( james ) and i'm james fletcher. and this morning we are tracking the rain. taking a look at radar this morning. the rain is in this morning. the rain is in the north bay this morning but it will be spreading all acorss the bay area throughout the day.( will ) let's start with a look at the forecast. john shrable is standing by to get you ready as you head out the door. dry weather this past weekend but today we work our way back into a day of rainy weather. expect showers to be heavy at times later in the morning with rainfall continuing well

in the east bay could see plumes of smoke and flaring from the valero refinery in benicia. the refinery has temporarily shut down after heavy smoke was seen coming from the refinery over the weekend. valero says the cause was an operational issue with it's flue gas scrubber. city officials

sent a text alert to residents to stay indoors due to the poor air conditions... right now, the health advisory has been lifted because the air quality has improved.

sreet from the movie theater. this morning police do not have the shooter in custody. the shooting happened at the union bank parking lot on mount diablo blvd and locust street last night just before ten.an entire block was tapped off as walnut creek police investigated the scene...nearby movie goers stood by wondering what happened.after a man was shot he walked into kaiser's walnut creek medical center with a gunshot wound to the back.his injuries are non life threatening.the odd thing is that there are very few witnesses so the circumstances that led up to the shooting are still under investigation. people on scene say the victim was robbed before being shot - but we are still trying to confirm that with police. right now we're waiting to get an update from police to see where they're at in the investigation this morning. live in walnut creek, sara stinson, kron four news. four news.

( james ) in the east bay... a school prinicpal who was shot at his home last weekend has died. now his wife could be facing even more serous charges. "paul shatswell" died yesterday after he was placed on life support... police got a call about a domestic incident and found the 45-year-old shot in the head lat weekend on

barrie drive. shatswell was a principal at pittsburg adult education center. right now --his wife 39- year-old ámaria videsá is charged with attempted murder... but those charges could be upgraded. she is being held on 2-million dollars bail at the contra costa sheriff's office jail in martinez. the couple have 8 children together. this is the city of pittsburg's first homocide of the year. ( will ) police in san francisco are investigating a shooting that killed one person and sent 5 people to the hospital. the shooting happened saturday night on the 13-hundred block of fillmore. police say the person killed was a 25-year-old man from san francisco. officers did not release information about the shooter. ( will ) new this morning... a man is dead after he was hit by a car while trying to cross highway 101 in mountain view. it happened last night near the rengstorff avenue interchange. the person was trying to cross the

northbound lanes when he was hit by the car. police say the driver stopped at the scene and is working with police. the victim was taken to the hospital where he died... his identity has not been released. the nothbound lanes of 101 were shutdown for about 30 minutes after the accident. ( james ) in the east bay... this week -- emergency officials will be conducting a test for sending out earthquake alerts to cell phones in oakland. beginning at 11 on wednesday... your cell phone may go off if you're in or around downtown oakland. officials are using geo- fencing technology to target phones within 60 square blocks of east lake merritt. ( james ) a surfer was rescued from ocean beach over the weekend near the cliff house restaurant. the man was rescued just sunday afternoon in the area known as seal rocks. a helicopter was used to get him off the rocks he is expected to be okay.

( james ) and we have new video this morning showing firefighters in richmond saving two dogs from a burning building. this is body cam video showing the firefighters entering the smoky building and finding the dog. they even had to perform c-p-r on at least one of the dogs. neither dog had any burn injuries and both are expected to be okay. the college admission scandal. tmz is reporting that the university has eight suspicious cases where alums used admission scam ring leader rick singer's services. attorneys say usc can and should take away the degrees of any alum found to have gotten in by fraud but some students dis agree. henry avocado, a grower and distributor based near san diego, is recalling some of the fruit. the recall covers conventional and organic avocados grown and packed in california. there is concern over possible listeria contamination. no illnesses have been reported. apple is expected to unveil a bunch of new services today. it's widely expected apple will launch a video and news subscription service that it hopes will help make up for sluggish iphone sales.apple will show us footage of some of its original shows at the event today.and reportedly will offer hbo and showtime for 9-99 a month.the hashtag ' in a world without twitter' is trending on twitter.one poster says without twitter they. may have to write pithy sayings on rocks or actually talk to people-face to face.twitter has come under criticism for letting abusive and harassing tweets stay on the platform when other social media sites will take them down.drunken online shopping is big business-especially for amazon. tech and business newsletter the hustle surveyed

the report also found that contact sports resulted in nearly twice as many emergency visits. the c-d-c says boys are twice as likely as girls to get a brain injury.( james ) the risk also increases with age...with kids between 10 and 17 having the highest rate. ( will ) ( will ) in the east bay...get ready to see major changes to the parking situation at the walnut creek bart station. a new bus transit center is now open and there will soon be a new parking garage. ther's also a new bart police substation one big noticiable change is the location of the passenger drop off area. that white zone is no longer right outside the ticket agent booth. you will have to do a little walking to get to the location where passengers are being picked up.

( will ) police in sonoma county are reminding drivers to lock their doors and take out your valuables.....after a man was caught on camera breaking into a cars. surveillance video caught this person walking up to cars in a healdsburg neighborhood. the first car was locked..and then he moves on to the next car..which wasn't locked..he goes inside and rummages through the vehicle...he then checks to see if a third car is unlocked.
