( james ) kron4's lydia pantazas has the video that shows just how out of hand thigs got. yesterday the san jose office of chp learned of some information that tipped them

to some sideshow activity that was planned in san jose. chp worked with san jose police to position themselves in key locations to stop freeways from being shut down. chp was able to arrest one participant and impounded the owners car for 30 days. officers also observed an onlooker driving erratically and was able to stop that person after a short chase and arrested the driver. chp could not confirm any of the activity that happened on city streets but we are hearing that sjpd was able to arrest at least 3 other drivers and impound several cars.

( james ) new this morning... three teenagers are recovering after being shot in the south bay. it happened near the seven trees community center in san jose. police arrived on scene and found two girls and a boy with gun shot wounds. none of the injuries are considered life threatening. the teens were hanging the teens were hanging out behind the community center when a gunman walked up and started shooting. police do ánot believe that this is gang related. the shooter is still on the loose. ( darya ) our top story this morning... baseball fans al across the bay area are mourning the death of giants legend willie mccovey.( james ) mccovey died yesterday at the age of 80. kron 4's sara stinson is live at a-t-and-t park with reaction this morning. sara.

( sara )i'm live here at the willie mccovey statue where tributes continue to pour in...here you can see pictures, candles, giants gear all in honor of the giants legend.the giants announced his death saying the fearsome hitter passed peacefully yesterday afternoon.the hall of famer made his major league debut with the giants in 19-59 and was with the giants for 18 years out of his 22 year career.in recent years - mccovey also known as stretch had been getting around in a wheelchairbut that's didn't stop him from coming here to a-t and t park as he regularly watched games in his suite.he even got to see the final game of the season this year.this growing memorial shows you mccovey will always be loved by giants fans and this statue ensures he will never be

( darya ) sad news out of the east bay this morning. a 3-year-old was killed when she was struck by a car. police tell kron 4 the crashed happened when the girl was crossing the shepard avenue in hayward. the driver remained on scene and

is cooperating with the investigation. the cause of the crash is still under investigation. ( darya ) in the south bay... a man is charged with attempted murder after police say he stabbed a woman on the cabrillo college campus in aptos. when deputies arrived, they found the manager of the cafeteria holding down steven wooding. a 19-year-old student was stabbed while she was sitting in the cafeteria. she was able to run away to an area outside where she waited for paramedics to arrive. she is in stable condition. wooding has a history at the college. the school has a restraining order against him for harassing behavior. he was previously arrested for an assault of a staff member in 1994. he spent several years in a psychiatric institution for that crime. ( darya ) happening today...hundreds of google employees plan to participate in a company-wide walk-out. the employees are protesting a senior software developer who was given 90-million dollars after resigning. he resigned after allegations that he forced a woman to

perform sexual acts in a hotel. more than 200 employees plan to participate in the walk-out which will take place later this morning. some workers have even quit their jobs as a form of protest. ( james ) happening today... then man accused of murdering 11 people inside a pittsburgh synagogue is scheduled to appear before a judge. robert bowers is accused of firing on worshippers at the tree of life synagogue in a hate-driven rampage. he has been indicted on 44 criminal counts, including hate crimes. he could face the death penalty. ( james ) on the peninsula... a parent has filed a lawsuit against the south san francisco unified school district... after they say their child was sexually abused by a teacher. the parent claims their 14- year-old was molested by westborough middle school teacher, joseph toy... and that the school failed to report the incident after being notified. the lawsuit cliams toy would put the 14-year-old victim on his lap, kiss his head, and place his hand under his shirt. the lawsuit also says a parent previously caught toy being inappropriate with another student .. and took a picture of the teacher with his arms

was put out. two people were killed including a cal- fire engineer. a state investigation will determine the fire's official cause. ( darya )in the north bay... a 16-year old has been arrested in marin county for threatening to shoot students at novato high school. novato police say the teen sent threatening messages to other students where he also commented on their sexual orientation. even though the teen and his parents deny he had any intention of hurting other students... he was still booked into juvenile hall on suspicion of criminal threats and committing a hate crime. police officers were on campus for added security. ( darya )and... an elementary school teacher from san rafael has died after being hit by a drunk driver while riding her bike. this also happened in marin county. debra di-benedetto taught at dixie elementary school for the past 20 years. grief counselors have been on campus to help the students and the school observed a moment of silence in her honor. the

driver has been arrested and booked on suspicion of dui causing death and gross vehicular manslaughter. di- benedetto was 63 years old. ( darya ) san jose is asking voters to help with student homelessness in that city. students and local elected officials are asking voters to support state propositions one and two and local measure "v". with as many as 400 san jose state students living in cars, supporters say the measures would bring some relief. < "....i have a futon and i have had friends and comrades at my house all the time becauswe they cant afford a place of their own.... ( darya ) an american airlines employee falls asleep on the job and ends up flying from kansas city to chicago in the belly of the plane. the baggage handler admitted to being intoxicated when he took a nap in the cargo hold. nobody noticed him missing and he wasn't found until the plane landed at o'hare airport in chicago. the baggage handler has not been charged with a crime but american airlines says they are investigating. ( james ) another big story we are following... a bart rider gets on a train and finds it ransacked.( darya ) and it aparently happens quite often. kron 4's dan kerman has the details. soti was scared and rattled i wanted to know is there someone on this train, am i safeit was a week ago monday night when diane wagner boarded a bart train at 24th and mission in san francisco and found the car completely ransacked. when she told the train operator he said it's routinesot diane wagner/bart

rider 18-25he says the drug people come on the train and they flip over the cushions to find money.wagner says the train operator was friendly and apologetic but did nothing about it, nor did the station agent she told in castro valley the next day.sotthe message for bart is they need to clean it up and make it safe and secure because right now as a rider i dont feel safe sot we want to have people have a good experience riding the systemthat said, bart director bevan dufty says bart has more serious issues to deal with than people removing cushions, such as a recent incident when a bart rider pulled out a two chainsaws. sot bevan dufty/bart director 100-110in that case, bart police officers were on scene in two minutes so i would offer to you thats where they should be in a situation that is potentially violent or dangerous.dufty says trains are inspected at the end of the line and he says over the next few years seat cushion flipping will cease to be an issue as more new bart cars like this one come on line, with cushions that are not revable.standup dan kerman/sf 124-134dufty does want to see more of a presence on bart and is pushing for community service personal like muni has. he says it will make a real difference. in sf, dan kerman kron 4 news. warning before you hop-on one of those "lime" scooters found across the east bay. they could catch on fire. the company released a statement saying the manufacturer is recalling some of the scooters because of an issue with the battery. they say the defect could result in the battery smoldering, or in some cases, catching fire. lime did say the issue impacts less than one-percent of their scooter fleet. they say all affected scooters have been removed from circulation. no injuries have been reported. ( james ) another big story we are following... the california democratic party headquarters in sacramento was evacuated wednesday after a suspicious package arrived. investigators swarmed the scene... including the f-b-i.

nearby buildings were also evacuated before investigators concluded the area was safe. ( james ) california water officials say... the one - point- one billion dollar spillway at the oroville dam ... will be ready for rain this winter. this comes two- years after it was damaged and thousands of people were forced to evacuate the area. crews have now finished pouring concrete on the main spillway at the dam. it will still need to sit for a month... and other work is needed before it can be used. because of a "fight club" at her children's daycare organized by teachers in saint louis. a ten-year old took this fight club video with his ipad from the next room. one teacher is excited, while the other teachers puts hulk fists on preschoolers. mother nicole merseal cannot watch without crying. ( james ) daycare cameras recorded at least 30 minutes of the children fighting. a police reportays the director immediately fired both teachers and called the child abuse hotline. the st. louis district attorney's

office declined to prosecute the teachers because they say there was not enough evidence that any laws were ( darya ) more than seven months after the deadly police shooting of stephon clark his family still grieving. now... community members, along with city leaders and local businesses rallied around stephon clark's family to renovate his grandparent's home... the clark family held a ribbon cutting yesterday, to thank the people who helped fix the family home. it's a home family memebers say their grandfather built from the bottom up... stephon clark was shot and killed in the back yard of that home... and his family says they are still waiting for justice. legend willie mccovey died at the age of 80.mccovey made his major league debut back in 1959. they called him "stretch" cuz he was 6 foot 4 and man, he had a mighty swing.. in fact, they call it mccovey cove, cuz if he had played in att park, that's where a lot of his balls woulda wound up. he had 18 grand slams:: the most in national league history.. .and 521 career home runs.. in 1986 he was inducted in to the baseball hall of fame: ( darya ) the magnitude of that honor

while they are in a checkout line. the device would also be used to listen in on what employees are saying to customers. the report says walmart wants the technology to make the checkout and shopping process smoother. but privacy advocates say this would cross the line. walmart is not using any of the devices yet in its stores and hasn't said if it ever will. ( james ) on the peninsula... a parent has filed a lawsuit against the south san francisco unified school district... after they say their child was sexually abused by a teacher. the parent claims their 14- year-old was molested by westborough middle school teacher, joseph toy... and that the school failed to report the incident after being notified. the lawsuit cliams toy would put the 14-year-old victim on his lap, kiss his head, and place his hand under his shirt. the lawsuit also says a parent previously caught toy being inappropriate with another student .. and took a picture of the teacher with his arms

yesterday the san jose office of chp learned of some information that tipped them to some sideshow activity that was planned in san jose. chp worked with san jose police to position themselves in key locations to stop freeways from being shut down. chp was able to arrest one participant and impounded the owners car for 30 days. officers also observed an onlooker driving erratically and was able to stop that person after a short chase and arrested the driver. chp could not confirm any of the activity that happened on city streets but we are hearing that sjpd was able to arrest at least 3 other drivers and impound several cars. ( james ) teenagers are recovering after

being shot in the south bay. it happened near the seven trees community center in san jose. police arrived on scene and found two girls and a boy with gun shot wounds. none of the injuries are considered life threatening. the teens were hanging out behind the community center when a gunman walked up and started shooting. police do ánot believe that this is gang related. the shooter is still on the loose. bay... a man is charged with attempted murder after police say he stabbed a woman on the cabrillo college campus in aptos. when deputies arrived, they found the manager of the cafeteria holding down steven wooding. a 19-year-old student was stabbed while she was sitting in the cafeteria. she was able to run away to an area outside where she waited for paramedics to arrive. she is in stable condition. wooding has a history at the college. the school has a restraining order against him for harassing behavior. he was previously arrested for an assault of a staff member in 1994. he spent several years in a psychiatric institution for that crime ( darya ) happening today...hundreds of google employees plan to participate in a company-wide walk-out. the employees are protesting a senior software developer who was given 90-million dollars after resigning. he resigned after allegations that he forced a woman to perform sexual acts in a hotel. more than 200 employees plan to participate in the

back tears... after watching a video of her child at daycare getting beat up.( james ) the video shows what you might call a "fight club."... and it was organized by teachers. chris heyes reports. a ten-year old took this fight club video with his ipad.he's with older kids in the next room.thatús his little brother crying after three fights. one teacher is excited, while the other teachers puts hulk fists on preschoolers.mother nicole merseal cannot watch without crying.nicole merseal, mother: "he doesn't understand why his friends were fighting him, why he was beat up by his best friends - and it was on his 4th birthday."the fight begins -- the kids fall. a teacher -kicks in the air in excitement. the only person who tries breaking it up is another preschooler, but he cannot stop one child from pounding the other's head into the floor.merseal believes it only stopped because her older son texted her video.she

( darya ) happening now... a warning before you hop- on one of those "lime" scooters found across the east bay. they could catch on fire. the company released a statement saying the manufacturer is recalling some of the scooters because of an issue with the battery. they say the defect could result in the battery smoldering, or in some cases, catching fire. lime did say the issue impacts less than one-percent of their scooter fleet. they say all affected scooters have been removed from circulation.
