california. cargill meat solutions is recalling the meat because it may be contaminated with e. coli. the beef has an experation date of september 5th. so far there have been no reports of any illness. e. coli can be life threatening for young children and the elderly. worse when students realized one of the shooters... had slipped into the gym... and tried to hide among them. but police were able to find him and the other gunman. and as students returned to class yesterday...many of them say they were thinking about school safety. ( james ) fairfield police have increased their patrols around the school and the district also brought six counselors onto campus... to provide support for students and staff. now they're putting pressure on the school district to remove one of its students.pkg a crowded room of parents ... demanding the mount diablo school district expel one student from sequoia middle school and the district.i don't think any child that makes a threat like that should be in public school without doing a thorough mental health evaluation parents say the student in question .. is the same 13 year old that was arrested for threatening to shoot 30 students at valley view middle school back in june.this is not something to be taken lightly. gun violence and the culture is so persistent and constant that the way the district handled it seems duplicitousalthough this student was cleared ... before being moved to sequoia ... parents say their children are afraid to go to school. and they themselvves also have reservations.every single day. sometimes i can't sleep at night. it's difficult to think about itthe moment kim childers found out her son had classes with the teen, she

removed him from sequoia. she started a petition last week to get the child expelled. they now have over a thousand signatures. just like my son is able to be drawn from the district and attend a charter school online and get an alternate education, so can this childfind him some mental health. there are other programs he can be in but he shouldn't be in the mainstream not everyone agrees with the ideai have a child and if the elcted da and the elected school district sent him down the street, who are we, the uninformed parents to judge him when we have none of the facts?standup this issue was not on tongiht's agenda. parents are pushing to get this item on the agenda for the next session in mid september.they're hoping to get answers.reporting live from concord ... ali reid ... kron 4 news.

( darya ) a 20-month-old child is recovering this morning after being hit by a car in menlo park. it happened near willow road last night. police say the toddler was riding a toy car when a relative was backing his car on the driveway and did not see the child. the child is in critical condition at lucile packard children's hospital stanford but is expected to survive. the driver is cooperating with investigators, who do not believe drugs or alcohol were factors in the case. ( darya ) happening now... the manhunt is on for a northern california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya... was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year

oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he just wants his daughter home. ( james ) in san jose.... advocates for the homeless are trying to save a county- owned building from the wrecking ball. the old san jose city-hall annex at first and mission is slated for demolition to make way for parking. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too expensive. the board of supervisors has is expected to take action on the proposal next month. ( james ) new this morning... firefighters spent the overnight hours mopping up a small grass fire. this is video from the scene tweeted out by firefighters. the fire broke out at 9:15 last night on the 100 block of west view. the fire burned some fences and a hillside but no structures were damaged. no body was injured. enforcement throughout the state came to the bay area to focus on getting a message out to the public... about using marijuana and getting behind the wheel. they held a marijuana traffic safety summit in dublin. officers say the importance of informing the public about the dangers of driving while under the influence of marijuana was the primary subject of the summit. ( darya ) while the summit mainly focused on taking marijuana and driving... authorities also discussed driving while under the influence of other drugs like painkillers and sleeping pills... all of which officers say...are also on the rise. canceled. this after the deadly shooting at a gaming tournament in jacksonville, florida. gunman david katz shot and killed two people and injured 10 others... before shooting himself. there is still no motive for the shooting... however we are learning that katz was once treated for psychological and emotional issues.... and according to his parents' divorce papers in 2006-- katz was treated with medication for schizophrenia. a man who survived the shooting...says he is still in disbelief this morning. ( james ) the two players who died... have been identified as 27-year old taylor robertson from west virginia who had won the national tournament two years ago... and 22-year old eli clayton a former high school football player from woodland hills in southern california. the 10 other victims who were shot are all expected to survive. hospital has hit a major milestone... it's celebrating a birthday.( james ) doctors delivered the first baby born at sutter health's new c-m-p-c's mission bernal campus on sunday. little isabella weighed in at just over 7 pounds. the hospital says isabella's parents are enjoying their private room. also arriving on sunday... were two other baby girls and one boy. ( james ) coming up in the next hour ... police

convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in 1998. police arrested anthony hughes for her murder after getting a d-n-a match... 13 years later. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional rights to a fair trial. the appeals court rejected that argument. ( james ) new this morning... san francisco may soon be allowed to launch a pilot program that would allow people to inject heroin and other drugs under medical supervision. the goal is to curb overdose deaths. the state assembly passed the "safe injection sites" bill yesterday. it now goes to governor brown. the sites would provide sterile needles and allow people to use illegal drugs without fear of arrest. ( darya ) the bay area is desperate for housing... construction projects in san francisco are now stalled.

this property on folsom street was permited to be 117 units of housing ... but now the project has stalled and the property up for sale. industry insiders say construction is just too expensive to build. there is also a shortage of construction workers that's persisted after the real estate bubble burst in the last decade. ( darya ) but the stalling of so many projects in san francsico could provide an opportunity for developers focused on affordable housing. non-profit organizations have access to funding from the city ... as well as state and federal dollars. ( james ) students at armijo high school in fairfield returned to class monday... just days after shots were fired a block away near a friday night football game. a 16-year-old was killed in that shooting. after the shooting... police funneled the crowd into the high school gym... and put them on lockdown... but

( james ) a federal judge is blocking a texas-based company from posting blueprints online for 3-d printed guns. the state department reached a settlement back in july... with the gun rights organization "defense distributed." that deal would have allowed the release of those blueprints . but several states argued that deal could put untraceable

( darya ) in the east bay... there's a growing movement to have a child kicked out of the mount diablo school district... for making violent threats. that student has already been placed in another middle school in the district. the student's new school -- sequoia middle school -- held a meeting last night to discuss the issue. the student was arrested back in june... for threatening to shoot 30 students at valley view middle school. the boy was never charged... but guns were found in his parents home. a petition to have the boy kicked out of the district has over a thousand signatures. ( james ) a 20-month-old child is recovering this morning after being hit by a car in menlo park. it happened near willow road last night. police say the toddler was riding a toy car when a relative was backing his car on the driveway and did not see the child. the child is in critical condition at lucile packard children's hospital stanford but is expected to survive. the driver is cooperating with investigators, who do not believe drugs or alcohol were factors in the case. ( james ) happening now... the manhunt is on for a northern california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya... was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he

( darya ) students at armijo high school in fairfield returned to class monday... just days after shots were fired a block away near a friday night football game. a 16-year-old was killed in that shooting. after the shooting... police funneled the crowd into the high school gym... and put them on lockdown... but the scary sitution was made worse when students realized one of the shooters... had slipped into the gym... and tried to hide among them. but police were able to find him and the other gunman. and as students returned to class yesterday...many of them say they were thinking about school safety. ( darya ) fairfield police have increased their patrols around the school and the district also brought six counselors onto campus... to provide support for students and staff.

( james ) in san jose.... advocates for the homeless are trying to save a county- owned building from the wrecking ball. the old san jose city-hall annex at first and mission is slated for demolition to make way for parking. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too expensive. the board of supervisors has is expected to take action on the proposal next month.
